Government's mobile phone data grab is not harmless and Malaysians deserve a say — Wong Kin Chai
JUNE 17 — In 2018 and again in 2022, Malaysians voted for reform, demanding greater transparency, democratic rights, and a government that listens.
That is why the public backlash to recent revelations about the Malaysian Communications and Multimedia Commission's (MCMC) mobile data request has been swift and entirely justified.
According to local and international media reports, including The Edge Malaysia and South China Morning Post, MCMC issued directives to five major telcos requesting mobile phone metadata for the first quarter of 2025.
The fields listed include anonymised user IDs (MSISDN), precise date and time stamps, base station identifiers, GPS coordinates, data type (calls or internet), service type (2G–5G), and mobile country code. On paper, names or Identity Card (IC) numbers were excluded, but in practice, metadata is never truly anonymous.
What the data reveals and why it matters
Let's consider what this sample allows. A user who connects to a transmitter in Taman Tun Dr Ismail every weekday at 7.20am and another in Putrajaya at 8.45am reveals a consistent home-to-work pattern.
Add weekend connections to a location near a cancer centre or a temple, and you have sensitive behavioural data, like one's health or religious beliefs, without ever knowing the person's name.
Even if MSISDNs are masked, consistent patterns over time function like a fingerprint. When combined with public sources such as social media check-ins, delivery logs, or workplace directories, the data can be reverse-engineered and individuals re-identified. The time and location data from one's daily mobile phone use is essentially like an 'invisible IC'.
This is not hypothetical. A peer-reviewed study published in 2013 found that just four spatiotemporal points, such as where and when someone used their phone, are sufficient to uniquely identify 95 per cent of individuals in large anonymised datasets.
Four distinct location points are enough to identify most individuals because human movement patterns are highly distinctive. Just like fingerprints, each person's daily travel routine tends to follow a unique and recognisable path. In other words, location and time are as personal as a name.
These risks are compounded by the absence of legal safeguards. There is no statutory opt-out. The public was never notified, and no clear retention limits or independent oversight mechanisms have been disclosed.
Why the public reacted swiftly
The backlash to MCMC's metadata directive was immediate and cut across political, professional, and generational lines. Civil society organisations, digital rights advocates, opposition leaders, and ordinary citizens voiced strong concerns about the scale of the data requested and the manner in which it was done — quietly and without public consultation or opt-out provisions.
The move was seen as part of a worrying pattern: the use of regulatory powers without adequate transparency, oversight, or legal safeguards. Critics pointed out that the government's explanation, that the data would be used for tourism and digital infrastructure planning, did not justify the level of detail requested.
The controversy intensified when individuals who publicly questioned the programme were subjected to investigations and enforcement action, further fuelling fears that the initiative was less about planning and more about control.
To be fair, the government's intention may not be malicious. There is genuine value in data-driven policymaking. However, without credible safeguards and the absence of open dialogue, what might have been a technical data exercise quickly became a public crisis of trust.
When fear replaces trust
This incident reflects a broader erosion of democratic norms. When governments collect sensitive data without consent or consultation, people stop feeling safe. They self-censor. They avoid dissent. They begin to fear the very institutions meant to protect them.
Malaysia's international standing on civil liberties is already under scrutiny. In the 2024 World Press Freedom Index by Reporters Without Borders, Malaysia dropped to 107th place out of 180 countries, with specific concerns over growing pressure on online platforms. The Straits Times also reported a spike in content takedown requests and censorship during Prime Minister Anwar Ibrahim's first year in office.
The metadata issue cannot be separated from this broader context. When citizens are punished for speaking up, and when data is collected quietly and forcefully, public trust quickly erodes.
Reform is the only path forward
If the government is serious about reform, it must act now to restore public confidence. First, all metadata initiatives must be subject to independent technical audits. The public has a right to know what data is being collected, how long it is stored, and who has access.
People must be given the legal right to opt out of non-essential data collection.
Malaysia's Personal Data Protection Act should be extended to government bodies.
Public consultation must be institutionalised, not reactive. And above all, an independent oversight mechanism must be established — one with enforcement powers and complete political neutrality.
Finally, we must defend freedom of expression. No citizen should face investigation for raising concerns about government policy. If fear has gripped the public, it is not because of misinformation but because of silence.
The stakes are clear
This is no longer a technical matter; it is a democratic one. A country cannot claim to value liberty while quietly collecting personal data without consent. A government that wants to be trusted must first act in ways that are trustworthy.
Metadata may seem harmless to the untrained eye, but in the wrong hands or without rules, it becomes a tool of profiling, exclusion, or control. It is not the data alone that threatens us; it is the lack of oversight and the slow erosion of public voice.
Let data serve the people, not control them.

