Testimony: Warren police SUV was going nearly 115 mph seconds before crash that killed 2

A Warren police vehicle that violently collided with an SUV carrying two men, killing them both, was traveling at 114.9 mph five seconds prior to impact and 93.8 mph at the time of impact, a Macomb County sheriff's evidence technician and crash investigator testified in court during a preliminary exam for a former officer charged in the case.
Relatives and supporters of the men, Cedric Hayden Jr., 34, and his lifelong best friend, DeJuan Pettis, 33, shook their heads when Sheriff's Deputy Joseph Bosek testified on Monday, June 23, about the speeds the police-owned Ford Explorer was traveling before and when it collided with a Dodge Durango the men were riding in.
Former Warren Police Officer James Burke, 29, is charged with two counts of homicide-manslaughter with a motor vehicle, a felony, and two misdemeanor charges, a moving violation causing serious impairment of bodily function and public officer−willful neglect of duty in the Sept. 30 crash. Burke was terminated by Warren police after he was criminally charged, his attorney, Marc Curtis, said after the hearing.

Bosek testified that event data recorder information indicated the police SUV was traveling at 113.5 mph four seconds before impact; 113.4 mph at three seconds before impact; 111.4 mph at two seconds before impact, and 108.8 mph one second before impact.
He testified that 2.6 seconds before impact was the first indication of braking and that there was evidence of braking "all the way through until you got to .7 seconds," when the anti-lock braking system kicked on. He also testified that steering control on the police SUV determined evasive steering, with an attempt to the right at 0.3 seconds and 0.2 seconds before impact and then to the left at 0.1 second before.
Bosek, the third witness to testify June 23, told the court that he also reviewed data from the Durango, which is anticipated to be discussed when the preliminary exam continues June 25 before Chief Judge John Chmura in 37th District Court in Warren. Chmura will decide whether or not to bind over Burke to the county's circuit court for trial.
The sheriff's office, which investigated the crash, previously indicated the police SUV had no emergency lights or sirens activated. A civil lawsuit filed in October against two officers and the city indicated the police SUV was traveling at or more than 100 mph.
The courtroom was full for the start of the exam, with many of those present relatives or supporters of Hayden and Pettis. Several wore white T-shirts with "Justice for Twan & Juan Friends til the end" on them. One woman dabbed her eyes with a tissue several times when the first witness, Officer Andrew Piasecki, who responded to the scene that night, testified, describing the scene as "pretty hectic" and that Burke appeared "shook."
Officer Rami Anees testified that he came upon the crash and saw Burke by the sunroof of the Durango, which was on its driver's side, trying to assist one of its occupants. Anees, who was in his third month of field training with Warren police at the time of the crash, testified that Burke "basically ordered" him to check on Burke's partner, then went back to assist Burke get the occupant out of the Durango.
He testified that he saw another occupant on the passenger side of the Durango. Once the civilians were out of the Durango, Anees said he did CPR on one of them, as the man had no pulse, until firefighters arrived. Anees, too, described Burke in "some sort of shock."
The sheriff's office indicated the police's oncoming SUV slammed into the Durango as it turned left from Schoenherr Road onto Prospect Avenue about 5 a.m. Fieger Law — the firm representing the men's families — released what it indicated were three new videos taken prior to and during the violent collision between the two vehicles.
Burke's 34-year-old partner was hurt in the crash, but has not faced any charges. Burke said little during the exam except to answer "Yes," your honor" to questions Chmura posed to him.
The sheriff's office previously indicated the Warren officers were responding to a Flock camera hit on a stolen, black Jeep Cherokee out of Sterling Heights that was traveling southbound on Schoenherr at 10 Mile. There allegedly were two stolen firearms in the Cherokee, the sheriff's office spokesperson previously said. She previously said there was no "pursuit," but the officers were responding to a be-on-the-lookout.

Illegal migrant — not deported despite multiple DUI and domestic violence raps — allegedly kills mom, 11-yr-old daughter in horrific wrong-way crash

