AGC appeals High Court decision in Isham Jalil contempt case

KUALA LUMPUR: The Attorney-General's Chambers (AGC) has filed an appeal against the High Court's decision to dismiss committal proceedings against former Umno information chief Isham Jalil.
Isham's lawyer Jamie Wong confirmed the matter when contacted today.
"We received the notice of appeal dated July 15 via email," she said in a WhatsApp message.
Judge K. Muniandy, in his decision, said Isham's statements criticising Datuk Seri Najib Razak's corruption trials involving 1Malaysia Development Bhd (1MDB) did not undermine public confidence in the judiciary.
The court ruled that the alleged contempt did not have a direct bearing on the specific courts in which the 1MDB and SRC International Bhd cases were heard and decided.
Muniandy said the object of the law of contempt was not to protect judges and their dignity, but to safeguard the public's rights by ensuring that the administration of justice is not obstructed.
He said the judgments in the corruption cases involving 1MDB and SRC International were clearly based on facts and the law, rather than on emotion or public pressure.
The AGC filed the contempt application on Dec 28, 2023, following Isham's remarks in an interview titled "Townhall for Justice: Keadilan Sebenarnya Untuk Siapa?" (Justice: Who Is It Really For?).
In his remarks, Isham had criticised the corruption trial and appeal involving his former boss, Datuk Seri Najib Razak, in relation to the 1MDB and SRC International Sdn Bhd cases.
The recorded interview, which discussed the trial and appeal proceedings in the SRC and 1MDB cases, was posted on the Facebook page of the Malaya Post on Sept 30, 2023.

Zara, a Form One student at Sekolah Menengah Kebangsaan Agama (SMKA) Tun Datu Mustapha in Papar, Sabah, was found critically injured in a drain beneath her school dormitory in the early hours of July 16, after reportedly falling from the third floor. She died the following day at Queen Elizabeth I Hospital in Kota Kinabalu. Her body was buried on July 17 without a post-mortem, prompting her mother to seek legal steps to exhume the grave for an autopsy, amid public concern and questions over the cause of death.

Kota Kinabalu: The investigation paper submitted to the Attorney-General's Chambers on the death of Form One student Zara Qairina Mahathir is incomplete, according to a joint statement by the family's legal counsels. 'In light of Prime Minister Datuk Seri Anwar Ibrahim's statement that the investigation paper concerning the death of Zara Qairina binti Mahathir ('Zara') has been submitted to the Attorney-General's Chambers, we wish to clarify the following matters regarding the clothing and personal items Zara was wearing when she was found outside the school's hostel building at dawn on July 16, 2025. 'From July 17, until today, the police have never collected nor requested any of these items from our client for the purpose of investigation. 'Therefore, we believe that the investigation paper submitted to the Attorney General's Chambers is incomplete,' according to Hamid Ismail and Shahlan Jufri who represented Zara's mother. According to them, all of Zara's clothing and belongings were handed over to her mother by hospital staff on July 16. These items, they said, are currently in the custody of a representative of a non-governmental organisation (NGO), who has been officially appointed as the sole representative of Zara's mother. 'We are deeply shocked by this, as in our experience handling criminal trials in court, it is standard procedure for police to seize all items worn by a victim suspected of having died as a result of any criminal act, for the purpose of investigation. 'These clothes and personal effects are crucial pieces of evidence that should have been forensically examined and analysed to determine whether Zara's death involved any criminal elements,' said the counsels. They added that the police's failure to do so raises serious concerns as to whether the investigation has been limited solely to the theories of sudden death or suicide despite multiple police reports lodged by Zara's mother requesting investigation into possible criminal elements in her daughter's death. 'Furthermore, no post-mortem was conducted prior to Zara's burial. Noraidah KOTA KINABALU (Aug 3): The mother of Form One student Zara Qairina Mahathir has lodged a fresh police report after recalling possible signs of physical trauma on her daughter's body — nearly three weeks after her tragic death at a school hostel in Papar. Noraidah Lamat filed the report at the Sipitang police station on Sunday, stating she had remembered seeing bruises on Zara's back while preparing her body for burial. Her legal counsel, Hamid Ismail and Shahlan Jufri, said the memory was triggered during questioning about the state of Zara's body during the Islamic funeral washing ritual at Queen Elizabeth Hospital I on July 17. 'Our client did not mention this earlier because she had completely forgotten due to her overwhelming grief,' they said in a statement. The lawyers asserted that this new detail warrants a fresh investigation into Zara Qairina's death, despite recent remarks by Home Minister Datuk Seri Saifuddin Nasution Ismail, who said the police had completed their probe and would submit the investigation papers to the Attorney General's Chambers (AGC) next week. 'Zara Qairina's grave must be exhumed, and a post-mortem must be carried out to determine the exact cause of death and the possibility of foul play,' the lawyers urged.
