Bombay high court junks plea alleging Maharashtra poll discrepancies
MUMBAI: Bombay high court on Wednesday rejected a petition to declare the state assembly elections null and void due to 76 lakh bogus votes allegedly cast after the closing of polls at 6 pm on Nov 20 last year.
"There is nothing on record that at any polling station in the state of Maharashtra, any untoward incident or fraud took place. We, hence, fail to discern how, in the absence of any tangible material acceptable in law, which also needs to be booth-wise, there was any fraudulent voting," said Justices Girish Kulkarni and Arif Doctor.
Petitioner Chetan Ahire, a voter from Vikhroli constituency, based his petition on an RTI reply obtained by Delhi resident Venkatesh Nayak from the
Election Commission of India
that "there is no data available about these votes with the ECI."
Ahire said that these votes cannot be considered in declaring the results.
Senior advocate Ashutosh Kumbhakoni, for the EC, and the Centre's advocate Uday Warunjikar urged the dismissal of the petition as it amounted to "gross abuse of the process of law." "We wonder how the petitioner can have a locus standi to seek such wide, sweeping, and drastic reliefs to question the entire elections of the state legislative assembly.
It is a relief, too far-fetched, that too on the basis of no cause of action," the judges noted.
They said this is more particularly in the context of the constitutional and statutory bar that no election to either House of a state legislature shall be called into question, except by an election petition. Such a petition is maintainable at the behest of a voter or a contesting candidate. Ahire, "having failed to demonstrate a legal injury, the sequel is automatically the lack of the petitioner's locus to maintain the writ petition.
"
The judges viewed Ahire's advocate Prakash Ambedkar's submission that the conduct of the poll violated the basic structure of the Constitution and breached Ahire's fundamental rights as "wholly without foundation". They said although farcical claims are made on purity of the process of state assembly polls, and more particularly in the context of EVMs and a need to replace them with ballot papers, "such plea of the petitioner appears to be in absolute desperation.
" The use of EVMs was held to be legal and valid by SC, the HC said.

When asked about the High Court dismissing pleas related to bogus voting in the 2024 assembly polls as "farcical claims made out of desperation", the CM said Congress leader Rahul Gandhi must stop talking about rigging and irregularities in the state polls if he really respects the Constitution, democracy and the judiciary. Asserting that the High Court has given its order in detail with logic, Fadnavis said "nothing can be done about those pretending to sleep". "But yeh public hai, yeh sab janti hai (the public knows everything)," he added using a Hindi film dialogue. Language not just means of communication, but soul of a nation: Shah
New Delhi, June 26 (UNI) Union Home Minister Amit Shah today emphasised the importance of language in preserving a nation's identity and cultural heritage, stating that it is not merely a means of communication, but the very soul of a nation. 'Our roots, traditions, history, and culture cannot progress without language. Just as it is important to keep languages alive, it is equally important to enrich them,' Shah said while speaking at the Golden Jubilee celebration of the Rajbhasha Department at Bharat Mandapam here. Speaking on the government's ongoing efforts to promote linguistic diversity, Shah highlighted the 'Bhasha Sangam' initiative under which students across all schools in the country are being taught 100 commonly used phrases in the 22 languages recognised by the Constitution. He stressed that until a person takes pride in their own language, expresses themselves in it, and develops the ability to think, analyse, and make decisions in their own language, they cannot free themselves from a colonial mindset. Reflecting on the achievements of the Department of Official Language, Shah said its 50-year journey has been shaped by struggle, dedication and determination. He underscored the importance of conducting administrative work in Indian languages, aligning with the spirit of the nation and upholding the self-respect of these languages. 'If a country wants to function according to its own consciousness, progress based on its culture and preserves its self-respect, it is essential that its administration operates in its own languages. It was with this noble objective that the Department of Official Language was established,' he said. Shah said over the past 11 years, Prime Minister Narendra Modi has launched several initiatives under the 'Ek Bharat, Shreshtha Bharat' programme. Events such as Kashi-Tamil Sangamam, Kashi-Telugu Sangamam, Saurashtra-Tamil Sangamam, Shashwat Mithila Mahotsav, and Bhasha Sangam have provided platforms to strengthen national unity and celebrate India's linguistic and cultural diversity. Present on the occasion were Minister of State for Home Bandi Sanjay Kumar, Lok Sabha MP Bhartruhari Mahtab, Rajya Sabha MP Sudhanshu Trivedi, Delhi Chief Minister Rekha Gupta, Rajya Sabha MP Sudha Murthy and others. The Union Cabinet passed the resolution to observe June 25 as ' Samvidhan Hatya Divas ' on the 50th anniversary of Emergency to expose the atrocities perpetrated on people, so that this 'Black Day' is not repeated, Union Minister for Parliamentary Affairs, Kiran Rijiju said here on Thursday. "India is the largest democracy in the world and it is the duty of every Indian to safeguard democracy," he said while addressing a press conference here. Rijiju took a jibe at the Congress, saying that those who "murdered" the Constitution are flaunting a copy of it. The Emergency was imposed on the night of June 25, 1975, and opposition leaders and media were throttled and curbs were placed on civil liberties, he added. Rijiju, who is on a three-day visit to Himachal Pradesh, debunked the charge of 'undeclared emergency' and said that those making this charge curse Prime Minister Narendra Modi from early morning to late night. India is the only country where people have so much liberty, he added. Live Events Referring to the situation in Manipur, he said that the state is suffering due to ethnic clashes for the past 50 years and with the efforts of the prime minister and Home Minister Amit Shah, the situation was coming back on track. Replying to a question, Rijiju said that allegations of the state Congress government that the Union government is not giving financial aid to Himachal Pradesh are politically motivated as development is visible everywhere - roads have reached every village and electricity and water in every household.
