Kerala HC orders interim stay on proceedings against CM in Ernakulam CJM court

The Kerala High Court has ordered an interim stay for three months on further proceedings before the Chief Judicial Magistrate (CJM) Court, Ernakulam, in a petition filed by Ernakulam District Congress Committee (DCC) president Mohammed Shiyas, who sought action against Chief Minister Pinarayi Vijayan. In the petition, Mr. Shiyas sought action against Mr. Vijayan for making a speech 'abetting violence' while referring to agitating Youth Congress activists reportedly coming under attack, mainly from alleged Democratic Youth Federation of India (DYFI) activists during the Nava Kerala Yatra led by Mr. Vijayan in November 2023.
In his petition, Mr. Vijayan had sought a stay on all further proceedings before the CJM Court, pending disposal of the case. In its order issued on Thursday, a Single Bench of Justice V.G. Arun said that there appeared to be prima facie substance in the contention of the counsel of Mr. Vijayan that the CJM exceeded his jurisdiction by entertaining the complaint, since the alleged incident (of violence against the protesters) took place outside the territorial limits of the court.
The contention that the contents of the speech does not attract the offence under Section 109 (that states the punishment for abetment) of the Indian Penal Code is also liable to be considered. Hence, the interim stay on further proceedings for three months in the petition that is pending before the CJM Court, the court added. The case has been posted for hearing on October 14.

Chandigarh: The Directorate of Enforcement (ED), Delhi Zonal Office, on Wednesday claimed to have provisionally attached shares worth Rs 127.33 crore in two immovable properties – Alchemist Hospital and Ojas Hospital – located in Panchkula under the provisions of the Prevention of Money Laundering Act (PMLA), 2002. These properties are beneficially owned by Karan Deep Singh. The attachment forms part of an ongoing money laundering investigation involving M/s Alchemist Group, its directors, promoters, and associated entities, in relation to alleged large-scale fraud and misappropriation of public funds, the ED mentioned in a release. The ED had initiated the investigation into the case based on an FIR initially registered by the Kolkata Police and subsequently by the Central Bureau of Investigation (CBI), and ACB Lucknow under Sections 120-B and 420 of the Indian Penal Code against M/s Alchemist Township Pvt Ltd, M/s Alchemist Infra Realty Pvt Ltd, and promoter/directors of the Alchemist Group, including Kanwar Deep Singh and others. The case pertains to alleged large-scale criminal conspiracy to defraud investors by illegally raising funds through fraudulent collective investment schemes, offering unusually high returns, and/or making false promises of allotting plots, flats, and villas. These tainted proceeds were ultimately used for the acquisition of shares and subsequent construction of Alchemist Hospital and Ojas Hospital. The transactions were deliberately structured to project these assets as legitimate, thereby disguising the proceeds of crime. The shares of Alchemist Hospital and Ojas Hospital are held to the extent of 40.94% and 37.24%, respectively, by M/s Sorus Agritech Pvt Ltd, a company beneficially owned by Karan Deep Singh, son of Kanwar Deep Singh. Earlier in the case, Kanwar Deep Singh was arrested by the ED on Jan 12, 2021. Thereafter, a prosecution complaint was filed by the ED before the Special Court (PMLA), New Delhi, on March 2, 2021. Also, a supplementary prosecution complaint was filed on July 19, 2024. The Enforcement Directorate (ED) has conducted searches at six locations in Hyderabad in connection with a bank-fraud case against the promoters and directors of a company and its associate entities. The ED initiated its investigation on the basis of an FIR registered by the Anti-Corruption Bureau of the CBI in Hyderabad against SEW LSY Highways Limited and others under various sections of the Indian Penal Code and the Prevention of Corruption Act for allegedly siphoning off and diverting loan funds, cheating and criminal misconduct, resulting in the loss of public money, the agency said in a statement. The federal agency's Hyderabad zonal office conducted search operations on Tuesday at six locations in Hyderabad under the provisions of the Prevention of Money Laundering Act (PMLA) in connection with a bank-fraud case against SEW Infrastructure Limited (SIL), Prasad and Company (Project Works) Private Limited (PSPWPL), group companies and their promoters and directors, the statement said. SEW LSY Highways Limited was incorporated as a special purpose vehicle (SPV) for the execution of a concession contract awarded by the Uttar Pradesh State Highway Authority to a consortium of SIL and PSPWPL. SEW LSY Highways Limited was sanctioned a term loan of Rs 1,700 crore by a consortium of 14 banks led by the Punjab National Bank (PNB). SEW LSY Highways Limited awarded the engineering, procurement and construction contracts to SIL and its group entities, which further sub-contracted the work to other entities. The ED's investigation has revealed that a part of the project was sub-contracted to group entity SEW Transport Networks Limited (STNL), which in turn further sub-contracted the same at lesser values to other parties, including PSPWPL, which again sub-contracted the same at lesser rates. As a result of this sub-contracting activity to group entities at lesser rates, SIL and its group entities allegedly diverted and siphoned off the loan funds, the ED has alleged. Further, according to the terms of the loan, the promoters were required to bring in their own contribution. However, the investigation has revealed that as part of the loan, funds were diverted to PSPWPL (30 per cent stakeholder in SEW LSY Highways Limited), which in turn infused the loan funds as promoter's contribution. A total amount of Rs 603.68 crore was disbursed to SEW LSY Highways Limited by the banks for the project, the statement said. "However, the project was not completed and the term loan became non-performing asset, resulting in outstanding amount of Rs 621.78 crore to the banks," the ED said. The agency said the search operations resulted in a seizure of financial documents evidencing suspected diversion of funds as well as property documents with a current market value of around Rs 120 crore in the names of the promoters and their family members. A total of 33 bank accounts belonging to SEW Infrastructure Limited, STNL as well as their directors and family members were frozen during the search operations. Further investigation is under progress, the ED said.

