Life sentence for Facebook rapist after State's successful appeal

A convicted rapist who lured his unsuspecting Facebook victims with the promise of employment before raping them at knife-point recently had his 15-year sentence escalated to life imprisonment.
Philani Ndwandwe was sentenced in the Durban High Court after the State took his 2023 rape sentence on appeal.
National Prosecuting Authority (NPA) spokesperson, Natasha Ramkissoon-Kara, said Ndwandwe, between July 2018 and April 2020, engaged the complainants on Facebook and promised them employment.
'He would then meet each of the complainants at a specified location in the Amaoti and Congo areas, where he would accompany them further. En route, he would force them into a bush/roadside and rob them at knifepoint and rape them. Following his appearance in the Ntuzuma Magistrate's Court, Ndwandwe pleaded guilty to the five counts of rape and was sentenced to 15 years' imprisonment on each count.

'Two of these rape counts attracted the minimum sentence of life imprisonment because one of the complainants was physically disabled and the other rape involved the infliction of grievous bodily harm. While the court did not find any substantial and compelling circumstances to deviate from the minimum sentence of life imprisonment, the court sentenced Ndwandwe to 15 years' imprisonment on each count (including the ones that attracted life imprisonment),' said Ramkissoon-Kara.
Aggrieved by the sentences imposed on the two rape counts, which attracted the minimum sentence of life imprisonment, Chief Prosecutor of the Ntuzuma Cluster, Advocate Amy Kistnasamy, referred the matter to the office of the Director of Public Prosecutions in KwaZulu-Natal.
'Based on the merits, it was decided that the State would appeal the sentence. The State applied to the High Court for leave to appeal the sentences. This was granted,' said Ramkissoon-Kara.
Representing the NPA, Advocate Kelvin Singh articulated the detrimental consequences faced by the victims, painting a vivid picture of the long-lasting trauma inflicted upon those affected.
Singh argued that the trial court was obliged to impose life imprisonment in terms of the minimum sentencing legislation for those two counts of rape, where the minimum sentence of life was applicable.
He told the court that the offences of rape violated the complainants' constitutional rights, including their rights to bodily integrity and humanity.
Singh quoted cases from the Supreme Court of Appeal (SCA), where the court had increased an accused's sentence from six years' imprisonment to life imprisonment, asking that the appeal court employ the same principle in Ndwandwe's matter.
'Further quoting the SCA, Singh mentioned that rape is one of the most invasive and horrendous criminal acts, and that despite the minimum sentencing legislation, this crime is at unprecedented high levels in South Africa,' said Ramkissoon-Kara.
The Durban High Court agreed with the State's argument, setting aside the 15 years' imprisonment imposed on the two counts of rape and replacing them with life imprisonment.
The court highlighted the violence used on the complainants, the premeditation involved, and the seriousness of gender-based violence as part of its judgment.

In this matter, Gopal, Ravine Naidoo, Tyreece Govender, and Timothy Govender are charged with Dlamini's murder, two counts of attempted murder, malicious damage to property, and public violence. The State is alleging that Gopal incited his security guards and members of the public to commit acts of violence against black Africans visiting Phoenix. The witness said that when the incident took place around midday on July 12, 2021, he had last taken drugs at 6am. 'When the incident took place, I was in my sober senses,' he said. During re-examination by state prosecutor advocate Thabani Buthelezi, the witness said his drug addiction had been arrested three or four years ago when he went into rehabilitation. As he was continuing to explain, Judge Mluleki Chithi interjected, stating that the addiction issue was not relevant to the court. 'Was he under the influence of drugs at the relevant time? That is the question,' he said. Judge Chithi interjected often, telling the witness to answer the questions that had been asked instead of talking about his life experiences or giving the court unnecessary answers. Additionally, the witness told the court that during the incident, he had a clear view. Buthelezi asked the witness if he knew where the person seen in a video of the incident got the cloth that was put in the petrol tank of the victim's taxi. The witness said this was done by two people and one was wearing a bulletproof vest. When the taxi did not burn as anticipated, Gopal and his brother then made attempts to burn it. 'You told us here in court that the people who burnt the taxi were accused, two (Gopal and his brother). Why did you not tell us about this?' Judge Chithi asked. The witness replied by saying he thought it was not relevant to mention this, 'because the taxi did not do what it was meant to do'. The witness said Gopal told people to stop filming at that stage, and he together with his brother approached the taxi to set it alight.

Police dismiss social media reports claiming kidnapped Pretoria farmer found dead
The SAPS has dismissed social media rumours claiming that prominent farmer and businessman Jerry Boshoga has been found dead. The Witness reports that Boshoga (46), from Silver Lakes in Pretoria, was kidnapped in Centurion in November last year. His abductors initially demanded R25m in ransom, later lowering the demand to R10m. Since his disappearance, the family has received disturbing videos allegedly showing Boshoga being assaulted and pleading for his life. In one of the videos, Boshoga, clearly injured and with a cloth stuffed in his mouth, is heard appealing to his mother: 'Please pay, pay now so they can release me. It is too bad. I really need you. Please pay everything they want, I am begging you…' In another recording, he begs his wife to ask his father to raise the money. The footage sparked widespread concern and led to a national outcry for his safe return. Yesterday, posts began circulating on social media claiming that Boshoga had been found dead. SAPS has labelled these reports as false and irresponsible. Police spokesperson Brigadier Athlenda Mathe urged the public to refrain from spreading unverified information, saying the investigation is ongoing and at a 'very sensitive stage'. 'The SAPS can confirm that the businessman has not been found alive or deceased. These unverified social media claims are misleading and have caused unnecessary trauma, panic and anxiety to his mother, wife and children.' She confirmed that police remain in close contact with the Boshoga family, who will be informed of any developments first by the investigating team. 4 arrested after double murder in KZN
Police acted quickly to arrest four men in connection with a double murder and house robbery that took place in the Maqumbi area of Maphumulo in KZN on Tuesday. North Coast Courier reports that, according to Maphumulo SAPS, the men, aged between 23 and 30, entered a homestead in the Mzulwini area where they allegedly shot and killed a 33-year-old man and his 32-year-old girlfriend. They also made off with cash and a cellphone belonging to one of the victims. Police were able to trace the men to three different locations and arrested them yesterday. The first two, aged 25 and 30, were found at a local tavern. One of them had an unlicensed shotgun with the serial number removed. The next, aged 27, was later discovered with an unlicensed 9mm pistol and the stolen cellphone and cash. The fourth suspect, a 23-year-old man, was arrested at his home. All four men face two counts of murder and one count of house robbery. The 30-year-old and 27-year-old suspects face additional charges for possession of unlicensed firearms.
