Special Intensive Revision
(SIR) of electoral rolls in Bihar. The top court again asked the poll body to reconsider including Aadhaar and Election Photo Identity Card (EPIC) as admissible documents in the list of acceptable documents to prove identity of voters in the revision of electoral rolls.
A division bench comprising Justices Surya Kant and Joymalya Bagchi, however, refused to stop the ECI from publishing the draft electoral rolls for Bihar on August 1 as per the schedule notified for SIR.
Speaking for the bench, Justice Kant verbally remarked that "it is only a draft exercise". He added "it does not take away our power" to quash the entire roll if found erroneous in future. "Trust us... as soon as we know anything is wrong, we will quash everything," Justice Kant added, saying that the "interpretation" needs to be decided.
Speaking on the exclusion of Aadhaar and EPIC, the senior SC judge orally observed that "any document on this earth can be forged. Tomorrow, you may see that not only Aadhaar but out of eleven (list of acceptable documents), other documents can also be forged. That is a separate issue. We will deal with it on a case to case basis." Urging the ECI to include the two cards in the list of acceptable documents, Justice Kant added: "Aadhaar and EPIC have a presumption of correctness."
Questioning the counsel for ECI on exclusion of Aadhaar and voter cards, Justice Bagchi weighed in, saying, "You say none of the documents are conclusive as per SIR notification... suppose someone uploads the form with Aadhaar, why will you not include it in the draft?" The counsel for ECI contended that there are large scale issues with ration cards. He also said that EPICs also cannot be conclusive. The bench, however, questioned the poll body's stand.

The SC adjourned the matter on account of paucity of time. The top court asked the counsels for the petitioners and ECI to give a timeline of their submissions following which the court will post the matter for final adjudication.
At the last hearing earlier this month, the SC had refused to stay the SIR of electoral rolls being undertaken in Bihar. Referring to the ECI, the top court had said it "cannot stop a constitutional body" from conducting a "democratic process" and that it "will not second guess" the ECI.

Yet, he says his name and those of many RJD staff members, a senior IAS officer, and his wife have gone missing from the voter list. He claimed that 20,000 to 30,000 names have been removed from every Assembly constituency, and questioned whether this was a mistake or done with a political motive. 'There was no transparency. Political parties weren't even told before deleting names,' Yadav said, adding that even Supreme Court guidelines were not followed during the process. Patna has the highest number of 46,51,694 electors followed by Purvi Champaran (33,73,055), Muzaffarpur (32,03,370), Madhubani (30,24,245), Gayaji (29,01,493), Samastipur (28,61,415), Saran (28,60,885) and Darbhanga (27,99,852). Sheohar accounts for the lowest number of voters at 2,95,929, followed by Arwal (5,11,568), Lakhisarai (7,33,600), Jahanabad (7,81,313) and Munger (9,75,222). (With inputs from agencies)

Rashtriya Janata Dal (RJD) leader Tejashwi Yadav has alleged that the Election Commission has deleted names of around 6.5 million voters from the electoral rolls in Bihar — nearly 8.5 per cent of the total voters — without providing enough information to trace them. He added that even his own name is missing from the list, raising serious questions about the transparency of the process. 'My name is not there in the electoral roll. How will I contest the elections?' Yadav said, while showing his phone as proof. He said that the lists shared by the Election Commission do not contain vital details like addresses, booth numbers, or EPIC (Electors Photo Identity Card) numbers of the deleted voters. This, he alleged, has made it impossible to identify whose names have been removed. 'Almost 20,000-30,000 names have been removed from every assembly constituency. A total of around 6.5 million voters, or about 8.5 per cent of the total, have had their names removed from the list." He further added, "Whenever the Election Commission issued an advertisement, it would mention that many people had shifted, many were deceased, and many had duplicate names... But in the list provided to us by the Election Commission, they have cleverly not given the address of any voter, no booth number, and no EPIC number, so that we cannot find out whose names have been removed from the voter list,' he said.

Congress leader and Lok Sabha MP Rahul Gandhi has made serious allegations against the Election Commission of India (ECI), claiming that the 2024 Lok Sabha elections were rigged and that the country's electoral system is 'already dead'. He was speaking at a legal conclave on Saturday in Delhi, where he strongly criticised the ECI, claiming that the current Prime Minister is in power with only a 'thin majority'. During the event themed "Constitutional Challenges: Perspectives and Pathways", Gandhi said, 'The truth is that the election system in India is already dead. Please remember one thing that the prime minister of India enjoys a very slim majority. If 10-15 seats were rigged, and we suspect the actual figures to be closer to 70-80 to 100, he would not have been the prime minister of the country.' He added that the Congress party has collected proof of fake voting in a Karnataka Assembly seat. 'We checked photographs and names of electors and found that out of 650,000 voters, 150,000 votes were fake," he said. He claimed the evidence will soon be made public: 'You will see the shockwave that is going to go through the electoral system when we release this data. It is literally like an atom bomb.' Gandhi said the Congress will soon present irrefutable proof showing how the 2024 election was manipulated. 'In the coming few days, we are going to prove to you without any doubt how a Lok Sabha election can be rigged, and it was rigged,' he alleged. 'Constitutional institutions have been taken over' The Congress MP accused the ECI of failing in its duty to protect democracy. 'It's very clear that the institution that protects this (Constitution), and defends it has been obliterated and taken over,' he said. Gandhi also said that he had been cautious earlier as he didn't have the evidence. 'But, I am making this statement confidently now because I have 100 per cent proof. And, whoever I have shown it to has fallen off the chair... It's happening, literally,' he said. 'Vote chori' for BJP, says Rahul Gandhi On Friday, speaking to reporters in Parliament, Gandhi directly accused the ECI of helping the BJP by stealing votes. 'I have said 'vote chori' is happening and now we have open and shut proof that the Election Commission is involved in 'vote chori'.' He stressed that these are not baseless claims. 'I am not saying this lightly. I am saying this with 100 per cent proof. As soon as we release it, the whole country would know that ECI is indulging in 'vote chori'. It is doing it for the BJP.' He further added that the party conducted a six-month investigation into the election process after raising doubts during the Madhya Pradesh polls and the Maharashtra results. He also alleged the ECI did not cooperate, prompting Congress to dig deeper. 'What we have found is an atom bomb. When it explodes, the EC would have no place to hide in the country," Gandhi said. Issuing a stern warning to the Election Commission officials, Gandhi said, 'This is treason, nothing less than that. You may be retired, you may be anywhere, we will find you.' (With agency inputs)
