Luigi Mangione lawyers: DA office improperly obtained medical records
July 18 (UPI) -- Luigi Mangione's attorneys allege Manhattan prosecutors wrongly obtained the medical records from the insurance carrier of the suspect in the shooting death of the UnitedHealthcare CEO in December.
In a court filing Thursday in the New York case, the defense said prosecutors violated HIPAA, which is the federal law that protects medical privacy, when Aetna was pressured to hand them over without a court order or Mangione's consent.
"There is no question that the District Attorney has no right to possess or review these documents," the filing said.
"The violation also involves the intentional and knowing violation of his doctor-patient privilege."
The prosecutors used a "false and fraudulent" subpoena, warning they would be held in contempt if they didn't give them the records, the defense said. Obtained were 120 pages of information, including "different diagnoses as well as specific medical complaints made by Mr. Mangione," the lawyers said.
They said the office "falsely made up a court date -- May 23 -- and bypassed the court. The information wasn't relevant to the court, they said.
Magione's lawyers want Supreme Court Judge Gregory Carro to schedule an evidentiary hearing, including possibly throwing out the charges.
The Manhattan District Attorney's Office told FOX News and CNN that limited information was requested the insurer erroneously sent some additional records.
"We deleted the materials as soon as we became aware of them and brought it to defense and the court's attention," the office said.
Aetna told CNN that the insurer "received a subpoena for certain medical records, and we provided them appropriately."
Mangione, who turned 27 on May 6, is facing charges in state and federal court in the death on Dec. 4 of Brian Thompson outside the Hilton Hotels in Midtown Manhattan before the company's annual investor conference there. He was apprehended three days later at a McDonald's restaurant in Altoona. Pa.
Mangione wasn't covered by UnitedHealthcare.
The federal government is seeking the death penalty but in New York there is no capital punishment since it was outlawed in 2004. The state case is proceeding ahead of the federal one.
The state charges are first-degree murder in furtherance of terrorism, two counts of second-degree murder, weapons charges and using a forged instrument.
The federal charges are murder through the use of a firearm, interstate stalking resulting in death and a firearms offense.
Also in Pennsylvania, he has been charged with forgery, carrying a firearm without a license, tampering with records or identification, giving false ID to law enforcement and possessing "instruments of crime?
He has pleaded not guilty to all charges.
Mangione is a federal inmate at the Metropolitan Detention Center in Brooklyn, N.Y., without bond.
Last month, his attorneys wanted the judge to allow him to attend court proceedings without wearing handcuffs or body armor. His next appearance is scheduled for Sept. 16.
Four months before the shooting on Aug.15, Mangione wrote in his diary: "I finally feel confident about what I will do.
"The target is insurance. It checks every box."
Magione suffered from back pain and underwent surgery to treat it, according to a friend, R.J., Martin and online postings.
The court filing didn't disclose whether the medical records related to his back problems.

Girl, 9, dies after incident in Hersheypark's wave pool
July 25 (UPI) -- A 9-year-old girl died after being in distress at Hersheypark's wave pool near Pennsylvania's state capital of Harrisburg. The incident occurred Thursday at The Boardwalk water park, which also includes slides and a lazy river. The Shore wave pool is 378,000 gallons, the largest in the state, and is up to 6 feet deep. Hershey Enterainment & Resorts Company didn't give details on what happened. "From the moment our lifeguard team recognized that a child was in distress, they performed an immediate rescue, followed by continuous, coordinated life-saving efforts by our lifeguards, on-site first responders and medical personnel," CEO John Lawn said in a message. The girl was taken to Milton S. Hershey Medical Center, "where despite everyone's tireless efforts, the child did not recover," Lawn said. Authorities did not identify her. In an updated statement Friday, the park said the wave pool within The Boardwalk will remain closed that day "out of respect for the family and deep appreciation of our team members who worked so valiantly in their efforts to save the life of the guest." Ten lifeguards were dedicated to the wave pool at the time of the incident, the park said. Also, complimentary life vests were available. On Thursday, Lawn said park employees were investigating the incident. "The safety of our guests has always been our highest priority," he said. "In the coming days, we will conduct a thorough internal review and cooperate with authorities." The park was founded by Milton S. Hershey in 1927 "as leisure grounds for employees of Hersehy's Chocolate Factory," according to the park's website. The 121-acre amusement park includes 15 roller-coasters. It is open from Memorial Day to Labor Day. "To every family who visits Hersheypark, please know this: your safety and well-being drive each decision we make," Lawn said. "We will thoroughly investigate this tragedy and honor the memory of this young guest by continuing our focus on ensuring the safety of our guests at Hershepark."

NATO fighter jets scrambled as Russia attacks Ukraine

"Polish and allied quick reaction aircraft were scrambled, and ground-based air defense and radar reconnaissance systems reached the highest state of readiness," Poland's Operational Command of the Armed Forces said in a statement. "These actions are preventive in nature and are aimed at securing airspace and protecting citizens, especially in areas adjacent to the threatened region." A few hours later, it issued a statement that the aircraft had concluded their deployment, adding that "no violations of Polish airspace were observed." Swedish fighter jets stationed in Poland were among the aircraft scrambled, it said. The Ukrainian Air Force said in a statement on Telegram on Monday that Russia launched 324 drones and seven missiles overnight, resulting in 311 of the attacks being either shot down or suppressed by electronic warfare. "There were confirmed impacts of two missiles of various types and 15 strike UAVs at three locations," it said. Andriy Yermak, head of Ukraine's Office of the President, said in a statement on X that some of the Russian aerial strikes hit civilian infrastructure, including in the capital Kyiv. "He wants nothing but war and Ukraine's defeat," he said, referring to Russian President Vladimir Putin. "But defeat is not an option." "Russia and its satellites are also testing NATO's response," he added. "Drones entering the airspace of the Baltic states are signals that must not be ignored."
