
America's Prison Population Is Finally in Serious Decline
For more than 40 years, the United States—a nation that putatively cherishes freedom—has had one of the largest prison systems in the world. Mass incarceration has been so persistent and pervasive that reform groups dedicated to reducing the prison population by half have often been derided as made up of fantasists. But the next decade could see this goal met and exceeded: After peaking at just more than 1.6 million Americans in 2009, the prison population was just more than 1.2 million at the end of 2023 (the most recent year for which data are available), and is on track to fall to about 600,000—a decline of roughly 60 percent.
Discerning the coming prison-population cliff requires understanding the relationship between crime and incarceration over generations. A city jail presents a snapshot of what happened last night (for example, the crowd's football-victory celebration turned ugly). But a prison is a portrait of what happened five, 10, and 20 years ago. Middle-aged people who have been law-abiding their whole life until 'something snapped' and they committed a terrible crime are a staple of crime novels and movies, but in real life, virtually everyone who ends up in prison starts their criminal career in their teens or young adulthood. As of 2016—the most recent year for which data are available—the average man in state prison had been arrested nine times, was currently incarcerated for his sixth time, and was serving a 16-year sentence.
Because of that fundamental dynamic, the explanation for why roughly 1.6 million people—more than 500 for every 100,000 Americans—were in a state or federal prison in 2009 has very little to do with what was happening on the streets or with law-enforcement policies that year. Rather, the causes lay in the final decades of the 20th century.
From the end of World War II until the mid-1970s, the proportion of Americans in prison each year never exceeded 120 per 100,000. But starting in the late 1960s, a multidecade crime wave swelled in America, and an unprecedented number of adolescents and young adults were criminally active. In response, the anti-crime policies of most local, state, and federal governments became more and more draconian. The combined result was that the prison population exploded. By 1985, the imprisonment rate had doubled from its historical norm, such that more than 200 in 100,000 Americans were in a state or federal prison. The number of people in prison increased an average of 8 percent a year for the next decade, breaching the 1 million mark in 1994 and continuing to grow until 2009. This had ramifications that were felt for years: Because most people who are released from prison return, the system has been stocked and restocked with the legacy of that American crime-and-punishment wave for a quarter century. That's why the 2009 peak of U.S. imprisonment came 18 years after the 1991 peak in the violent-crime rate. The prison system is like a badly overloaded tractor trailer—it takes a long time to stop even after the brakes are hit.

That tractor trailer is finally slowing down, decades after the 'great crime decline' began in the 1990s. Until 2009, the lengthier sentences handed down during the preceding crime wave and the tendency of released prisoners to be re-incarcerated kept imprisonment rising even as crime declined. But the falling crime that the U.S. experienced in the 1990s and 2000s is now finally translating into a shrinking prison population.
This chart, using data from the U.S. Department of Justice, shows the collapse of criminal arrests of minors in the 21st century. Rapidly declining numbers of youth are committing crimes, getting arrested, and being incarcerated. This matters because young offenders are the raw material that feeds the prison system: As one generation ages out, another takes its place on the same horrid journey. The U.S. had an extremely high-crime generation followed by a lower-crime generation, meaning that the older population is not being replaced at an equal rate. The impact of this shift on the prison population began more than a decade ago but has been little noticed because it takes so long for the huge prison population of longer provenance to clear.
But such a transformation is now well under way. One statistic vividly illustrates the change: In 2007, the imprisonment rate for 18- and 19-year-old men was more than five times that of men over the age of 64. But today, men in those normally crime-prone late-adolescent years are imprisoned at half the rate that senior citizens are today.
As the snake digests the pig year after year, the American prison system is simply not going to have enough inmates to justify its continued size or staggering costs. Some states that are contemplating expanding their prison capacity will be wasting their money—their facilities will be overbuilt and underused. By 2035, the overall imprisonment rate could be as low as 200 per 100,000 people. States should instead be tearing down their most deteriorated and inhumane correctional facilities, confident that they will not need the space.
