
Despite moves by Indiana lawmakers, Illinois' borders unlikely to change. Here's why.

The nearly three dozen Illinois counties where a majority of voters in recent years have expressed their desire to leave the Land of Lincoln won't be joining their neighbor to the east anytime soon — or probably ever — regardless of any recommendation from a bistate commission Indiana Gov. Mike Braun signed off on last month to study the issue.
While the measure creating the commission sailed through the Republican-dominated Indiana statehouse on its way to the GOP governor's desk, a companion proposal from one of Illinois' most conservative state lawmakers went nowhere in the Democratic-controlled General Assembly before it adjourned its spring session.
The disparate responses in Indianapolis and Springfield to the proposed creation of an Indiana-Illinois Boundary Adjustment Commission, described by supporters as a conversation starter but decried by critics as a pointless political stunt, are emblematic of the yawning political divide between the states despite their deep geographic and economic ties.
Here's a look at how we got here and what comes next.
When it comes to changing existing state boundaries, the U.S. Constitution is fairly clear.
Article IV Section 3 reads: 'No new State shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or Parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress.'
In plain English, that means the 33 Illinois counties that have had successful — though nonbinding — referendums seeking secession can't join Indiana without the approval of each state's legislature and of Congress. And if they wanted to form their own new state, the counties still would need lawmakers in both Springfield and Washington, D.C., along with Illinois' governor and the president, to sign off.
Such changes aren't entirely unprecedented. Kentucky, for example, joined the Union in 1792 after its breakaway from Virginia was approved in the state legislature and Congress. Similarly, Massachusetts lawmakers gave their approval for Maine to become its own state, a move that Congress formalized in 1820 as part of the Missouri Compromise, which also admitted Illinois' southwestern neighbor as a slave state.
One state, however, did manage to carve itself out of an existing state without strictly adhering to the process laid out in the Constitution: West Virginia. But that move came amid the Civil War, after Virginia seceded from the Union and its capital became the seat of the Confederacy. President Abraham Lincoln signed a measure creating the state of West Virginia in 1863. After Virginia was readmitted to the Union, the U.S. Supreme Court upheld West Virginia's statehood.
Regional animosities have existed in Illinois since before it was admitted to the Union in 1818 as the 21st state and only grew stronger with Chicago's rise as an economic powerhouse in the late 19th and early 20th centuries, according to a 2022 report from the Paul Simon Public Policy Institute at Southern Illinois University.
After the state narrowly voted in 1860 to send Lincoln from Springfield to the White House, Confederate sympathies lingered in some areas. Union troops were stationed in the southern Illinois town of Olney to enforce the draft, and a deadly clash between Union soldiers and pro-slavery Copperheads broke out in Charleston, now home to Eastern Illinois University, in 1864.
Over the 160 years since the Civil War ended, the urge to separate has bubbled up from time to time. The Chicago City Council in 1925 passed a resolution to look into secession over concerns about the city's representation in Springfield; residents of western Illinois in the 1960s and '70s created the tongue-in-cheek Republic of Forgottonia; and the state Senate in 1981 approved a Democratic legislator's facetious resolution urging Congress to make Chicago and the rest of Cook County 'New Illinois,' the 51st state.
In the Donald Trump era, as Democrats have firmly consolidated their control of Illinois government, some on the political right, largely downstaters, have picked up the 'New Illinois' mantle, pushing unsuccessful state legislation and successful but legally weightless countywide resolutions seeking to cleave the state in two.
Most recently, in November voters in seven downstate counties — Iroquois on the Indiana border and Calhoun, Clinton, Greene, Jersey, Madison and Perry near the Missouri state line — approved ballot measures calling for a divorce from Chicago and Cook County.
The recent rumblings from downstate Illinois have caught the attention of lawmakers across the border in Indiana, where dominant Republicans are eager to position their state as a low-tax, low-regulation alternative to deep-blue Illinois.
In the only bill he introduced during the spring session, Indiana House Speaker Todd Huston called for the creation of a bistate commission 'to discuss and recommend whether it is advisable to adjust the boundaries between the two states.'
'These people (in downstate Illinois) literally went and voted. They have spoken,' Huston told the Post-Tribune in January. 'Whether Indiana is the right solution or not, they've expressed their displeasure. We're just saying, if you've expressed your displeasure, we'd love to have you.'
Originally calling for equal representation from each state, the measure was modified as it became clear Illinois Democrats weren't having it. The final version Braun signed into law, opposed by Democrats and a few Republicans in his state, gives Indiana a one-seat majority on the panel, allowing it to meet without any input from Illinois.
