New York real estate industry appeals broker-fee case ruling
[NEW YORK] Real estate groups are challenging a ruling by a federal judge that allowed New York City to begin enforcing a new law requiring landlords, rather than their tenants, to pay fees for hiring listing brokers.
US District Judge Ronnie Abrams on Tuesday (Jun10) denied a request by the Real Estate Board of New York, the New York State Association of Realtors and others to pause the law while their lawsuit proceeds. The ruling was another setback for the industry's legal fight against the measure, which went into effect on Wednesday (Jun 11).
The groups on Thursday filed an appeal of Abrams' decision to the US Court of Appeals for the Second Circuit. The City Council adopted the measure in November to end the longstanding practice of tenants being forced to pay costs incurred by landlords to hire the brokers who list their properties, which can add thousands of dollars to housing costs. The real estate industry argued the new law branded brokers as villains and would force landlords to raise rents to cover the costs of hiring them.
New York City renters who settle on apartments that have broker fees pay an average of almost US$13,000 to secure the keys to a property, which frequently includes thousands of dollars in fees for brokers hired by landlords to secure tenants, according to an analysis by StreetEasy released last year. Roughly 40 per cent to 50 per cent of listings on StreetEasy have required lease signers to pay the commissions of agents hired by their new landlords, which have typically ranged from one month's rent to 15 per cent of the annual bill.
The Real Estate Board contends that the law, known as Fairness in Apartment Rental Expenses Act, or FARE Act, interferes with exclusive agreements that landlords sign with brokers to list their properties and find tenants, in violation of the Constitution's bar against state laws impairing private contracts. It also argues the law violates the free-speech rights of landlords and brokers who publish real estate listings and then seek to receive compensation from tenants for the cost of the listing service.
The industry's lawsuit alleges that the law will make rent-stabilised apartments too costly to operate and force landlords to raise rents to cover the cost of broker fees. The industry says tenants usually pay less over the life of a lease when commissions are paid separately, and that some are already refusing to pay broker fees even though the law hasn't taken effect yet.
A state-approved broker-fee ban was briefly in place in February 2020, just before the first Covid lockdown brought the rental market to a near halt. By the time renter demand began rising the next year, a court had struck down the state law and brokers were eager to capitalise on what quickly became a very competitive market where prices have continued to rise.
The law could dramatically change the dynamics of the city's highly competitive rental market, where prices have soared since pandemic restrictions began easing in 2021. The median cost of new Manhattan leases was US$4,571 in May, reaching another all-time high, according to appraiser Miller Samuel and Douglas Elliman. PHOTO: AFP HOUSTON - Minutes after an immigration judge rejected his asylum case earlier this week, Oscar Gato Sanchez was arrested as he exited a federal courthouse in Houston. 'I'm a Cuban citizen unjustly arrested,' he told AFP as plainclothes officers led him away on June 9. His aunt Ms Olaidys Sanchez, a 54-year-old legal resident of the United States, sobbed against a nearby wall. Her nephew was placed in an unmarked gray vehicle that took off with sirens blaring, heading towards an immigrant detention center in Conroe, about 80 kilometers north of Houston, according to official documents. Gato Sanchez is now among dozens of migrants detained there, awaiting deportation. In recent weeks, there has been an uptick of immigration enforcement operations at courthouses, as thousands of migrants pursue the asylum process by attending hearings. Agents from US Immigration and Customs Enforcement (ICE) enter the court facilities unidentified, migrant advocates say, and those who do wear badges often cover their faces. Since President Donald Trump returned to power in January, ICE has been authorised to conduct enforcement activities in courts. AFP journalists have also witnessed arrests at courthouses in New York. In late May, US media published footage from a court in San Antonio, Texas, where a woman who had just been arrested cried out to ask anyone in earshot to pick up her children from school. Meanwhile, a young boy tried to comfort his mother as they were loaded into a vehicle to be taken away. Gato Sanchez entered the United States in December 2023. Like many other migrants, he turned himself in to authorities after arriving and was freed on condition that he appear in court at a later date. He filed an aslyum petition in May 2024 and went on Monday to the Houston court, where a date was to be set for a hearing on his case. Instead, a judge rejected the petition, after a public prosecutor said it was 'no longer in the best interest of the government,' said Ms Bianca Santorini, a lawyer who began representing Sanchez immediately after his arrest. 