This optimistic analysis could have been written in 2019, when the imprisonment rate had been falling for more than a decade and hit a level not seen since 1995. I thought about writing this article then, but a world turned upside down shook my confidence.
COVID initially looked like a boon for decarceration because states reduced prison admissions and accelerated releases in 2020 to reduce transmission, cutting the prison population by 16 percent. But whether it was due to this mass release, COVID, de-policing, other factors, or some combination thereof, crime exploded in 2020 after a long quiescent period, most shockingly with an unprecedented 30 percent increase in homicides. Crime spikes increase incarceration directly because more people are committing crimes and also because they lead the public to demand more aggressive policies, which often translate into longer and more frequent prison sentences. If the turmoil of the early 2020s had led to an extended period of high crime and high punishment similar to what the U.S. experienced in the late 20th century, the COVID-era contraction of the prison population could have been immediately nullified and then some when, in the ensuing years, the prison pipeline was eventually replenished.
But thankfully, the spike was just a spike, not a new equilibrium. Crime stopped rising sometime in 2022, and fell in 2023 and 2024. The prison population inched up 2 percent in 2022 and again in 2023, and it is possible that a similar rise took place in 2024, but even collectively, this is a fraction of the sudden population decline during the early pandemic. The COVID era ended with prison populations lower rather than higher: A recent Vera Institute report found that, on balance, from 2019 to the spring of 2024, the number of federal prisoners declined by 11 percent, and the number of state prisoners declined by 13 percent.
Accelerating the de-prisoning of America is worthwhile and possible. The benefits of a smaller prison population are not limited to those who would otherwise be locked up and the people who love them. Prisons crowd out other policy priorities that many voters would like the government to spend more money on. In all 50 states, the cost to imprison someone for a year significantly exceeds the cost of a year of K–12 education. But even greater than the financial savings would be the prosperity in human terms: Less crime and less incarceration are profound blessings for a society.

The simplest available policy to accelerate the decarceration trend is to stop building prisons except in cases where a smaller, modern facility is replacing a larger, decaying institution. Though it will be nonintuitive to many reformers, particularly on the left, opposition to any such new facilities being private should be dropped. The principal political barrier to closing half-full prisons is the power of public-sector unions. In contrast, a private prison can be sent to its reward if its contract is canceled. Individual communities in areas of low employment will also fight to keep their prisons. Prison-closing commissions, analogous to military-base-closing commissions, may be necessary and should coordinate with legislators to provide worker retraining and financial assistance to compensate for the loss of high-wage jobs in communities whose economy revolves around corrections.
Finally, America should not let its prison system become the most expensive and inhumane of nursing homes. The rate of recidivism among senior citizens is near zero, and compassionate release of sick and aging inmates should be the default rather than the exception, a reversal of current practice.
In any given future year, small rises in imprisonment are possible, but the macro trend is ineluctable: Society is going to experience the benefits of past decades of lower crime throughout its prison system. The imprisonment rate will be lower in five years and lower still in 10. Prisons will still exist then and still be needed, but the rate at which Americans are confined in them could be lower than anything in the preceding half century. This is the fruit of a lower-crime society—good in and of itself, surely, particularly for the low-income and majority-minority communities where most crime occurs. It will also, of course, be a blessing for those who avoid prison, and for the taxpayers who no longer have to pay for it. The decline in the prison population will be something everyone in our polarized society will have reason to celebrate.

