Transair to resurrect Hawaii cargo business after defeating FAA shutdown

Hawaiian airline Transair is attempting a comeback four years after one of its cargo jets crashed in the Pacific Ocean off the coast of Honolulu and federal aviation authorities grounded the cargo carrier for alleged safety violations.
Executives say the airline could resume interisland service by the tail end of this year, if preparations go according to plan.
Rhoades Aviation, the legal entity flying aircraft under the Transair brand, got a reprieve in November when a National Transportation Safety Board administrative law judge dismissed the Federal Aviation Administration's move to revoke its operating certificate as a scheduled airline.
FAA officials are now working with Rhoades Aviation to bring it into compliance with federal aviation regulations, as ordered by Judge Alisa Tapia, the agency confirmed on Friday.
In a statement to FreightWaves, the FAA said it has assigned a team of specialists to help Transair restart operations. Regulators and company officials are expected to meet soon and jointly develop a comprehensive plan for resuming operations.
'We appreciate the NTSB judge's thorough review of this matter,' said CEO Teimour Riahi. 'We look forward to doing now what we have wanted all along: to work collaboratively with the FAA so that Transair can provide vitally important cargo air transportation for the benefit of Hawaii's residents, communities, and businesses. We remain committed to upholding the highest safety standards as we work to restore Hawaii's only locally owned Part 121 airline.'
Transair also holds a license to operate unscheduled passenger and cargo charter flights with a small fleet of mostly Shorts 360 turboprop aircraft. The grounding of the 737 fleet didn't affect the charter business because regulations for charter aircraft under the federal code differ from ones governing larger, scheduled airlines that fly more frequently.
Transair has four 737-200 cargo aircraft parked on its base at Honolulu airport that require a comprehensive maintenance service before they can be returned to service, said Tracy Reasoner, vice president of operations, in an email exchange.
The initial number of aircraft to be deployed will be determined once the C-checks, which involve technicians performing a deep inspection of a large majority of the aircraft's components, are completed. At the time of the accident in 2021, Transair was operating with two cargo jets.
'We anticipate that the return of our services will be implemented in a phased approach over time,' Reasoner explained.
Transair will begin to hire pilots and other personnel as it prepares to resume 'and potentially expand our operations,' he added.
Tapia's decision against the FAA was damning. The agency grounded Transair two weeks after the crash landing in 2021 for maintenance and safety practices that were separate from the crash inquiry. In May 2022, the FAA announced its intent to revoke Transair's air operator's certificate for a series of alleged violations, operating 33 flights with engines that weren't airworthy because compressor fan blades didn't meet manufacturer standards.
Grounded carriers would normally have their certificates revoked for dormancy if the airline's fitness is not redetermined within a year, but Rhoades Aviation managed to obtain limited extensions to this deadline in order to discuss its situation with the FAA, according to aviation publication FlightGlobal.
Rhoades Aviation in January 2023 appealed the FAA order to put it out of business.
In a blistering opinion, the administrative law judge said the FAA overreached its authority, tried to submit extraneous evidence during certain proceedings, bundled unrelated enforcement cases and that the FAA took an unreasonable amount of time – between 10 and 21 months – to issue citations to Rhoades Aviation after discovering alleged violations.
Tapia specifically faulted the FAA for dragging its feet in providing guidance to the family-owned air carrier on how to update technical manuals, undercutting the argument that the company was unresponsive. And she said there was no evidence that inspectors told Rhoades Aviation that the aircraft with alleged engine defects were unworthy and should be grounded. Many paperwork corrections could have been achieved by temporarily grounding aircraft rather than seeking to shut down the company.
The judge blamed FAA inspectors for being sloppy and failing to document their contacts with the company.
'The complaint pleads a compendium of mundane compliance issues stockpiled in an attempt to substitute volume for severity. … The Administrator's inaction – or delayed action – is evidenced throughout the record, from stale charges and lack of diligence to an untimely filing of the complaint,' she wrote.
The NTSB investigation found that the 2021 accident was caused by pilot confusion over which engine was experiencing a partial power loss shortly after takeoff, which caused them to rely on the damaged engine for power instead of the good left engine that would have enabled them to safely fly back. The captain sustained serious injuries and the first officer was relatively unharmed from the water landing.
