Victor teacher accused of raping minor

A Victor high school teacher has been charged with rape following a joint investigation by the Ontario County Sheriff's Office, Ontario County District Attorney's Office and Ontario County Child Protective Services, according to authorities.
David Porter, 66, is alleged to have engaged in sexual intercourse with a person less than seventeen years old in December 2024, according to police. Authorities said the victim is a student, but not a current student of Porter and that there is no evidence the incident occurred on school property.
According to police, once the district was notified of the investigation, Porter was placed on immediate leave and the district had its legal counsel seek interim and immediate suspension of his teaching certificate.
'These circumstances are distressing. The safety and well-being of our school community is of the highest importance. Additional support and resources will be available on Monday for students and staff," Superintendent Timothy Terranova said. "If you or your child are in need of immediate support, please contact your child's principal. The school will send out information as law enforcement allows."
Porter was arraigned in Ontario County on Saturday and was released on his own recognizance, according to police. An order of protection was issued on behalf of the victim. Porter is expected to appear back in Victor Town Court on Tuesday, March 4.
The investigation is ongoing.

A family member told police that Porter sent a concerning text message and that he may be armed with a handgun. Porter is described as a Black male who is 6'3 and weighs about 285 pounds. He also has black hair and brown eyes. According to those who saw him before he was reported missing, Porter was wearing a red shirt. ONTARIO COUNTY, NEW YORK (WROC) — In court Thursday: the seven suspects charged in the case of Sam Nordquist, a Black transgender man from Minnesota who was found dead in the Finger Lakes earlier this year. Thursday's court date was for a motions hearing, intended to hash out some of the technicalities and complexities behind this case. And, establish how future court proceedings will look for each of the defendants. The seven suspects are accused of torturing and killing Nordquist. Each suspect pleaded not guilty to all of their charges back in March. Thursday was considered a motions hearing where both the prosecution and defense attorneys moved towards how their respective cases will proceed once they go to trial. While the defense attorneys argued that each case should be tried separately, Ontario County Assistant District Attorney Victoria Porter said the request for this is premature. 'We have to determine first if we can use the statements that were elicited by the defendants and then determine if and how we would sever the case,' Porter said. All seven suspects face charges including first degree murder, kidnapping, conspiracy and endangering the welfare of a child. All suspects, except Thomas Eaves, have been charged with concealment of a human corpse. A major discussion inside the courtroom revolved around Discovery Laws, which are the procedures prosecutors are expected to follow to present their evidence to the defense in a timely fashion. Porter said this evidence is being handed over as soon as its able to. 'The discovery in this case is voluminous, there's many things outstanding. This is an active police investigation, there are things that are being created even as we speak that have yet to be turned over to the defense attorney,' Porter said. 'Realistically though, there may be discovery coming far past the hearing dates. There's still material being tested at the lab for example, and things that need to be tested.' The legal team for Arzuaga requested a change in venue in respect to the fairness of her future trial. The prosecution countered, saying due to this case making national headlines, it isn't necessary. Porter also addressed the legal challenges ahead and the emotional toll this has had on Nordquist's family and friends. 'I know that this is a difficult process and its slow and its painful and they don't have a lot of the information that we all get,' Porter said. We learned all seven suspects will be due back in court in early September — where the court is expected to proceed on some of the motions raised Thursday. Copyright 2025 Nexstar Media, Inc. SYRACUSE, N.Y. (WSYR-TV) — The Syracuse Police officer who killed a man she thought was about to shoot her was found civilly liable for violating his constitutional rights Friday in federal court. Officer Kelsey Francemone shot and killed Gary Porter as she responded and was working to subdue active shooters at a Father's Day party that turned into a riot near Syracuse's Skiddy Park in 2016. Francemone was cleared of any criminal wrongdoing by a grand jury in 2016. Porter's family then sued Francemone personally, alleging she violated his constitutional rights. A federal jury of eight people found the victim's family did sufficiently argue their claims and awarded the Porter family $10,000 in damages. Somewhat contradictory, the jury also found that Francemone successfully argued that Porter was armed and actively shooting. That determination allows the judge to consider 'qualified immunity' for Francemone, which allows her protection from damages because of her official duties as a police officer. The $10,000 awarded at trial is somewhat of a financial victory for the City of Syracuse, which was about to award the Porter family more than $800,000 until the settlement was blocked by the Syracuse Common Council.