Under the Indiana law, Braun must appoint six members to the commission, notifying Illinois Gov. JB Pritzker of his selections, and schedule its first meeting by Sept. 1.
When the Indiana proposal made headlines early this year, it quickly became clear, if there was ever any doubt, that Illinois Democrats had no interest in playing along.
'It's a stunt. It's not going to happen,' Pritzker said at an unrelated news conference in January. 'But I'll just say that Indiana is a low-wage state that doesn't protect workers, a state that does not provide health care for people in need, and so I don't think it's very attractive for anybody in Illinois.'
Even those pushing hardest for an Illinois breakup don't appear overly eager to be subsumed into Indiana.
'Our goal is the constitutional formation of a new state separate from Illinois,' G.H. Merritt, who leads the group New Illinois, told Indiana lawmakers at a hearing in February, the Post-Tribune reported.
Nevertheless, in the Illinois House, Republican Rep. Brad Halbrook of Shelbyville, a member of the ultraconservative state Freedom Caucus who in the past has filed resolutions calling for Chicago to become its own state, in January filed a proposal for Illinois to join Indiana in creating the boundary commission.
But Halbrook's proposal was never given a hearing or even assigned to a committee this spring.
At a statehouse news conference during the closing days of the legislative session in late May, Halbrook and some of his Freedom Caucus colleagues bristled when asked how they hoped to move the conversation forward in Illinois when Democratic leaders won't let the proposal see the light of day.
The real question, Rep. Blaine Wilhour of Beecher City said, is why the counties that have voted in favor of secession 'want out of Illinois so bad?'
'That's the question that you need to be asking,' Wilhour said. 'But nobody asks it. They want out of Illinois because they're not being respected by their government. Their government continues to push policies that drives away every one of their opportunities.'
Tacitly acknowledging the futility of the effort, Halbrook said, 'We don't need a new state; we need a new governor, and that's the bottom line.'
Illinoisans will have a chance to elect a new governor next year. Pritzker, who has won two terms by double-digit margins, has yet to say whether he'll seek a third.

The Archaic Sex-Discrimination Case the Supreme Court Is Reviving
The Supreme Court's decision last week in United States v. Skrmetti will have direct consequences for many transgender minors. Tennessee's law, which the Court upheld, prohibits people under age 18 from accessing certain kinds of treatment, such as hormones and puberty blockers, to treat gender dysphoria (the condition in which an individual's sex does not align with their gender identity). But the consequences will be indirect as well, and reach beyond the realm of transgender rights—potentially representing a setback for gender equality and the enforcement of antidiscrimination law. The majority opinion, written by Chief Justice John Roberts and joined by the five other Republican appointees, revives an outdated case, Geduldig v. Aiello, that blessed discrimination based on archaic thinking. If the Republican appointees plan to revive this older case, they will take the law and the country back to a time when the government used the existence of 'biological differences' between men and women to excuse all kinds of discrimination against women. The Court's logic underscores the extent to which the ideology and methodology of the conservative justices threaten many of the hard-fought civil-rights protections of the 20th century. The key issue in Skrmetti was whether Tennessee's law, and others like it, requires heightened constitutional scrutiny. The Court said it does not and rejected two different theories to the contrary—first, that the law discriminates on the basis of sex, and second, that the law discriminates on the basis of gender identity against trans minors. Roberts's majority opinion first insisted that the law does not constitute sex discrimination because it concerns a medical procedure for minors—the law prohibits using hormones or puberty blockers to treat minors for gender dysphoria. Therefore, Roberts reasoned, the law distinguishes between persons on the basis of medical treatment and age rather than sex. Adam Serwer: The attack on trans rights won't end there Roberts next explained that the law does not constitute discrimination on the basis of gender identity—discrimination against transgender individuals as such. The Court's logic went as follows: Although the law restricts access to hormones and puberty blockers to treat gender dysphoria, both transgender and cisgender individuals can access these treatments for other conditions. Therefore, the Court suggested, even though transgender people are the only group negatively affected by the law, it still does not amount to discrimination against them, because they, along with cisgender individuals, can still receive hormones and puberty blockers as treatment for conditions other than gender dysphoria. (In a concurring opinion, Justices Amy Coney Barrett, Clarence Thomas, and Samuel Alito indicated that even