BluSmart follows Gensol group firms into insolvency after ₹1.28 cr default

The wheels have come off the fraud-hit BluSmart Mobility, once hailed as a pioneer in India's electric ride-hailing startup, as the company has been formally admitted into insolvency by the National Company Law Tribunal (NCLT) in Ahmedabad.
The move follows payment defaults totalling over ₹ 1.28 crore and adds BluSmart to a growing list of Gensol-linked entities now undergoing bankruptcy proceedings, including its parent Gensol Engineering Ltd and sister concern Gensol EV Leasing Pvt Ltd.
In an order dated 28 July, a two-member bench comprising Justice Shammi Khan (Judicial Member) and Sanjeev Sharma (Technical Member) admitted BluSmart into the Corporate Insolvency Resolution Process (CIRP) under the Insolvency and Bankruptcy Code (IBC), 2016.
'In light of the above findings, this Tribunal is satisfied that the Financial Creditor is entitled to the relief as sought. The Corporate Debtor's default justifies the admission of the petition and the initiation of CIRP under the Code,' the tribunal said in its order, reviewed by Mint.
The dispute with the financial creditor began after BluSmart Mobility raised ₹ 150 crore through 15 non-convertible debentures (NCDs) in April 2023, with Catalyst Trusteeship as the debenture trustee.
Under the agreement, BluSmart was to start repaying the principal by 30 April 2023, but unilaterally deferred it to 31 May, which Catalyst viewed as a breach. In early 2025, BluSmart defaulted on payments due in February, March, and April—totalling ₹ 1.28 crore, prompting Catalyst Trusteeship to seek insolvency proceedings against the company.
Supporting documents included default notices, bank records, and an email from co-founder Anmol Singh Jaggi admitting liability that led to the admission of insolvency plea.
BluSmart opposed the insolvency plea, arguing that the defaults were temporary, the petition was premature and motivated and that procedural issues such as missing IRP details and vague timelines weakened the creditor's case.
The company also pointed to the 15 April Securities and Exchange Board of India (Sebi) order against Gensol Engineering and its promoters as background pressure behind the filing.
However, the tribunal rejected all objections, holding that the defaults were material and proven, the promoter had admitted liability, and procedural gaps had been corrected.
It also stated that the Sebi order had no bearing on BluSmart's contractual obligations to repay its lenders.
The tribunal appointed NPV Insolvency Professionals Pvt Ltd as the Interim Resolution Professional (IRP), which will now take control of BluSmart's management, issue public notices and invite claims from creditors.
A moratorium has also been imposed, halting all ongoing or new legal actions, asset transfers and recovery proceedings against the company.
Under IBC timelines, the IRP must invite claims within three days and constitute a Committee of Creditors (CoC) within 30 days.
The entire resolution process must be completed in 180 days, extendable by another 90 days. If no viable resolution plan is approved within that time, BluSmart may face liquidation.
With BluSmart joining Gensol Engineering and Gensol EV Leasing in insolvency, legal experts believe the case may become a landmark test for group insolvency in India—a concept not yet formally codified in law.
Courts have, however, allowed consolidated proceedings in rare cases like Videocon, where 13 related companies were treated as a single economic entity.
'This could set the stage for group insolvency. If operational and financial links between these firms are clearly established, it may prompt courts to adopt a similar approach,' said Raheel Patel, partner at Gandhi Law Associates.
'The real challenge ahead is determining whether their assets and debts should be resolved jointly or separately, and whether overlapping creditors and related-party transactions will be prioritized for scrutiny,' Sonam Chandwani, managing partner at KS Legal & Associates, said.
When BluSmart defaulted and suspended operations, those same vehicles used as collateral for Gensol loans became value at risk. Power Finance Corporation Ltd and the Indian Renewable Energy Development Agency Ltd (Ireda) were thus exposed to defaults arising from both entities, effectively making them overlapping creditors, she added.
BluSmart's insolvency is the latest and perhaps the most visible blow to the Gensol Group, which has been under intense regulatory scrutiny.
In June, Ireda revealed that Gensol Engineering had defaulted on loans worth ₹ 510 crore.
On 15 April, the Sebi issued an interim order accusing Anmol and Puneet Jaggi of diverting investor funds meant for electric vehicle purchases towards personal luxuries, including a $5 million apartment and high-end golf equipment.
Sebi also found that Gensol had procured only 4,704 electric vehicles despite claiming funding for 6,400.
Both promoters resigned from Gensol's board on 6 May. The Securities Appellate Tribunal (SAT), on 7 May, declined to stay Sebi's order and asked the company to respond, with the market regulator expected to issue a final decision thereafter.
Meanwhile, Gensol Engineering, now also under CIRP, has issued advertisements seeking to lease out pre-owned EVs at fixed rentals, in what appears to be an effort to monetize stranded assets amid the group's widening financial crisis.