An illegal immigrant from Mexico was allegedly drunk behind the wheel of a speeding SUV that crossed into incoming traffic and crashed head-on into a compact car, killing an innocent woman and her bright-eyed 11-year-old daughter, New Jersey authorities said. Raul Luna-Perez, 43, has been living in Red Bank, N.J., since early 2023, federal sources told The Post. When and where he allegedly snuck into the U.S. is not known. The suspect has been roaming free despite two DUI arrests in March and April, and a domestic violence arrest in 2023, according to records. 8 Maria Pleitez and Dayanara Cortes were killed in a head-on crash July 26. 8 Photos from the scene show the mangled front-end of Pleitez's car. Y Smith/TLS 'Governor Murphy and his sanctuary policies released this serial criminal into New Jersey communities,' Department of Homeland Security Assistant Secretary Tricia McLaughlin told the Post Friday. 'Now, this innocent family is shattered by their failed leadership. 'President Trump and Secretary Noem will continue to do everything in their power to remove these criminal illegal aliens before they destroy more lives.' Luna-Perez's Dodge Durango slammed into Maria Pleitez's Nissan Sentra in the horrific July 26 wreck in Lakewood, NJ, according to local prosecutors. The 42-year-old mother was killed instantly. Her youngest daughter, Dayanara Cortes, who was sitting in the front passenger seat, perished soon after arriving at the hospital. A second, unidentified 11-year-old girl riding in the back seat at the time of the 11:20 p.m. collision, was also injured and rushed to a local hospital in critical condition. She has since been upgraded to stable. Luna-Perez walked away with minor injuries. His two passengers sustained minor injuries, for which they were treated and released. 8 Raul Luna-Perez is a Mexican national. Ocean County Corrections 8 The crash killed Pleitez instantly, while Dayanara died moments after arriving at the hospital. Y Smith/TLS Because he was showing symptoms of intoxication at the crash scene at Cross Street and Hearthstone Drive, blood was drawn from Luna-Perez at the hospital, authorities said. He was later charged with two counts of vehicular homicide and assault by auto. Charges could be added once prosecutors receive the blood test results. In a sad irony, the mother he allegedly killed immigrated from El Salvador years ago. It is unclear if her children were born in the U.S. A GoFundMe campaign is raising money to pay for the bodies to be transported to El Salvador for burial. 'My aunt was a wonderful woman who worked hard everyday to take of care her 2 daughters,' her niece, Maria Celina Aguilar, wrote on the GoFundMe page, which has raised close to $30,000. The mother and daughter are survived by Dayanara's 16-year-old sister, the niece said. The suspect remains in custody at the Ocean County Jail in Toms River on an active ICE immigration detainer, according to online jail records. 8 Dayanara only recently celebrated her 11th birthday. 8 A photo shows police tape encircling Luna-Perez's crumpled SUV. Y Smith/TLS Luna-Perez has been a scofflaw for years, records show. Why he remained in the U.S. after being charged with crimes multiple times is a mystery. New Jersey prosecutors would not even discuss his immigration status, citing state disclosure laws He was arrested in 2008 by Red Bank cops for disorderly conduct. He was charged with assault on Jan. 2, 2023, following a violent incident in the same shore town. That same month, Luna-Perez was busted — again in Red Bank — for leaving the scene of an accident involving property damage, and failure to report an accident. He was later ordered to pay a $970 fine. His rap sheet includes an arrest in June 2023 for domestic violence. The details surrounding that incident were unavailable. Shockingly, Luna-Perez was twice collared for DUI within a month this year, yet continued to walk — and drive — free. He was busted March 20 after a traffic stop on River Street in Red Bank. On April 17, he was stopped by police and again charged for DUI. Prosecutors said Luna-Perez does not yet have a lawyer. 8 The mother and daughter will be buried in El Salvador. 8 Luna-Perez seemed drunk at the crash scene, authorities said. Y Smith/TLS While Red Bank has never declared itself a 'sanctuary city,' officials there adopted a 2017 resolution stating its support for migrants. Under the direction of Gov. Phil Murphy, New Jersey Attorney General Gurbir Grewal issued a directive in 2018, turning the Garden State into a sanctuary state. In recent years, Republican lawmakers have implored Murphy to 'reevaluate' the state's position on the classification. Since 2018, New Jersey has had a statewide Immigrant Trust Directive, with new mandates designed to foster cooperation and 'strengthen trust between law enforcement officers and immigrant communities.' One of those bars police from even questioning suspects about their immigration status.

Mom dies of injuries — eight days after daughter — in rural Hamilton crash

The mom of a 10-year-old girl killed in a multi-vehicle crash on Trinity Church Road last week has died, The Spectator has confirmed. Hamilton police said a 30-year-old woman from Glanbrook died of her injuries following the July 6 crash around 9:30 p.m. The woman and a 10-year-old girl, also from Glanbrook, were both occupants of a Honda Civic that was hit head-on by a GMC Sierra, whose driver was trying to pass another vehicle, police suggested. Girl was in car hit head-on by pickup truck that was trying to pass another vehicle The impact caused the Honda to be pushed back into the path of Ford Explorer, causing a second crash. Two other people in the Honda were hurt and three in the GMC Sierra suffered minor injuries. 'Hamilton police extend our continued condolences to all those impacted by this tragic incident,' police said a news release Tuesday, announcing the second death. Police have not released their names because detectives have not spoke with next of kin about doing so. However, friends have identified the victims online as Julia Smith and her daughter Grace. Julia died on Monday, eight days after her daughter. The investigation by the collision reconstruction unit is ongoing. No charges have yet been laid.
