
Submit report on alleged illegal mining near Sri City, high court to Tirupati collector
One Madras Babu moved the high court with a Public Interest Litigation (PIL) petition, contending that the officials failed to prevent rampant illegal mining taking place under the guise of desilting an irrigation canal. The counsel for the petitioner told the high court that the gravel excavated from the canal was being used to fill up a nearby tank. He said that the forest area was getting damaged and alleged that the Sri City management was behind the illegal mining.
The govt pleaders for forest and irrigation submitted that they permitted the IIIT located in Sri City to desilt the canal to prevent waterlogging and flooding of the campus. The mining department submitted that no permission was given for any mining activity.
Considering the arguments on both sides, the HC asked the district collector to submit a report on whether any damage was caused, to what extent, and if any illegal mining was done damaging the environment.

Kochi: High court has held that both the owner and driver of a vehicle have a bounden duty to ensure that the vehicle is in roadworthy condition before putting it on the road. This includes regular maintenance checks, maintaining proper tyre pressure and condition and ensuring that loose parts, such as nuts and bolts on the tyres, are secure. Failure to do so can lead to accidents and injuries, potentially resulting in liability for the resulting damages, the court added. Justice Shoba Annamma Eapen made this ruling while dismissing an appeal by the state police chief and an insurance company challenging a Motor Accidents Claims Tribunal (MACT) order awarding Rs 2.46 lakh as compensation to an elderly woman who suffered serious injuries when a tyre rolled off a police vehicle in motion. The incident occurred at the Edappally Toll bus stop in Ernakulam in 2010. According to the petition, 64-year-old L Rajeswari from Thiruvananthapuram was waiting at the bus stop when the rear left tyre of a police vehicle, driven by K K Rajesh of Koothattukulam, detached while the vehicle was in motion and struck her, causing serious injury. The MACT, Ernakulam, awarded compensation with interest at 8% per annum, prompting the appellants to move HC. The main contention in the appeal was that the tyre detachment was not due to the driver's negligence but rather a mechanical defect, and hence, no liability should attach to the driver. However, the claimant's counsel argued that negligence on the part of the driver and owner in maintaining the vehicle in good condition was evident. Agreeing with the claimant's contention, HC also took note of the assistant motor vehicles inspector's report, which indicated that the wheel bolts were missing, and all wheel bolts were found damaged. HC held that this clearly pointed to a lack of ordinary care and caution on the part of the owner and driver and dismissed the appeal.

Contempt: Kerala HC allows KU syndicate member's discharge plea
Kochi: High court has closed the criminal contempt proceedings initiated against R Rajesh, Kerala University syndicate member and former MLA, over an alleged Facebook post targeting HC judges by allowing his discharge application on the ground of procedural violations. The proceedings stemmed from a Facebook post allegedly made by Rajesh on July 7, which was linked to an ongoing case concerning the suspension of the Kerala University registrar. The post reportedly stated: "It is the goddess of justice who sits in the high court, not a woman holding a saffron flag. " Rajesh argued that the single bench that initiated the contempt proceedings had not followed the mandatory procedure. It was submitted that the bench not only initiated the proceedings but also framed charges and issued notice without first placing the matter before the Chief Justice for assignment to the appropriate bench, as required under Rule 7(2) of the Contempt of Court (Kerala High Court) Rules. He contended that the alleged post should have been placed before a duly constituted bench for a preliminary hearing, which was not done. The bench of Justices V Raja Vijayaraghavan and K V Jayakumar held that the procedure adopted was in clear violation of the rules and allowed Rajesh's discharge application. TNN

Permission for idol installation on Sabarimala temple premises revoked, TDB tells Kerala HC
Kochi: Travancore devaswom board (TDB) has informed high court that the permission granted to a private individual to install a Panchaloha Vigraham (idol) of Lord Ayyappa within the Sabarimala temple premises has been revoked. The report stated that the TDB had granted permission to E K Sahadevan, chairman of Lotus Multispeciality Hospital and IVF Fertility Centre, Erode, to install the idol. It further pointed out that Sahadevan had allegedly circulated pamphlets seeking donations for the idol installation, directing contributions to the account of 'Rotary Freedom India Trust'. In an affidavit filed before HC on Wednesday, the TDB stated that the devaswom commissioner had been directed to initiate legal action against Sahadevan for allegedly collecting funds by misrepresenting facts. Meanwhile, the Sabarimala chief police coordinator submitted a report stating that a criminal case had been registered against Sahadevan by the Pampa police, based on a complaint filed by the TDB on July 31. However, the govt pleader sought additional time to obtain instructions regarding the extent of funds amassed by Sahadevan in connection with the idol installation. Considering the request, the bench of Justices V Raja Vijayaraghavan and K V Jayakumar adjourned the matter to Sept 10.