Last year, the Department of Labor forced Transair to return more than $450,000 in back pay to 250 employees who were allegedly shortchanged full pay and benefits while fulfilling a $113 million U.S. Postal Service contract to ship mail among the Hawaiian islands between 2019 and 2021.

It said: 'The aircraft's composite construction provides enhanced durability and fatigue resistance compared to traditional aluminium structures. 'The aircraft features sophisticated health monitoring systems that continuously assess component performance and predict maintenance requirements. This proactive approach to maintenance significantly reduces the likelihood of in-flight failures that could compromise safety.' Yet beneath the hype, the Dreamliner has had a long history of engineering concerns. In January 2013, two lithium‑ion battery fires—one in-flight with ANA and another while parked in Boston—prompted the Federal Aviation Authority (FAA) to ground the entire fleet, the first time that the FAA had grounded an airliner type since 1979. From about 2019, quality‑control alarms began sounding. Gaps and faulty shims—fillers used to plug the gaps—in tail sections prompted grounded aircraft and a temporary halt in deliveries. Then, in April 2024, Boeing engineer Sam Salehpour blew the whistle, claiming the company 'used shortcuts' and flagged issues such as 'drilling holes incorrectly' and forcing components into place—raising fears these defects could degrade structural integrity over time. Boeing disputed the allegations, insisting that the jets were safe. The company did not immediately respond to a request for comment from The Daily Beast. Boeing's shares were down about 7.5 percent at $197.82 in premarket trading. 'It's a knee-jerk reaction (to the incident) and there's revised fears of the problems that plagued Boeing aircraft and Boeing itself in recent years,' said Chris Beauchamp, analyst at IG Group, quoted by Reuters.

(NewsNation) — Federal aviation officials last week unveiled an ambitious, three-year plan aimed at modernizing the U.S.'s air traffic control system. The plan calls for a new, state-of-the-art system to replace the outdated technology currently in use, which includes floppy disks and computers running the Windows 95 operating system. According to NPR, air traffic controllers also still use slips of paper containing flight numbers to help track the approximately 45,000 flights that the Federal Aviation Administration handles on a daily basis. 'The whole idea is to replace the system,' acting FAA administrator Chris Rocheleau said. 'No more floppy disks or paper strips.' Aviation experts say air safety issues are years in the making A 2023 FAA assessment determined that more than a third of the country's air traffic control systems were unsustainable. Some had already begun to fail. System failures most recently hit Newark Liberty International Airport in New Jersey, where staffing shortages and equipment issues have caused mass delays over the past few months. The delays forced FAA officials to curtail the number of flights in and out of the airport. Airline officials pointed to those system failures in a recent open letter to Congress urging legislators to provide adequate funding to overhaul the 'wildly outdated' system. Sean Duffy outlines plans to 'radically transform' air traffic control Transportation Secretary Sean Duffy last week described the proposed plan as the 'most important infrastructure project' the U.S. has seen in decades. The Boeing 787 Dreamliner's Long History of Safety Concerns

Credit - Bloomberg—Getty Images The odds were in your favor if you were one of the 242 people who boarded Air India flight 171 in Ahmedabad, India, bound for London on June 12. The plane you were flying was a Boeing 787 Dreamliner which has been in service since 2011 without a fatal crash. More than 1,100 Dreamliners are in use worldwide, carrying more than 875 million passengers over the last decade, according to Boeing. Your particular 787, delivered to Air India in 2014, had amassed 41,000 hours of flying time and just under 8,000 takeoffs and landings, according to Cirium, an aviation industry analytics firm. But none of that would have helped you. Just after takeoff, when the plane was barely 625 ft. in the air, it lost altitude and plunged into a residential area, killing all but one of the passengers and crew on board. The cause of the crash is as yet unknown. 'Our deepest condolences go out to the loved ones of the passengers and crew on board Air India Flight 171, as well as everyone affected in Ahmedabad,' said Boeing president and CEO Kelly Ortberg in a statement. 