High Court strikes out ex-MMM deputy chairman's suit challenging insider trading law
KUALA LUMPUR: The High Court (Special Powers Division) has dismissed a civil suit filed by the former executive deputy chairman of Malaysian Merchant Marine Bhd (MMM), Datuk Ramesh Rajaratnam, against the Securities Commission (SC) and the Government.
In a statement, the SC said Justice Datuk Amarjeet Singh Serjit Singh had ruled that the originating summons filed by Ramesh constituted an abuse of the court process, and awarded costs of RM5,000 each to the SC and the Government.
On Sept 10, 2024, Ramesh commenced a civil suit at the High Court (Special Powers Division) and sought a declaration that section 188(2)(a) of the Capital Markets and Services Act 2007 (CMSA) was contrary to Articles 5(1), 8(1) and (2), 10(1)(a) and 13 of the Federal Constitution and therefore null, void, and of no effect immediately.
In response, the SC filed an application on Oct 8, 2024 to strike out the civil suit on the grounds that it was barred by res judicata, constituted an abuse of process, and represented a collateral attack on Ramesh's criminal conviction by the Sessions Court and his ongoing criminal appeal before the High Court.
Ramesh was previously charged at the Kuala Lumpur Sessions Court on Oct 29, 2015 with three charges of insider trading under section 188(2)(a) of the CMSA.
He was convicted following a full trial and was sentenced to five years imprisonment and a fine of RM3mil (in default three years imprisonment) for each charge.
In relation to the appeal to the High Court, Ramesh's conviction and sentence on all three charges were set aside on the grounds of judicial copying by the trial judge.
The Court of Appeal subsequently reinstated his conviction and sentence for the first charge upon the Public Prosecutor's appeal and remitted the case to the High Court for the case to be heard on its merits. The appeal on merits is pending hearing before the High Court.

Mobile app to streamline fuel subsidy distribution for fishermen
BACHOK: The government is developing a mobile application to facilitate the distribution of subsidised fuel to fishermen nationwide, said Malaysian Fisheries Development Authority (LKIM) chairman Muhammad Faiz Fadzil. He said the app, which is expected to be operational by the end of this year, will replace the personal digital assistant (PDA) devices currently in use. "At present, fishermen rely on PDAs to obtain fuel subsidies, but these devices are outdated and frequently malfunction. "With the new app, the process will be much simpler, allowing eligibility checks and fuel quota details to be accessed directly via mobile phones," he told reporters after officiating the LKIM Rahmah Mesra Programme with Bachok fishermen at the Portable Container System (PCS) site in Pantai Baru Bachok here today. He said the app will also enable real-time monitoring and auditing, helping to curb any potential misappropriation. "Through this app, we will be able to monitor fishermen's performance, including the declaration of their catch. "So far, nearly 40,000 fishermen nationwide are eligible for fuel subsidies, with the amount depending on the type of boat used," he added. On the PCS facility, Muhammad Faiz said the initiative has resolved difficulties faced by fishermen in accessing fuel supplies. "To date, seven PCS units are operational nationwide. We also plan to set up another in Perlis, one in Terengganu, and three in Sabah in the near future," he said. Meanwhile, Muhammad Faiz said LKIM is committed to enhancing youth participation in the fisheries sector to ensure its long-term sustainability. He said only 30 per cent of the 112,000 registered fishermen nationwide are under the age of 40 - a figure that needs to be improved. "LKIM plans to launch a programme to produce local young boat skippers soon, as the industry currently depends heavily on skippers from Thailand. "With modern fishing equipment and support systems, I believe today's tech-savvy youth can be drawn to the sector," he said. Earlier, he presented mock cheques worth a total of RM250,000 to five recipients under the Young Agropreneur Programme for the purchase of boat engines, as part of efforts to support youth involvement in the sector. – Bernama

Police investigate mastermind behind alleged haj package scam
KUALA LUMPUR: Police are in the process of identifying those responsible for an alleged haj package scam involving a group of elderly pilgrims who claimed they were confined against their will and forced to walk through dangerous routes in Saudia Arabia. Bukit Aman Commercial Crime Investigation Department acting director Datuk Seri Muhammed Hasbullah Ali said an investigation paper had been opened under Section 420 of the Penal Code following three reports lodged by the victim's next of kin, two in Mantin, Negeri Sembilan and one in Ayer Hitam, Johor. "It is too early to confirm a cross-border fraud. We are gathering statements and evidence to determine whether the syndicate is operating with certain agents or not. "We are waiting for the victims to return to record their statements and take further action," he said in a statement on Sunday (June 15). Muhammed Hasbullah said the police would also work with the Companies Commission of Malaysia, Lembaga Tabung Haji and the Tourism, Arts, and Culture Ministry to blacklist companies offering haj packages without approval, stressing that they are committed to taking firm action against those involved in such scams to protect the people from becoming victims. At the same time, Muhammed Hasbullah expressed his appreciation for the media's cooperation in helping to disseminate information and raise public awareness that only individuals with an official haj visa are to perform the pilgrimage. On Saturday (June 14), a media report cited that 47 Malaysian pilgrims had allegedly fallen victim to a haj scam by a local agent involving a well-known religious figure. The daughter of one of the victims, who claimed that her parents and aunt, who left for Saudi Arabia with the agent on May 9, were forced to trek through dangerous routes from Jeddah to Makkah without proper documents, food, or water, allegedly to avoid detection by Saudi authorities.