'If you're here without legal status, as soon as your case gets dismissed, the case doesn't exist anymore, the asylum application doesn't exist anymore,' she told AFP. 'So as soon as he walks out, he's here with nothing pending,' and it's at that vulnerable moment that the arrest occurs, she added. Ms Santorini believes ICE now has informants inside the courtroom. 'They're not walking to every person who walks out of court and saying 'let me see your paperwork, let me see what happened.' They already know when people walk out of court what happened,' she said. Even though he had an aslum applicaiton pending, Gato Sanchez will not get his day in court, despite the Constitution guaranteeing such a right, she added. 'It doesn't guarantee you'll win. It doesn't guarantee you get to stay, but it guarantees you have a day in court. Give me the day in court,' she said. The majority of immigrants present themselves in court in good faith, said Mr Cesar Espinosa, executive director of the immigrant-rights organisation FIEL. 'Most of these people are following some sort of law, whether it's asylum law or even showing up to court. They're here trying to do the right thing, to try to see if they can fight their case,' he said. In Los Angeles, an ICE operation targeting undocumented workers outside a home improvement store set off demonstrations and clashes that resulted in Mr Trump's controversial decision to send in the US National Guard and Marines. Mr Espinosa said some Americans had welcomed the anti-immigrant raids and complained about the people being detained. Hong Kong – Canary in a goldmine
THE perception of Hong Kong's decline as a financial hub and desirable place to live is both understandable yet overstated. During a recent business trip to Europe, one consistent reaction stood out: Clients' faces flashed with concern and sympathy when I mentioned I was based in Hong Kong. I get it. For years, the narrative around Hong Kong has been relentlessly downbeat: falling property prices; the 2019 protests; Covid lockdowns; expat departures; strained US-China relations; and renewed worries about the stability of the HKD-USD peg. The concerns are valid but, as I argue below, also misplaced. Which major equity market has outperformed most others in 2025? Which market ranks fourth globally by capitalisation, trailing only the United States, mainland China, and Japan? Which market raised more in IPOs than Europe's exchanges combined this year? And which economy welcomed more tourists than Japan from January to May 2025? If you answered Hong Kong to all, you're absolutely correct. Surprised? Let me explain. Golden goose My optimism about Hong Kong's future hinges on its currency: the Hong Kong dollar (HKD). Within the Greater China region, no other city matches its currency's liquidity and convertibility (with apologies to Macau's pataca). Corporate China's unquenchable demand to recycle hard currency is well known, and until the renminbi becomes convertible – likely a distant prospect – Hong Kong's role as China's premier funding conduit remains secure. But what about the HKD-USD peg's vulnerabilities? Recent media reports have highlighted pressures on the peg, and these concerns are reasonable. Yet, the strain isn't from capital flight; it's the opposite. Inflows from IPOs, dividends, and investment opportunities are so robust that the Hong Kong Monetary Authority (HKMA) had to sell some HK$47 billion (S$7.6 billion) in May 2025 to temper HKD appreciation. Of course, an appreciating currency is a nice problem to have, as are interest rates at – or close to – record lows. But, either way, both are still problems if allowed to endure, potentially distorting the allocation of capital. Sign Up Sign Up To be fair, the allure of a USD carry trade (selling HKD and investing in US money market funds for example) has seen the HKD's value normalise. But even two weeks on from the last mega-IPO, the monetary system remains awash with liquidity, allowing banks to reset mortgages rate lower and allowing refinancing opportunities for the beleaguered commercial real estate sector. Local hero With roughly comparable populations, land mass, and economic size, the friendly competition between Hong Kong and Singapore as rival business centres is as storied as it is long-running. Anyone who has recently visited Singapore will have been mightily impressed by the energy, opportunity, and confidence that the city state