if a law did specifically and overtly discriminate on the basis of transgender status, they still would not subject the law to heightened scrutiny.) As support for the majority's claims, the Court cited Geduldig v. Aiello, a 1974 case about sex discrimination that somewhat infamously concluded that discrimination on the basis of pregnancy does not constitute discrimination on the basis of sex. The case concerned California's disability-insurance program, which excluded coverage for any disabilities arising from pregnancy. Sure, the Geduldig Court acknowledged, the group excluded from the disability-insurance program by the pregnancy-discrimination provision included only women. But the group of people who could access the state's disability-compensation benefits for reasons other than pregnancy included both women and men. 'The program divides potential recipients into two groups—pregnant women and nonpregnant persons. While the first group is exclusively female, the second includes members of both sexes,' the Court wrote. In other words, the law didn't exclude all women from coverage, just those women who were unable to work because of pregnancy. Geduldig also gestured to the idea that pregnancy reflects an objective biological condition, which, the all-male justices explained, made the law legitimate and meant that the law was not a form of discrimination. 'Normal pregnancy,' the justices opined, 'is an objectively identifiable physical condition with unique characteristics.' At the time Geduldig was decided, laws that explicitly and specifically discriminated on the basis of sex were not subject to heightened judicial scrutiny. The courts instead excused and explained away the discrimination by invoking the biological differences between men and women—legitimate reasons for legitimate discrimination. Many observers of constitutional law thought, until recently, that Geduldig had been consigned to history. The decision was viewed as an anomaly and outdated not only because of its reasoning, but also because it had been whittled away and rejected by both Congress and the Supreme Court. Congress overturned the result in Geduldig when, in 1978, it designated pregnancy discrimination as a species of sex discrimination. The Supreme Court also declined to apply Geduldig in cases where states sought to invoke biological differences between men and women to excuse discrimination against women. For example, in United States v. Virginia, the Court rejected the argument that Virginia could maintain a men's-only military-leadership academy because the state insisted that women, due to their biology, could not conform to the school's rigorous methods. Although Congress, by statute, prohibited pregnancy discrimination in employment, that did not change the Constitution. Similarly, although the justices weakened or ignored Geduldig, they never outright overruled it. Justice Ruth Bader Ginsburg called for Geduldig to be formally overruled, perhaps recognizing that the Court's failure to do so left the decision available to be invoked in the future to protect other discrimination. Garrett Epps: What 'because of sex' really means In Skrmetti, the Court dropped even more hints that it is open to green-lighting more sex discrimination. Roberts's majority opinion acknowledged that 'a law that classifies on the basis of sex may fail heightened scrutiny'—but, it continued, the law would fail only ' if the classifications rest on impermissible stereotypes,' as opposed to permissible ones such as those rooted in biological differences (emphasis added). The Republican-appointed justices have now indicated that Geduldig is making a comeback. When the Supreme Court overruled Roe v. Wade, Alito's majority opinion invoked Geduldig to declare that abortion restrictions do not amount to sex discrimination. Such restrictions, Alito wrote, are about a medical procedure tied to the biological differences between men and women. By invoking Geduldig, the Roberts Court is doing what the Supreme Court of earlier eras did: supplying tortured legal logic to justify long-standing hierarchies. In Plessy v. Ferguson, for example, the Court insisted that laws that required white and Black individuals to ride in different train cars were not impermissible racial discrimination—the rules applied to and burdened everyone, after all. That logic sounds like the thread in Skrmetti that maintains that bans on gender-affirming care don't constitute gender-identity discrimination because the bans allow transgender and cisgender kids to access hormones and puberty blockers—just not for treatment of gender dysphoria. In Korematsu v. United States, the Court claimed that the internment of Americans of Japanese descent did not constitute racial discrimination; the policy was about national security. That reasoning tracks with Skrmetti 's insistence that the health-care bans do not discriminate on the basis of sex or gender identity; they are about age and medical procedures. The decisions in Plessy and Korematsu are rightly reviled today. Geduldig should be as well. Instead, the country has a Court that is turning to it as precedent, repurposing it to justify a new era of legal discrimination.

Why Won't Zohran Mamdani Denounce a Dangerous Slogan?
