Govt will ensure water utilities meet targets after tariff adjustments

KUALA LUMPUR: The government is taking robust steps to ensure state water utility companies meet operational and infrastructure improvement targets following water tariff adjustments, says Datuk Seri Fadillah Yusof.
The Energy Transition and Water Transformation Minister added that the National Water Services Commission (SPAN) plays a crucial role in assisting state-level utilities by regulating and considering applications for tariff increases.

"To ensure a reliable supply of clean water, operational and capital expenditure costs are the main issues faced by water supply companies," said Fadillah during the Minister's Question Time at the Dewan Rakyat on Thursday (Aug 7).
He was responding to a question by Datuk Mohd Isam Mohd Isa (Barisan-Tampin) about the monitoring and auditing mechanisms for additional revenue from water tariff adjustments and actions against operators failing to meet KPIs post-adjustment.
Fadillah explained that many companies struggle to cover these costs due to low tariff rates, prompting regular tariff reviews every three years.
He added that all states, except Perak, submitted applications for tariff adjustments, which SPAN approved based on specific justifications.

Fadillah emphasised that these adjustments come with stringent Key Performance Indicators (KPIs) that companies must meet.
"In cases where KPIs are not met, operators can face penalties under the law, including fines and imprisonment," he said.
He added that before any legal action is taken, SPAN will issue a warning to non-compliant companies, granting them six months to fulfil the KPIs.
He highlighted the importance of performance-based licensing, noting that water utility licences are reviewed every five years, with good performers having their licences extended for the full term.
'Conversely, poor performers face shorter extensions and, in severe cases, non-renewal of their licences.
"If a company consistently fails to meet KPI standards, their licence may not be renewed, and the state government will need to appoint a more capable operator," Fadillah said.
Last month, SPAN received applications from service operators in 10 states, including Penang, Perlis, Kedah, Kelantan, Terengganu, Selangor, Negeri Sembilan, Melaka, Johor, and Pahang.
Earlier this month, households using between 20 to 35 cubic metres (m3) of water monthly in Selangor, Kuala Lumpur, and Putrajaya will now pay RM1.62/m3, an increase of 30sen effective September 1 this year.

Deputy Prime Minister Dato Sri Fadillah Yusof said the basis of agreement had already been established through a joint declaration between the federal government and the Sarawak government. 'The declaration has already been made (finalised) in which the Prime Minister and the Sarawak Premier clearly agreed that federal and state laws must go hand in hand. 'The Federation cannot disregard Sarawak laws, and likewise, Sarawak cannot disregard federal laws. So that has already been agreed upon in the declaration,' he said when met after officiating the MySalam 3K (Finance, Health and Welfare) Petra Jaya programme at the Kampung Samariang Batu Community Hall here today. He was responding to a statement by Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said in Parliament on Friday, who said that Petronas and Petros have yet to finalise the terms and mechanisms for implementing the joint declaration on gas distribution, even though nearly three months have passed since it was signed. Azalina reportedly said both parties were still discussing details of the cooperation framework based on agreed principles, in line with commercial considerations. Fadillah further explained that what remains unresolved are only the administrative and commercial negotiations between Petronas and Petros. 'The declaration is already there. What has yet to be finalised are the business negotiations between Petronas and Petros. These are still ongoing, and that is the current situation. 'So yes, they are still negotiating,' he said. Fadillah stressed that although no timeline has been set, the government hopes the negotiations can be concluded quickly to facilitate investment and business operations both offshore and onshore. 'That is what we want to expedite because it will make it easier for industry players to carry out their daily activities,' he said. Prime Minister Datuk Seri Anwar Ibrahim and Sarawak Premier Datuk Patinggi Tan Sri Abang Johari Abang Openg signed the Joint Declaration on May 21, which formed the basis for establishing a cooperation framework between Petronas and Petros. The declaration also outlined key principles of alignment, such as ensuring all Federal and Sarawak State laws related to gas distribution within Sarawak coexist and are respected by all parties engaged in such activities in the state. In addition, the declaration stated that Petronas will continue to carry out its roles and responsibilities as provided under the Petroleum Development Act 1974 (Act 144). Petros, meanwhile, has been appointed as the gas aggregator for Sarawak's domestic market effective March 1, 2025, and this appointment will be respected by all industry players involved in gas distribution and supply to domestic consumers. As for the liquefied natural gas (LNG) business, Petronas will continue its role and responsibilities across the entire upstream value chain through to the sale of LNG to international markets, and all existing agreements or arrangements between Petronas and/or its subsidiaries with third parties for LNG sales (from upstream to export) will remain intact and in force. Meanwhile, in his speech, Fadillah said the Petra Jaya 3K Carnival 2025 was an important platform to engage with the people, listen to their voices, and share information on various government initiatives in a direct, open, and inclusive manner. This approach, he said, was in line with the Madani spirit which emphasises well-being, justice, and inclusiveness. According to him, the government has always focused on the lower-income (B40) group who are more vulnerable to the pressures of the cost of living. 'In line with this, various assistance programmes have been implemented to ease the burden and improve the well-being of the people. Among them are the Rahmah Cash Contribution (STR), Cost of Living Aid (BSH), PeKa B40, the People's Housing Project (PPR), and the Rahmah Basic Contribution (SARA). 'In fact, one important initiative I wish to highlight today is mySalam, a free health protection scheme for the B40 group which provides financial assistance and hospital treatment for critical illnesses,' he said. Under Thrust A7 – Strengthen­ing Flood Mitigation and Adapt­ation – the government emphasises implementing more comprehensive, integrated and innovative strategies to increase the nation's resilience to increasingly complex and high-impact flood disasters. 'As the main technical agency in managing national water resources, Petra hopes JPS will continue to lead in ensuring integrated, sustainable and resilient water resource management in Malaysia. 'JPS is also expected to strengthen its role as a facilitator of the national water policy at the state and district levels so that there are no gaps in planning and implementing water-related projects,' Fadillah added.

KOTA BARU: The Kelantan government has acknowledged that Air Kelantan Sdn Bhd (Air Kelantan) owes Tenaga Nasional Bhd (TNB) RM61 million in outstanding electricity bills and will settle the amount in stages. State Infrastructure, Water and Rural Development Committee chairman Datuk Dr Izani Husin said the arrears were partly due to the Covid-19 pandemic and the Movement Control Order, which hindered bill collection, coupled with some residents withholding payment during frequent water supply disruptions. "TNB has met with us to discuss possible solutions, but no agreement has been finalised. "We will discuss further to determine a repayment schedule. With Air Kelantan's improved management, we are confident the debt will be cleared according to the agreed timeline," he told reporters after the weekly state executive council meeting at Kompleks Kota Darulnaim today. He added that Air Kelantan had previously settled older electricity arrears according to schedule, but several districts were found to still have outstanding amounts. Earlier, Deputy Prime Minister and Energy Transition and Water Transformation Minister Datuk Seri Fadillah Yusof revealed that Air Kelantan's arrears with TNB had reached about RM61 million as of June 30.
