
SC seeks MP govt response over ex-SIMI chief plea on sedition case
In 2017, a district court in Madhya Pradesh awarded life sentence to Nagori and 11 others for the possession of weapons, explosives, ammunition and for the plotting of 'anti-national' activities, following their arrest by a Special Task Force in March 2008.
During the last leg of arguments on May 15 this year, the top court issued an order to the Madhya Pradesh high court directing all proceedings related to sedition to be kept in abeyance pending the challenge to the constitutionality of the sedition offence contained in section 124A of the Indian Penal Code. The high court deferred the hearing of the appeal against which Nagori approached the top court seeking clarification on whether the order of May 2022 would impact hearing on his appeal.
A bench of justices PS Narasimha and R Mahadevan issued notice on Nagori's appeal seeking response of the Madhya Pradesh government and posted the matter for hearing after two weeks.
'The counsel for petitioner submits that the case in appeal against his client has virtually concluded. Before passing the final order, the HC judge seeks clarification with regard to operation of para 8(d) of the order of this court on May 11, 2022. Issue notice. List in the second week (after reopening) in July,' the top court said in its order.

Maharashtra moves Supreme Court challenging acquittal of 2006 Mumbai blasts accused
The Maharashtra government has moved the Supreme Court challenging a Bombay High Court order acquitting all 12 persons accused in the 2006 Mumbai local train blasts case, the Hindustan Times reported on Tuesday. The Supreme Court has listed the petition for hearing on Thursday. On Monday, the High Court acquitted the 12 men accused in the case, holding that the prosecution had 'utterly failed' in establishing their guilt. This came nearly 10 years after a special court had sentenced five of them to death and others to life imprisonment. The case pertains to the serial blasts that took place on July 11, 2006, in which seven bombs exploded in suburban trains on Mumbai's Western Railway line, killing 189 persons and injuring 824. Following a trial under the Maharashtra Control of Organised Crime Act, a special court had in October 2015 convicted the 12 persons. The five persons who had been sentenced to death by the trial court are Kamal Ansari, Mohammad Faisal Ataur Rahman Shaikh, Ehtesham Qutubuddin Siddiqui, Naveed Hussain Khan and Asif Khan. All had been held guilty of planting the bombs. Kamal Ansari died in 2021 due to Covid-19 while in the Nagpur Central Jail. The seven others who had been sentenced to life imprisonment by the trial court are Tanveer Ahmed Ansari, Mohammed Majid Shafi, Shaikh Mohammed Ali Alam, Mohammed Sajid Margub Ansari, Muzzammil Ataur Rahman Shaikh, Suhail Mehmood Shaikh and Zameer Ahmed Latifur Rehman Shaikh. On Monday, a special High Court bench of Justices Anil Kilor and Shyam Chandar overturned the convictions stating that the prosecution had failed to establish its case beyond reasonable doubt. It ordered the accused men to be released from jail if they were not required in any other case. Chief Minister Devendra Fadnavis had described the verdict as 'shocking' and said that the state government would challenge it in the Supreme Court, the Hindustan Times reported.

Uddhav Sena leader held on rape charges in Ahilyanagar; ‘suspect he is being framed,' says party
The head of the Shiv Sena (UBT) in Maharashtra's Ahilyanagar, Kiran Kale, has been arrested for allegedly raping a 21-year-old woman, the police said on Tuesday. Kale was arrested from his Ahilyanagar home at midnight after a married woman from Karjat lodged a complaint at the jurisdictional police station on Monday, alleging that he had raped her in 2023 and 2024, officials said. While Kale's family alleged that he was framed in the case as he had exposed a multi-crore road construction scam in the city recently, the Shiv Sena (UBT) raised similar doubts and sought a thorough investigation into the case. In her complaint, the woman said she had approached Kale seeking his help in a family matter. She said that she and her husband constantly fought, and she had sought Kale's help. She alleged that Kale raped her and threatened to kill her if she spoke about what had happened. Kale has been booked under sections 376 (1) (rape), 504 (intentional insult with intent to provoke) and 506 (criminal intimidation) of the Indian Penal Code (IPC). Meanwhile, Vikram Rathod, joint secretary, Shiv Sena (UBT), said that Kale was being framed in the case. 'I have met the city police and urged them to investigate the matter thoroughly as we suspect that Kale is being framed,' he said. Meanwhile, BJP spokesperson Keshav Upadhaye took a jibe at the Shiv Sena (UBT), saying, 'There are pictures of Kale on social media with Supriya Sule and Aaditya Thackeray. Does this mean that they are supporting Kale? Will Uddhav Sena leaders now demand a CBI case in the matter?'