Ex-senior executive wins final appeal to be reinstated
The Federal Court ruled that Osram Opto Semiconductors Sdn Bhd should pay all outstanding arrears, including statutory contributions, as a result of the reinstatement. PUTRAJAYA : A former senior employee in a Penang-based multinational semiconductor company has won back her job following a unanimous decision by the Federal Court to allow the 58-year-old woman's appeal to be reinstated. A three-member bench chaired by Justice Zabariah Yusof said they agreed with the submission by Ooi Mei Chien's lawyers that the primary remedy for unlawful dismissal was reinstatement as opposed to monetary compensation. Zabariah said Ooi's reinstatement with Osram Opto Semiconductors Sdn Bhd should be immediate and without loss of seniority, years of service, salary and all other benefits and allowances due to her from Jan 1, 2023. The court also ruled that the company should pay all outstanding arrears, including statutory contributions, as a result of the reinstatement. 'The net compensation of RM804,650, in lieu of reinstatement received by Ooi, is to be refunded to the company,' she said, adding that the court order must be complied with within 30 days. Justices Abu Bakar Jais and Vazeer Alam Mydin Meera also heard the appeal. Ooi's counsel Alex De Silva said his client's outstanding salary and allowances for the last 30 months could be about RM1 million. Last year, the Court of Appeal affirmed the High Court's decision that Ooi's retrenchment was not done in good faith, but reversed the High Court's order for reinstatement and instead ordered the employer to pay RM854,650 in compensation to Ooi. The Court of Appeal found compensation in lieu of reinstatement to be the preferred remedy as sending her back to employment was not in line with maintaining industrial harmony. The company had also paid her 24 months' back wages totalling RM772,464, as ordered by the High Court. The Court of Appeal had also affirmed the High Court order to Osram to pay Ooi RM50,000 in punitive damages. According to the facts of the case, Ooi had served Osram, a premium supplier of LED lighting products, for 24 years as head of its treasury and commercial administration services, drawing a monthly salary of RM32,186. In seeking to justify Ooi's retrenchment, Osram said it had outsourced its accounting and treasury function to a global shared services organisation, rendering her role in the company redundant. However, Ooi contended that only some of her functions had been taken over, and that her services were still needed. The Industrial Court in 2019 disagreed, and found Ooi's termination on Sept 30, 2015 to be fair and her redundancy package reasonable. In 2021, the High Court set aside the award, ordering that Ooi be paid back wages of RM772,464 and reinstated to her position. The Court of Appeal maintained that Ooi's retrenchment was in bad faith and also the order for punitive damages was correctly made. However, the Court of Appeal reversed the order for reinstatement with monetary compensation. Ooi was unhappy with the order for compensation in lieu of reinstatement and obtained leave to appeal on four questions of law. De Silva had argued that given Ooi's seniority in position and age, she was unable to find new employment. The Federal Court agreed with Ooi's counsel's submissions that in situations such as this, the primary remedy of reinstatement was the appropriate remedy. Lawyers De Silva, Louis Ambrose, Zuyin Toon and Jessica Chew appeared for Ooi while Arumugam Ganapathy and Moses Mathew George represented the company.

MACC nabs duo over graft involving land applications
Sabah MACC director S Karunanithy said the case is being investigated under Section 17(a) of the MACC Act 2009. KOTA KINABALU : The Sabah chapter of the Malaysian Anti-Corruption Commission (MACC) today detained a civil servant and a government pensioner for alleged involvement in a RM66,000 graft case involving land applications. Bernama quoted sources as saying the two men, in their 50s and 60s, were detained at the Sabah MACC office after having their statements recorded this morning. The duo were suspected of having accepted bribes in connection with a case in 2016, even though they had no power to either approve land applications or conduct a census. 'An initial probe found that the first suspect had allegedly accepted a bribe of RM54,000, while the second person took RM12,000 from several people as an inducement to process their applications and conduct a land census under the state government,' the sources said. Sabah MACC director S Karunanithy confirmed the arrests, saying the case is being investigated under Section 17(a) of the MACC Act 2009.

3 M'sians nabbed in S'pore over evasion of cigarette duty, GST
The three men were arrested and Singapore customs officers seized two Malaysian-registered vehicles and the duty-unpaid cigarettes. SINGAPORE : Three Malaysian men have been arrested for suspected evasion of S$812,384 (about RM2.7 million) in cigarette duty and goods and services tax (GST) following an enforcement operation at Gul Drive. In a statement, Singapore customs said during the operation on June 10, its officers observed the three men, aged 24, 30, and 40, transferring brown boxes between two Malaysian-registered vehicles parked by the roadside. 'Officers moved in to conduct checks and found 7,400 cartons of duty-unpaid cigarettes in a prime mover attached to a trailer, and 100 cartons in a multi-purpose vehicle (MPV). 'The three men were arrested at the scene. Both vehicles and the duty-unpaid cigarettes were seized,' the agency said, adding that the two vehicles had entered Singapore separately. Singapore customs said the 30-year-old suspect had allegedly driven the prime mover from Malaysia, with the duty-unpaid cigarettes concealed among boxes of coffee products. The 24-year-old allegedly assisted with transferring the duty-unpaid cigarettes to the MPV, while the 40-year-old was allegedly tasked with delivering them to customers in Singapore. All suspects are believed to have been recruited by unidentified individuals in Malaysia. Court proceedings are ongoing. Buying, selling, conveying, delivering, storing, keeping, possessing, or dealing with duty-unpaid goods are serious offences under the Customs Act and the GST Act. Offenders can be fined up to 40 times the amount of duty and GST evaded and/or jailed for up to six years. Vehicles used in such offences are also subject to forfeiture.
