HRF demands compensation to kin of farmers

The Human Rights Forum (HRF) has demanded that the State government implement the G.O. 43, which mandates comprehensive financial aid to and rehabilitation of the families of farmers who ended their life.
An HRF fact-finding team, comprising K. Anuradha, HRF A.P. State executive committee member; Y Rajesh, HRF A.P. State general secretary; V.S. Krishna, HRF A.P. and TG Coordination Committee member; and members of Rythu Swarajya Vedika (RSV) , had visited seven villages in three mandals of Gurazala division in Palnadu on July 29 and 30 and met the families of the nine farmers who ended their life in the recent years.
Speaking to media in Visakhapatnam, the HRF members said that they found that G.O. 43, meant to provide relief and rehabilitation to such families, remains unimplemented. 'Of the nine families we visited, only one had received financial assistance under the G.O. In several cases, even after official recognition that the deaths were genuine farmer suicides caused due to agrarian reasons as laid out in G.O. 43, the families received no compensation.'
In several cases, even after the three-member committee verified the deaths as farming-related, no compensation was disbursed, the HRF said.
The HRF demanded that the RDO-headed divisional-level three-member verification committee must immediately visit the affected families, complete the inquiry and ensure prompt disbursal of financial assistance and rehabilitation support.

Responding to a question on proposed changes to NCERT history books, the Chief Minister said it is wrong for politicians to rewrite history. 'No government lasts forever. If the present government changes tomorrow, what will happen if the next regime starts writing against the RSS? It is better to keep history separate from politics,' he remarked. Abdullah dismissed the opposition's criticism of his party's ongoing signature campaign for the restoration of Jammu and Kashmir's statehood, terming it baseless. 'The opposition's role is to oppose, while our role is to act,' he said. On the upcoming Vice President elections, Abdullah expressed confusion over why the polls had been necessitated. He questioned why former Vice President Jagdeep Dhankhar had resigned and where he had 'vanished.' He added, 'Now that the polls are to be held, I believe the UPA candidate should win the Vice President election.' The Chief Minister also distributed appointment orders under SRO-43 to beneficiaries at SKICC Srinagar, extending support to families who lost their breadwinners while in government service. He reiterated his government's commitment to relief and rehabilitation for the affected families.

MADURAI: The Madurai Bench of Madras High Court has imposed Rs 50,000 cost on a real estate broker for 'unnecessarily' questioning a welfare scheme introduced by the state government granting free house site pattas to people belonging to Scheduled Caste and Scheduled Tribe communities in the state. The amount should be paid to the district adi dravidar welfare officer of Ramanathapuram to be utilized for providing basic amenities for the Adi Dravidar Welfare High School, Sengapadai in Kamuthi taluk of Ramanathapuram district, the court said. The petitioner K Amalraj of Mudukulathur in Ramanathapuram district had challenged Clause 4(d) of a G.O. passed by the revenue and disaster management department on January 13, 2021. The said clause stipulates that the beneficiaries of the scheme are prevented from selling the land awarded to them till the expiry of the conditional assignment period of 10 years and even then, the land could be sold only to another person belonging to SC/ST community, he pointed out. Claiming that the said clause is discriminatory, he requested the court to declare it as void. A bench of justices SM Subramaniam and AD Maria Clete observed that the ground raised by the petitioner is untenable. "The very intention under the welfare scheme is to ensure that such lands acquired and allotted to the ST/ST people must be occupied by the people from the same community. That being the purpose and object for which the lands are acquired, then the government is empowered to impose such conditions in order to protect the interest and well being of the SC/ST people on allotment of free house site patta," they added. Further considering the contention of the government counsel that the petitioner being a real estate broker, has filed the petition for personal gains to purchase the lands from the SC/ST people and sell the same to third parties, the judges dismissed the petition by imposing Rs 50,000 cost.

The Madurai Bench of the Madras High Court has imposed a cost of ₹50,000 on a petitioner for filing a petition unnecessarily questioning the welfare scheme implemented for the benefit of the Scheduled Castes and the Scheduled Tribes. The court was hearing the petition filed by K. Amalraj who challenged Clause 4(d) in the G.O. issued in 2021 by the Revenue and Disaster Management Department. Free housesite pattas were granted to the Scheduled Castes and the Scheduled Tribes. In the present case, the scheme was being implemented in Kattuparamakudi in Ramanathapuram district. Free housesite pattas were granted to eligible Adi Dravidar people. The petitioner said as per the condition imposed in clause 4(d) of the G.O. the beneficiaries are prevented from selling the property within 10 years. Even after this period the property must be sold to the Scheduled Castes and the Scheduled Tribes. He said such a condition amounted to discrimination and should be declared void. A Division Bench of Justices S.M. Subramaniam and A.D. Maria Clete observed that the special scheme was implemented for the benefit of the Scheduled Castes and the Scheduled Tribes. Some special conditions were imposed to protect the interest of the beneficiaries. Free housesites were allotted for dwelling purposes and the idea of the government was that the livelihood of the people should be protected. In the event of not imposing any conditions, there was a likelihood of the free housesites being sold to third parties which would defeat the very purpose and objective of the welfare scheme of the government, the court observed. The conditions were imposed to meet the objective of the special scheme. It cannot be construed as discriminatory. Clause 4(d) stipulates that after the conditional assignment period of 10 years is over, the beneficiary can sell the land to another SC/ST person only and not to anybody else, the court observed. The court observed that the intention of the welfare scheme was to ensure that such land acquired and allotted to the Scheduled Castes and the Scheduled Tribes must be occupied by the people from the same community. Ramanathapuram District Adi-Dravidar Welfare Department submitted that the petitioner was a real estate broker and the petition was filed for personal gains. The court dismissed the petition and directed the petitioner to pay the cost to Ramanathapuram District Adi Dravidar Welfare Officer who in turn shall utilise the funds for providing basic amenities to the Adi Dravidar Welfare High School in Sengapadai in Kamuthi in Ramanathapuram district.