Zohran Mamdani's opponents paint him as a dangerous radical. The young, socialistic candidate for New York City mayor wishes to dispel that perception—in some ways. Last week, he appeared on a podcast with The Bulwark 's Tim Miller, a former Republican and the sort of moderate Mamdani knows he needs to win over, or at least neutralize, if he is to carry this week's Democratic primary. As Miller presented a litany of concerns about Mamdani's plans to freeze stabilized-housing rent, establish city-run groceries, and other offenses against Econ 101, the candidate expressed a willingness to hinge his policies on outcomes and abandon his plans if they failed. But when Miller asked Mamdani about the pro-Palestine slogan 'Globalize the intifada,' the candidate's pragmatism and intellectual humility evaporated. 'To me, ultimately, what I hear in so many is a desperate desire for equality and equal rights in standing up for Palestinian human rights,' he said. Mamdani may sincerely believe this, as do some of his supporters. But he then delved into the semantics of intifada, citing the United States Holocaust Memorial Museum's use of the word as the translation of 'uprising' in an Arabic version of an article the museum published about the Warsaw Ghetto. This comparison, to a Jewish armed rebellion against the Nazis, hardly dispels concern about the incendiary implications of the slogan. If the intifada is akin to the ghetto uprising, then it is a call for violence. If its theater of operations is global, then it is necessarily directed against civilians. Days before the Democratic primary, when Mamdani appeared to be gaining momentum, the controversy about his comments on Miller's show dragged the race's focus back to the Middle East, a subject that Mamdani has not emphasized in his campaign. Yet this debate has largely missed the significance. What makes the slogan so disturbing in an American context is not the intifada bit. It's the globalize part. An unfortunate spillover effect of the war between Israel and Hamas is its extension into U.S. politics. If we are heading toward a future in which even candidates for local office in the United States run on their position toward the Middle East, American politics will come to resemble that intractable conflict. The pluralist alternative is to confine conflict over Palestine and Israel to any national elected office that could have actual influence on U.S. foreign policy. Everybody needs to be willing to live with a mayor who does not share their personal solution to the Israel-Palestine conflict. Mamdani's defense of globalizing the intifada has spurred more commentary about his left-wing views on the Israeli-Palestinian conflict. But his beliefs about Israel are not the concern. The intifada is taking place inside Israel and the Occupied Territories. Globalizing the intifada definitionally involves events outside that region. Jeffrey Goldberg: Sinwar's march of folly Even if globalizing the intifada doesn't have to mean global violence, that interpretation is plausible. Indeed, some people inspired by the free-Palestine movement do take the slogan literally. Supporters of the movement have engaged in harassment, graffiti, and violence and terrorism against Zionists worldwide. In recent months, pro-Palestine activists have carried out homicidal or potentially homicidal attacks in Pennsylvania; Washington, D.C.; and Colorado. The ambiguity of the slogan is not a point in its defense but a point against it. The dual meanings allow the movement to contain both peaceful and militant wings, without the former having to take responsibility for the latter. If activists refused to employ slogans that double as a form of violent incitement, it would insulate them from any association with the harassment and violence that has tainted their protests. Their failure to do so reveals an unwillingness to draw lines, as does Mamdani's reluctance to allow any daylight between him and their rhetoric. Mamdani is neither stupid nor politically naive. He has backtracked on his previous support for defunding the police and, as mentioned, courted moderates (such as my colleague Derek Thompson, in an interview for the latest episode of his podcast, Plain English) by saying that his governing agenda would be driven by outcomes over ideology. If Mamdani is willing to absorb the political pain of tying himself to a slogan that many Jews find frightening, in an election in which they constitute a major voting bloc, his gloss on the slogan implies a genuine commitment to everything the slogan represents. Mamdani insisted to Miller, evasively, that he won't repudiate globalizing the intifada because, as he put it, 'the role of the mayor is not to police language.' Yet there's no rule in politics that says a mayor or a candidate can't criticize political rhetoric. Nor has Mamdani bound himself to such a prohibition: He has policed the terminology of his opponents by, for instance, complaining that he has faced 'dehumanizing language' as a Muslim candidate for office. Mamdani defended himself by denouncing anti-Semitism in broad terms and painting his opponents as cynics for using imputed anti-Semitism as a political cudgel against him. This offers little reassurance. Almost everybody is willing to renounce anti-Semitism on the opposite side of the political spectrum. The far right is stuffed with philo-Semites, who are willing and eager to attack the scourge of Jew hatred so long as it is on the left, while ignoring or apologizing for the rise of anti-Semitism in their own ranks. The key test of principle—the only test, really—is whether you are willing to call out your allies' hatred. Mamdani's refusal on this crucial point is a signal that he will downplay anti-Semitism when it springs from the pro-Palestine movement. American Jews should be willing to accept a candidate for municipal office who does not share their views about the Middle East. (Arab and Muslim Americans have long been obliged to do so.) A candidate who does not take seriously an incitement to violence against other Americans, though, is not something anybody should have to accept.
