DA secures Kern's first Prop. 36 conviction

Kern County District Attorney Cynthia Zimmer announced Friday her office has secured its first jury-trial felony convictions under Proposition 36, the new state law that increases penalties for people found guilty of crimes that otherwise would have been misdemeanors.
Dennis Ghianuly, 36, was convicted Thursday of possession of a hard drug with two or more priors and petty theft with two or more priors. Both crimes became felonies after state voters passed Proposition 36 in November.
The DA's Office said in a news release Ghianuly walked out of the Oswell Street PetSmart store without paying for the 44-pound bag of dog food he was carrying. Bakersfield Police Department officers who arrested him found multiple knives and more than 3 grams of fentanyl in his pocket.
The release said Ghianuly asked repeatedly about receiving a "cite-and-release." Instead, he was taken to Kern County Jail, but not before allegedly faking a drug overdose on the way there, requiring a diversion to a hospital.
Ghianuly had previously been convicted of a felony "strike" offense for attempted robbery in 2020 and other drug and theft crimes. If not for Proposition 36, his conviction of the more recent charges would have resulted in a sentence of no more than a year.
But because of his criminal history, he faces up to seven years and four months in prison at his sentencing June 27 by Kern County Superior Court Judge Kenneth C. Twisselman II.

These robberies, burglaries, vandalism and other crimes are done by crews of organized thieves who 'terrorize the citizens of San Bernardino County by utilizing intimidation tactics and a mob mentality that creates an unsafe and uncomfortable shopping environment for our residents,' according to the Sheriff's Department. BAKERSFIELD, Calif. (KGET) — A man was arrested after a home search led to the discovery of cocaine and money in his home on Tuesday, according to the Kern County Probation Department. On June 3, officers with the probation department's Post Release Community Supervision Unit conducted a home call in the 100 block of Hudson Street, according to officials. Officers found about 240 grams of suspected cocaine and U.S. currency in various denominations at the home, officials said. Erik Gutierrez Vega, 19, was arrested on suspicion of possessing a controlled substance, possessing a controlled substance for sales and keeping a place to sell drugs, according to the department. Gutierrez Vega was also arrested on suspicion of possessing drugs with two prior convictions under Proposition 36. Bakersfield police warns of rise in GMC truck thefts, mostly in southwest Bakersfield

BAKERSFIELD, Calif. (KGET) — The Bakersfield Police Department issued an alert regarding General Motor truck thefts within the city on Wednesday. Over the past two months, the city of Bakersfield has seen an increase in the number of thefts of high-end GMC trucks, according to officials. Suspects have targeted GMC Sierra 1500 trucks and GMC Sierra 2500 HD trucks, both with the AT4 or Denali trim package, police said. The thefts mostly occurred in southwest Bakersfield neighborhoods along Panama Lane and Buena Vista corridors between 2 a.m. and 4 a.m. The vehicles were stolen from the street near the victims' home or from their driveway, according to BPD. The suspects have not been identified yet. Police said the suspects used different types of vehicles to go to these places.