It's because they don't trust their own young people to take the reins — they're terrified of them. During the recent LA riots, moderate Democrats on X were openly pleading with activists to scale back their violence — or at the very least, to wave American flags and soften the brutal optics that were being transmitted to every corner of the nation. But those pleas were ignored: That's not who the leftists are, and they're not going to pretend otherwise anymore. And they wouldn't be caught dead with an American flag. For decades now, Democrats have cultivated these increasingly radical shock troops. College campuses became political training camps to serve left-wing interests, and our urban centers became breeding grounds for well-funded activists — backed by NGOs and nonprofits — ready to mobilize on demand. Advertisement For a while, this arrangement worked; Democrats were happy to corrupt our institutions so long it kept paying political dividends — electoral victories, fearful corporations, cultural cachet. But they were playing with fire as each generation of young Democrats moved further left than the last. Less tolerant of dissent or compromise. More insular and parochial. National Democrats will have to reconcile this embarrassment to voters in the rest of the country looking on with horror and disbelief. Good luck to them. How could a city struggling with crime and violence nominate a radical who wants to defund the police? Democrats will struggle to answer those questions. But the explanation is very simple — young urban progressives have completely lost the plot, yet they're the party's energy, the ones who get out and vote, the ones who get the clicks and views, the ones who volunteer and phone-bank and door-knock. Advertisement And they're going to relegate the Democratic Party to a permanent minority — with iron-fisted control over our deep blue cities, and very little beyond them. Extremism isn't a great long-term strategy for a national party. It tends to play poorly with exactly the sort of voters Democrats need to win back. And they're about to learn that lesson the hard way: Mamdani is a walking campaign advertisement for congressional Republicans in the midterms. As Vice President JD Vance posted Tuesday night on Bluesky, 'Congratulations to the new leader of the Democratic Party @zohrankmamdani.' Frankly, a general-election defeat would be the best-case scenario for Democrats now, sparing them years of embarrassment as Mamdani destroys this city. As a New Yorker, I pray that's the outcome. Col. McCormick's Tribune blamed FDR and Truman for events leading to outbreak Korean War 75 years ago
The United States was caught by surprise when heavily-armed North Korean troops and tanks poured into South Korea on June 25, 1950. But the Chicago Tribune had predicted America's enemies would pull just such a trick. Hastily flying back to Washington from his Missouri home, President Harry Truman acknowledged the situation was serious, adding he couldn't say more, 'Until I have all the facts.' The Tribune felt it already had the facts in hand. Its editor, Col. Robert R. McCormick, had long waged a verbal war against Josef Stalin's Communism and President Franklin Roosevelt's New Deal. To McCormick, they were different sides of the same coin. And President Harry Truman was FDR's vice president, a theme the Tribune rarely failed to mention as the Truman administration debated the appropriate response to the aggression by North Korea, which was backed by the Soviet Union and China. On June 27, Walter Trohan, the Tribune's Washington bureau chief, reported: 'American involvement in war appeared unlikely tonight as the fall of South Korea to communist invaders from North Korea appeared imminent.' Then the South Korean's resistance stiffened, giving the Tribune another shot at second-guessing the administration's strategy. 'Mr. Truman and the legatees of the Roosevelt policy now talk bitterly of the insatiable ambitions and the manifold betrayals of the Russian communist enemy they once heralded as a great ;democracy',' a Tribune editorial proclaimed under a July 2, 1950 headline: 'The Bill For Ten Years Of Madness.' Seventy-five years later, some of the Tribune's criticisms seem petty. But taken as a whole, they make a useful point about history. It doesn't occur in the discreet chapters of a textbook. It's like waves hitting a beach on a windy day. The first rolls back and combines with the next one, and that one with the third. In 1950, Col. McCormick and President Truman were buffeted by different combinations of waves breaking and backwashing. More than 30 years earlier, responding to President Woodrow Wilson's pitch of World War I as a crusade to save democracy, McCormick enlisted in the Army and commanded a company of volunteers he recruited. He was disillusioned when afterward England and France grabbed Germany's colonies instead of freeing them. Henceforth