In a major development in the probe in the 26/11 Mumbai terror attacks, the National Investigation Agency (NIA) on Wednesday filed a supplementary chargesheet detailing the role of Pakistani-origin Canadian national Tahawwur Hussain Rana in aiding the deadly assault that left over 170 people dead. The agency said, "Rana was instrumental in facilitating the reconnaissance operations carried out by David Coleman Headley(AFP) According to the chargesheet, Rana played a crucial role in supporting terrorist David Coleman Headley, a Pakistani-American operative linked to Lashkar-e-Taiba, by facilitating his reconnaissance missions across Mumbai. The agency said, "Rana was instrumental in facilitating the reconnaissance operations carried out by David Coleman Headley, a Pakistani-American terrorist linked to Lashkar-e-Taiba." According to the chargesheet, Rana played a critical role in laying the groundwork for the deadly strikes by establishing a corporate front in Mumbai. The NIA claims that Rana set up the Immigrant Law Centre in Mumbai--an office that posed as a legitimate business but lacked any real commercial activity. Despite the absence of genuine operations or revenue, the office remained operational for over two years, serving solely to support Headley's covert activities. This front allegedly enabled Headley to conduct detailed surveillance of multiple high-profile targets across Mumbai in preparation for the attacks, which killed more than 170 people and shocked the nation. Further investigations suggested that Rana was part of a broader criminal conspiracy that began around 2005, involving co-conspirators based in Pakistan. The stated objective of the conspiracy was to wage war against the Government of India by orchestrating large-scale terror incidents designed to destabilize the country's sovereignty, integrity, and internal security. The NIA alleged that Rana's actions were aimed at striking terror among the Indian population and undermining national interests. As a result, multiple charges under the Indian Penal Code and the Unlawful Activities (Prevention) Act have been pressed against him. After years of legal wrangling, Rana was extradited from the United States to India in early 2025. The US Supreme Court had denied his petition in January, clearing the path for his extradition. On April 10, 2025, he was taken into Indian custody under a Non-Bailable Warrant issued by the Special NIA Court in Delhi. His arrest is considered a major breakthrough in the investigation, which continues to uncover new dimensions of the terror conspiracy. According to the NIA, Rana has made several key disclosures during custodial interrogation, leading to fresh investigative leads. To further validate these statements, mutual legal assistance requests have been sent to the United States seeking corroborative evidence and intelligence. The officials close to the investigation believe that the information obtained through these international channels will be crucial in untangling the wider network of conspirators and gathering actionable proof. Rana faced an array of grave charges, including conspiracy to wage war against India, murder, and multiple counts related to terrorism and forgery. The offences include violations of IPC Sections 120B, 121, 302, 468, and 471, as well as Sections 16 and 18 of the UAPA. His extradition followed approval by U.S. authorities and marks a significant milestone in Indo-U.S. counterterrorism cooperation. The NIA has confirmed that the investigation is ongoing, with further charges and supplementary materials expected to be submitted depending on the results of international information exchange and continued interrogation.