Three days after the Supreme Court issued a scathing order barring an Allahabad High Court judge from hearing criminal cases until his retirement, several judges of the High Court have come out in support of their fellow judge opposing the implementation of the apex court's directive. Thirteen judges of the Allahabad High Court have written to Chief Justice Arun Bhansali, requesting the convening of a Full Court meeting and urging that the apex court's order removing Justice Prashant Kumar from the criminal roster not be implemented. The letter was circulated on Thursday (August 7, 2025), even as the Supreme Court relisted the case in which it made the remarks against Justice Kumar for allowing criminal proceedings in a civil dispute case. 'The Full Court resolves that direction made in para 24 to 26 in the subject order dated August 4, 2025 is not to be complied with as the Supreme Court does not have administrative superintendence over the High Courts,' the letter said. The High Court judges also recorded their 'anguish in respect of tone and tenor of said order'. On August 4, 2025, a Supreme Court Bench of Justices J.B. Pardiwala and R. Mahadevan had reprimanded Justice Kumar for 'cutting a sorry figure for himself' and making 'a mockery of justice'. The apex court had taken stern exception to Justice Kumar finding nothing wrong in a litigant filing a criminal case against a buyer in a purely civil dispute over an unpaid balance of money in a sale transaction. The Bench said the High Court judge had found nothing wrong in allowing a criminal case for 'criminal breach of trust' registered in the civil dispute. 'We are at our wits' end to understand what is wrong with the Indian judiciary at the level of the High Court. At times we are left wondering whether such orders are passed on some extraneous considerations or it is sheer ignorance of law. While discussing the shortcomings and limitations of the ED which contended that crooks are increasingly becoming smarter posing challenges to investigators, the Supreme Court Thursday said that still 'you can't act like a crook. You have to act within the four corners of the law'. 'There is a difference between law enforcing and law violating…,' Justice Ujjal Bhuyan, who was part of a three-judge bench, told Additional Solicitor General S V Raju, appearing for the ED. The bench, presided by Justice Surya Kant and also comprising Justice N K Singh, was hearing review petitions against the 2022 judgment in the Vijay Madanlal Choudhary case in which the SC upheld the agency's powers under the Prevention of Money Laundering Act. Justice Bhuyan said, 'I had observed in one court proceedings and it has come true in the statement made by the minister in the floor of the Parliament, you have registered about 5,000- plus ECIRs, conviction is less than 10% from 2015 to 2025. Therefore we are insisting that you improve your investigation, improve your witnesses.' '… If at the end of 5-6 years, they are put into custody, and end up in acquittal, who will pay…? …We are also equally concerned for the image of ED,' he said. Raju said, 'Wherever there are influential accused… a battery of lawyers will go on filing one application after the other…the Investigating Officer has to run around in courts…The problem is they don't allow the trial to commence. Raju said 'everybody is concerned' about the ED's image, adding, 'there's no acquittal'. Echoing the agency's concerns, Justice Kant said, 'I have got details of one case where 47 applications (were filed) and the magistrate has disposed of those applications with every order running into 10-15 pages. And he said 'I have time for no other work left'. One application I hear for two days, by the time I pass an order, another comes.' 'Somebody will have to hit them very hard. That's the only way,' he added. Raju said, 'The situation has changed. Crooks have become very smart… tech savvy. So it will be very hazardous if we are required to give them (material) which would disclose our investigation at a very nascent stage. Of course at the time of complaint, we will give them everything, we are bound to give them everything.' 'Suppose you arrest a person and the main persons are in the British Virgin Islands or Cayman Islands, you can't touch them. The investigation gets delayed, you can't get material… what do we do? We are handicapped. An investigator is no match for a crook with a lot of wherewithal,' he said. Justice Kant said, 'crypto currency is going to pose a big challenge before you.' To a specific query about regulating crypto currency, Raju said, 'They are trying to but sometimes it's very difficult… When we regulate, crooks always find a way out.' Meanwhile making his submissions in another matter before a bench presided by CJI B R Gavai, Solicitor General Tushar Mehta, appearing for the ED, said that the agency had so far recovered around Rs 23,000 crore laundered money and distributed it to the victims of financial crimes. The CJI asked him, 'What is the conviction rate?' The SG said that conviction rates are also very low in penal offences and added that the various ills plaguing the criminal justice system in the country was the key reason for this. The CJI said, 'even if they are not convicted you have been successful in sentencing them almost without a trial for years together.' The SG said, 'In some of the cases where the politicians were raided, where the cash was found, our (cash counting) machines stopped functioning because of the huge cash… we had to bring new machines'. He added that some narratives are being built on YouTube programmes when some big politicians are caught'. The CJI said, 'We do not decide matters on narratives… I don't see news channels. Jodhpur: HC grants bail to young mother accused of double murder: Rajasthan High Court 's principal seat at Jodhpur Tuesday granted bail to Maria, 32, who was in jail since Nov 2, 2021, for the alleged murder of her two aunts-in-law in their house in Udaipur on Oct 27, 2021, allegedly for stealing jewellery. Her previous bail plea was rejected by the trial court on Dec 19 last year. Justice Farjand Ali stated that the accused was a young mother responsible for the care of her 5-year-old child, and considering her youth, lack of socio-political influence, and absence of any intent or action to obstruct the trial, she was entitled to bail. The judge said it would be inappropriate to keep her in jail solely based on the seriousness of the charges, pointing out that the trial was proceeding at a very slow pace, and there was no likelihood of its early completion.