'I have spoken with Air India Chairman N. Chandrasekaran to offer our full support, and a Boeing team stands ready to support the investigation led by India's Aircraft Accident Investigation Bureau.' That investigation is likely to go deeper than just Flight 171, ranging back over the 14 years the 787s have been flying—years that, it turns out, have seen numerous complaints, concerns, and whistleblower reports over the safety of the widebody jet. All of them are getting a second look today. The problems began in early 2013, when fires broke out aboard two Dreamliners owned by Japanese airlines. One plane had just landed at Boston's Logan Airport, the other was just leaving Japan and had to turn around and land. Both blazes were traced to overheating of the planes' lithium-ion batteries that power the electrical system. The Federal Aviation Administration (FAA) quickly stepped in, grounding the worldwide fleet of Dreamliners and temporarily halting the delivery of new ones to airlines that had placed orders for them. In April of 2013, the FAA accepted Boeing's fixes, which involved better insulation for the batteries and a stainless steel box that would house the batteries and prevent smoke or flames from escaping into the plane if a fire did start. The Dreamliners were cleared to fly and the company was cleared to resume deliveries within weeks of the FAA's decision. The next incident occurred in 2019 when, as The New York Times reported in an exposé at the time, John Barnett, a former quality manager who retired in 2017, revealed that he had filed a whistleblower complaint, alleging sloppy work around the wires that connect the planes' flight control systems, with metal shavings being left behind when bolts were fastened. The risk existed that the shavings would penetrate the wires' insulation, leading to consequences that Barnett called 'catastrophic.' Barnett also alleged that damaged or substandard parts were being installed in 787s, including a dented hydraulic tube that a senior manager retrieved from a bin of what was supposed to contain scrap. The FAA inspected several 787s that were said to be free of the shavings Barnett reported and found that they were indeed there, reported the Times. The FAA then ordered that Boeing correct the problems before the planes were delivered to customers. In retirement, Barnett sued Boeing, alleging that the company had denigrated his character and blocked his career advancement during his employment—charges Boeing denies. In March of 2024, he was in North Charleston, S.C., the site of the plant where he was employed, working on his case, when he was found dead in his truck from a self-inflicted gunshot wound. 'Boeing may not have pulled the trigger,' Barnett's family said in a wrongful death lawsuit it filed, 'but Boeing's conduct was the clear cause.' The company sidestepped the charge: 'We are saddened by John Barnett's death and send our condolences to his family,' Boeing said in a statement. Last year turned out to be a bad one for Boeing and the Dreamliner for reasons other than Barnett's death. In January another whistleblower, engineer Sam Salehpour, came forward, reporting that sections of the fuselage of the Dreamliner were improperly connected, with gaps that could cause the plane to break apart during flight. When the sections wouldn't fit, Salehpour claimed, workers would resort to brute force. 'I literally saw people jumping on the pieces of the airplane to get them to align,' Salehpour said in Capitol Hill testimony. 'By jumping up and down, you're deforming parts so that the holes align temporarily. I called it the Tarzan effect.' In a statement on its website, Boeing defended the integrity of the Dreamliner: 'For the in-service fleet, based on comprehensive analysis no safety issues have been identified related to composite gap management and our engineers are completing exhaustive analysis to determine any long-term inspection and maintenance required, with oversight from the FAA.' Nonetheless, in May, the FAA acted again, announcing that Boeing had been ordered to reinspect 'all 787 airplanes still within the production system and must also create a plan to address the in-service fleet.' That was not the first time the government had taken action on the problem of unacceptable gaps in the Dreamliner's fuselage. From May 2021 to August 2022, the FAA halted the delivery of new Dreamliners to airline customers while the problem was addressed. Deliveries did resume but, as Salehpour testified, so did the shoddy work on the factory floor. In March 2024, meantime, a LATAM Airlines flight from Sydney to Auckland suddenly plunged 400 ft. when the pilot's seat in the 787 lurched forward unexpectedly. The captain recovered but 10 passengers and three members of the cabin crew were injured. For now, the 1,100 Dreamliners criss-crossing the skies are still flying. That could change pending the results of the Air India investigation. Even a temporary loss of the plane—which is a workhorse for long-haul flights—could be a hardship for both the airlines and the flying public.
