AGC: Prosecution of five teens related only to bullying, not to death of Zara Qairina
KUALA LUMPUR (Aug 19): The Attorney General's Chambers (AGC) today clarified that the prosecution of five minors in Zara Qairina Mahathir's case was made under Section 507C(1) of the Penal Code because it is related to bullying only and not to the death of the 13-year-old girl.
In a statement issued today, the AGC explained that the decision to charge the five teenagers under Section 507C(1) was based on a thorough review of the investigation papers.
'Therefore, the AGC reiterates that the charge under Section 507C(1) of the Penal Code in this case is grounded on evidence and facts obtained from the completed investigation,' the statement read.
The clarification follows a press statement by the lawyer representing Noraida Lamat, the mother of the Zara Qairina, who had requested a postponement of the prosecution process and proposed that the teens be charged under Section 507D(2), which carries a heavier penalty.
The AGC responded by stating that the argument raised by the lawyer, that if the teens plead guilty to the lesser charge, they could not later be charged under Section 507D(2) or a more serious offence due to the double jeopardy clause under Article 7(2) of the Federal Constitution, was speculative and not supported by concrete facts.
The AGC also confirmed that an inquest will still proceed to determine the actual cause of Zara Qairina's death.
Yesterday, Attorney General Tan Sri Mohd Dusuki Mokhtar confirmed that the five minors will be charged in the Kota Kinabalu Juvenile Court under Section 507C(1) of the Penal Code, while the Kota Kinabalu Coroner's Court set Sept 3 to commence the inquest proceedings into Zara Qairina's death.

Kota Kinabalu: Five teenage girls pleaded not guilty at the Children's Court here Wednesday to the charges of using abusive words against Form One student Zara Qairina Mahathir last month. The five made the plea before Sessions Court Judge Elsie Primus in closed proceedings. Advertisement They are accused of uttering abusive words directed at Zara Qairina, which were heard by the victim, and could have caused her distress. The offence allegedly took place between 10pm and 11pm on July 15. The girls were jointly charged under Section 507C(1)/34 of the Penal Code, which relates to the offence of using or making any threatening, abusive or insulting words, or communication, where a person is likely to feel harassed, distressed, fear or alarmed. It provides for a jail term of up to one year, or fine, or both, on conviction. The court set Sept 25 and Oct 16 for pre-trial case management, trial dates on Dec 8-12 and Dec 15-19. The girls were released on bail of RM5,000 each with RM1,000 deposited in a local surety. Deputy Public Prosecutors Nor Azizah Mohamad, Nik Haslinie Hashim and Deepa Nair Thevaharan appeared for the prosecution. Counsel Datuk Ram Singh, together with counsels Joan Goh and Elmer Prem Gunasan, represented one of the teenagers. The other four were represented by counsels Azhier Farhan Arisin, Abdul Fikry Jaafar, Farah Nazriah Chun Lee, Fareez Salleh and Sylyester Kuan. Counsels for Noraidah Lamat, the late Zara's mother, Hamid Ismail, Shahlan Jufri and four others, were also present at the proceedings. All the counsels for the five teenagers acted on the pro-bono basis. Counsels Dominic Ghani and Nabila Norsahar were present as watching brief on behalf of the Sabah Law Society. During the proceedings, the court also issued a Gag Order under Section 15 of the Child Act. Previously, the Attorney-General's Chambers (AGC), in a statement, said it had examined the investigation papers into the student's death, which were referred by the Royal Malaysia Police (PDRM), and decided to charge several suspects based on available evidence. The AGC also said an inquest proceeding still needs to be conducted to determine the actual cause of Zara Qairina's death. On Aug 12, the AGC decided to conduct an inquest to ascertain the cause and circumstances behind the death of the Sekolah Menengah Kebangsaan Agama Tun Datu Mustapha student after reviewing the investigation report submitted by PDRM. The Coroner's Court here on Monday set Sept 3 to commence the inquest proceedings. Rep claims trial for online remarks
KUALA LUMPUR: Gombak Setia assemblyman Muhammad Hilman Idham was charged at the Magistrate's Court here with making a statement on the social media platform TikTok late last month that allegedly threatened public order. The Bersatu Armada chief pleaded not guilty to the charge read before magistrate Amira Abd Aziz. 'I claim trial,' he said. Muhammad Hilman, 36, was accused of making the statement at 2.09pm on July 30 here. 'It is impossible for my client to abscond. He is well-known throughout Selangor and Malaysia and has cooperated fully with the authorities,' said Rafique. City police chief Comm Datuk Fadil Marsus said the items were seized in various operations linked to 21,293 investigation papers that had gone through the prosecution process in court between 2009 and 2024. He said the drugs included methamphetamine, cannabis, cocaine, ketamine and other substances, weighing a total of 839kg, along with 1,345 litres in liquid form. Comm Fadil said the items will be disposed of at a scheduled waste-to-energy incinerator that produces new energy in a regulated and pollution-free manner. 'The disposal will be conducted at a waste treatment centre at Ladang Tanah Merah A3 Division in Bukit Pelandok, Negri Sembilan,' he told reporters after attending the KL Narcotics Criminal Investigation Department case item disposal ceremony yesterday. On the 'Justice for Zara' gathering held outside a shopping mall here last Saturday, Comm Fadil said the situation was under control. 'No offences were detected during the gathering,' he said, adding that police would continue to closely monitor future gatherings and work with the community to maintain order. Comm Fadil reminded the public that any violation of the law would be taken seriously. The gathering was held in support of bullying victim Zara Qairina Mahathir, who was found unconscious in a drain near her school dormitory in Sabah on July 16 and died in hospital the following day. At the Children's Court in Kota Kinabalu yesterday, five teenagers pleaded not guilty to a charge under Section 507C(1) of the Penal Code, read together with Section 35, for using abusive words against the victim. If convicted, they face up to one year's imprisonment, a fine or both.
