
Wisconsin elections officials find clerk broke laws over uncounted ballots
The bipartisan Wisconsin Elections Commission voted 5-1 to accept a report finding that the former Madison clerk broke five election laws. The commission delayed a vote on ordering the city of Madison to take additional steps to improve election security.
No outcome of any race was affected by the missing ballots. Maribeth Witzel-Behl resigned as Madison city clerk in April amid investigations into the missing ballots.
The investigation was not a criminal probe and the elections commission does not have the power to bring charges. The report does not recommend that prosecutors do so.
There is no intention to refer the case to prosecutors for possible charges, commission chair Ann Jacobs said after the meeting. The goal of the probe was to find out what happened and stop it from happening again, she added.
Charges could be brought by the Dane County attorney's office or the state Department of Justice.
Dane County District Attorney Ismael Ozanne said his office would review the case if it received a referral. DOJ spokesperson Riley Vetterkind did not immediately respond to an email seeking comment.
Commissioners said they were shocked at how the Madison clerk handled the missing ballots.
The investigation determined that two bags of uncounted absentee ballots likely never made it to the poll sites where they should have been counted. The clerk's office did not notify the elections commission of the oversight until Dec. 18, almost a month and a half after the election and well after results were certified on Nov. 29.
Jacobs, a Democrat, called the incident a 'rather shocking dereliction of just ordinary responsibility.'
Republican Commissioner Bob Spindell, who cast the lone vote against accepting the report, said he blamed the problem on an extremely complicated system in the clerk's office and poor management.
'It's not something I think the clerk should be crucified for,' he said.
The elections commission report concluded that the former clerk broke state law for failing to properly supervise an election; not providing the most recent current registration information for pollbooks in two wards; improperly handing the return of absentee ballots; not properly canvassing the returns as it pertained to the 193 uncounted ballots; and failing to provide sufficient information for the municipal board of canvassers to do its work.
The report blamed a 'confluence of errors' and said that Madison did not have procedures in place to track the number of absentee ballots going to a polling place. It also said there was a 'complete lack of leadership' in the clerk's office.
'These are mistakes that could have been avoided,' said Republican commissioner Don Millis.
Madison city attorney and interim clerk Michael Haas said the city did not contest the findings of the report.
'The most important asset we have is the trust of the voters and that requires complete transparency and open coordination with partners when mistakes happen,' Haas said in testimony submitted to the commission. 'That did not happen in this case.'
Madison has already implemented numerous safeguards and procedures that were in place for elections earlier this year to ensure that all eligible absentee ballots are accounted for, Haas said.
The recommendations in the report for further actions exceed what is required under state law and are not within the authority of the commission to order, Hass testified. He urged the commission to delay a vote.
The commission voted unanimously to give Madison until Aug. 7 to respond before voting a week later on whether to order additional steps to be taken.
Four voters whose ballots weren't counted have filed claims for $175,000 each, the first step toward a class-action lawsuit. Their attorney attended Thursday's hearing but did not testify.

Rockies pitcher Biembenido Brito and free agent outfielder Pablo Abad suspended for drug tests
NEW YORK (AP) — Colorado Rockies minor league pitcher Biembenido Brito was suspended for 60 games and free agent outfielder Pablo Abad for 56 on Monday by Major League Baseball following positive tests for performance-enhancing substances. Brito tested positive for the performance-enhancing substance Stanozolol and for Hydrochlorothiazide, a diuretic and masking agent. He was disciplined under the minor league drug program, the commissioner's office said. Abad tested positive for Stanozolol and was penalized under the drug program for minor league players assigned outside the U.S. and Canada. Brito, a 22-year-old right-hander, agreed to a minor league contract with Texas in 2021 that included a $10,000 signing bonus. He was released by the Rangers in July 2024 and signed with the Rockies on May 23. He was 1-2 with a 2.97 ERA in seven starts and nine relief appearances for the rookie-level Arizona Complex League Rockies, striking out 38 and walking 18 in 33 1/3 innings. Brito is 6-7 with a 5.94 ERA in 19 starts and 31 relief appearances over parts of four minor league seasons. Abad, 19, signed with Cincinnati in June 2023 for a $10,000 bonus and was released last November. He hit .121 with one homer and six RBIs in 36 games over two seasons in the Dominican Summer League. Abad's suspension will start when he signs with a major league organization. Eleven players have been suspended this year for positive tests, including nine under minor league programs. States file lawsuit against Trump administration over efforts to collect SNAP recipients' data
Washington (AP) — A coalition of 20 state attorneys general filed a lawsuit Monday challenging the Trump administration's demand that their states turn over personal data of people enrolled in a federally funded food assistance program, fearing the information will be used to aid mass deportations. The data demand comes as the Trump administration has sought to collect private information on mostly lower-income people who may be in the country illegally. It has already ordered the Internal Revenue Service and the Centers for Medicare and Medicaid Services to share private information with the Department of Homeland Security to aid in deportation efforts. The U.S. Department of Agriculture told states last week that it had until Wednesday to hand over the data for those enrolled in its Supplemental Nutrition Assistance Program, or SNAP, which serves more than 42 million people nationwide. The USDA said the data will help it combat waste, fraud and abuse. The states' lawsuit seeks an injunction to block the data transfer. In the meantime, state attorneys general in the SNAP lawsuit said they will not disclose what they consider to be private information of recipients — including their immigration status, birthdates and home addresses — because they believe it would be a violation of privacy laws. 'It's a bait-and-switch of the worst kind,' California Attorney General Rob Bonta said in a Monday afternoon news conference announcing the lawsuit. 'SNAP recipients provided this information to get help feeding their families, not to be entered into a government surveillance database or be used as targets in the president's inhumane immigration agenda.' In May, the department announced it was seeking the data as part of President Donald Trump's executive order to obtain data from state programs to help root out fraud and waste. 'For years, this program has been on autopilot, with no USDA insight into real-time data,' USDA Secretary Brooke L. Rollins said in a statement at the time. 'The Department is focused on appropriate and lawful participation in SNAP, and today's request is one of many steps to ensure SNAP is preserved for only those eligible.' USDA officials declined a request for comment on the suit. The USDA did not mention immigration enforcement in the announcement or later notices. It is not clear why USDA officials believe the data will help it weed out fraud and abuse. The agency claims the program is already 'one of the most rigorous quality control systems in the federal government.' Immigration advocates noted that the Trump administration has used the same argument to obtain other sensitive data, only to later admit it would be using the information to enhance its deportation operations. Trump administration officials, for example, initially claimed they were seeking state Medicaid data to fight fraud. Last week, a top immigration official conceded they would be utilizing that same information to locate immigrants. Agency officials have threatened to withhold SNAP funding if states fail to comply with their demand for data. While immigrants without legal status are ineligible to receive SNAP benefits, they can apply on behalf of their children who are U.S. citizens or those who are part of a mixed-status household. Under the program, formerly known as food stamps, the federal government pays for 100% of the food benefits, but the states help cover the administrative costs. States are also responsible for determining whether individuals are eligible for benefits and for issuing those benefits to enrollees. Immigration and data privacy advocates expressed alarm at the Trump administration's efforts to obtain sensitive SNAP data maintained by states.