currently exudes; and might conclude – reasonably – that Hong Kong has (temporarily) lost its mojo to its ascendent challenger. Yet, Hong Kong's role as China's financial gateway also gives it both a role and an edge, certainly in the ability to offer local companies liquidity for financing purposes. For example, Hong Kong's stock market has a total market capitalisation of US$6.3 trillion, entirely dwarfing Singapore's at merely US$0.5 trillion, a 13-fold difference. As China corporates consider delisting from the US or dual list in Hong Kong, one can assume Hong Kong's market capitalisation may likely increase. Admittedly something of a stealth rally, the Hang Seng Index (HSI)'s year-to-date performance – largely complementing and reflecting renewed interest in China – may also have attracted international investors. At time of writing, the HSI was up 21 per cent on the year, outperforming the majority of competitor markets. My sense is as investors rotate thematically from US exceptionalism to – among other things – (China-centric) emerging market opportunities, local equities may further benefit in the months and quarters to come. Canary's fragility Yet for all Hong Kong's recent positives, as a financial entrepot it is both sensitive and vulnerable to the volatilities of global trade. And that is unlikely to change anytime soon. Thus, strained trade relations between the US and China – and the risk of high tariffs being imposed by the former on the latter – will negatively impact the city's fortunes. Inevitably, Hong Kong reliance on mainland inflows – with some 80 per cent of Hong Kong Exchanges and Clearing's market cap tied to Chinese firms – exposes it to China's economic slowdown risks. Escalating geopolitical tensions or a faltering Chinese economy could trigger occasional liquidity shocks, potentially derailing Hong Kong's markets for a while. At Lombard Odier, we are overweight equities, including those in emerging markets. Our preferred way to access China risk is via Hong Kong's H Share market. Thus far, it has been a satisfactory trade. But Hong Kong's East-West history positions it – somewhat uniquely – in the crosshairs of tensions between the world's two great superpowers. US judge blocks Trump administration from overhauling federal elections

PHOTO: REUTERS BOSTON - A federal judge on June 13 blocked President Donald Trump's administration from implementing parts of his sweeping executive order overhauling federal elections, including by requiring proof of US citizenship to register to vote and barring states from counting mail-in ballots received after Election Day. US District Judge Denise Casper in Boston issued a preliminary injunction at the behest of 19 Democratic-led states who had argued that the Republican president lacked the authority to mandate changes to elections and the states' voting procedures. The lawsuit is one of several across the nation challenging Mr Trump's March 25 executive order, which he signed after years of raising doubts about the integrity of the US electoral system and falsely claiming that his 2020 loss to Democratic former President Joe Biden resulted from widespread voter fraud. While parts of Mr Trump's order had already been blocked in April by a judge in Washington, Judge Casper's ruling went further as she concluded the states had established key pieces of the president's order were likely unlawful and unconstitutional. 'The Constitution does not grant the president any specific powers over elections,' Judge Casper, an appointee of Democratic president Barack Obama, wrote. She said 'the text of the Election Day statutes require only that all votes are cast by Election Day, not that they are received by that date'. As a result, nothing bars 13 of the suing states that accept mail-in ballots postmarked by Election Day from counting them, the judge wrote, as she blocked the US Department of Justice from pursuing civil or criminal enforcement actions against any states that do not comply with Mr Trump's order. Judge Casper also faulted provisions of Mr Trump's order tasking the US Election Assistance Commission with updating the federal voter registration form to require people to submit documentary proof they are US citizens. She said no one disputes that US citizenship is required to vote in federal elections, but 'the authority for election requirements is in the hands of Congress', which has never required documentary proof of citizenship. The White House did not respond to a request for comment, but the administration in court had argued that Mr Trump's order was lawful and that any legal challenge to its provisions was premature. In announcing the executive order, Mr Trump said it was needed to 'straighten out our elections'. He and his Republican allies have made baseless claims about widespread voting by non-citizens, which rarely occurs.