McCormick considered 'internationalism' a synonym for naivety and deception. The director of the CIA left Truman vulnerable to McCormick and the Tribune's criticism by telling a U.S. Senate committee his agents had known that North Korea was strong enough to invade, but said, 'the agency could not predict a timetable.' That fit nicely into memories of America being pulled into World War II by Japan's attack on Pearl Harbor, nine years earlier. In 1937, FDR had announced in a speech in Chicago: 'We are determined to keep out of war, yet we cannot insure ourselves against the disastrous effects of war and the dangers of involvement,' he said. The Tribune heard that as a confession of weakness. An invitation to the Japanese to help themselves to America's Pacific islands empire. From the perspective of 1950, it seemed a harbinger of Secretary of State Dean Acheson's announcement that, 'our defense line in the Pacific did not include Korea and Formosa.' That statement was the 'invitation for the North Korean Reds to move south,' a Tribune editorial on Oct. 2, 1950, concluded. Criticism of Truman's administration was further stoked in February 1950, when Wisconsin Sen. Joseph McCarthy said he had a list of 205 'known communists' in the State Department. A Senate committee said there were none, to which the Tribune in an editorial on July 19 responded: 'What we have had in the congressional investigation of the Pearl Harbor disaster we are now given again — a large bucket of whitewash.' Truman had previously dismissed the Alger Hiss scandal as a cheap-shot 'red herring,' the Tribune recalled. 'The herring is a little higher now, and Hiss, convicted as a perjurer-spy, is under sentence of five years and has been disbarred.' A Harvard Law School graduate, Hiss was the secretary general during the planning for the 1945 San Francisco assembly that founded the United Nations. His was accused over the years on several fronts of being a Communist. He denied those charges but ultimately was convicted of perjury. Despite their vitriol, the Tribune' editorials accurately reflect the Korean War's origins in World War II. The U.S. had the atomic bomb, but until the first bomb was tested, the government couldn't be sure it would work. For a Plan B to bring the war in the Pacific to a conclusion, the U.S. wanted to enlist the Russians, who had stayed out of the battle with Japan, being fully occupied with repelling the Nazis' invasion. With the Germans defeated, Russia declared war on Japan on Aug. 8, 1945. Korea was then a Japanese colony. Having helped to defeat Japan, the Russians wanted a share of the spoils. Korea was temporarily divided at the 38th Parallel, pending a referendum that never happened. Instead, the northern half became the Democratic People's Republic of Korea, a Soviet satellite. The southern half became the Republic of Korea, an American dependency. 'Mr. Roosevelt neither knew nor cared what he intended to accomplish in WWII,' the Tribune wrote on Aug. 6. 'Mr. Truman hastily improvised a war, in which we started with two strikes on us. What a mess!' The year before the two Koreas went to war, the Chinese Communist Mao Zedong defeated his rival, Chiang Kai-shek, who fled to Formosa — the island the Acheson initially said we wouldn't, then said we would, defend. 'Mr. Truman has reversed himself at the price of a war,' the Tribune concluded. The whole story was more complicated. During World War II, the U.S. had brokered a truce between Chiang and Mao. The objective was to put Chinese troops into the battle against the Japanese that otherwise would fight each other, or sit out the war. The result was that Mao's followers could project themselves as China's best shot at a better future. Chang's regime was famed for corruption. The Tribune simplified that into: 'Acheson has presided over the delivery of China to Stalin as a Soviet satellite.' Communist China and North Korea shared a border and an ideology. So a cloud hung over discussions of the Korean situation in news rooms and Pentagon offices: If the U.S. backed South Korea, would China respond? Gen. Douglas MacArthur, a World War II hero, said there was no chance the Chinese would intervene. MacArthur was far from infallible. His command was the Far East at the dawn of the U.S. entry into World War II, and the military's failure to spread out U.S. airplanes and ships clustered at Pearl Harbor led to a devastating defeat. So the Tribune inverted the question when Truman announced: 'I have ordered United States air and sea forces to give the Korean government and troops cover.' 'What does he intend to do if the air cover and support prove inadequate?' the Tribune asked. 'He doesn't say.' But an answer was forthcoming. On June 27, 1950, Truman said the U.S. was undertaking a 'police action' in Korea, and even a war by another name needs soldiers to wage it. On July 4, a Tribune headline proclaimed: 'U.S. Troops Go Into Battle.'
