B.C. doctor acquitted of sexual assault charge

Dr. Olumuyiwa Bamgbade, who specializes in pain management, was acquitted of one count of sexual assault last week after a judge-alone trial in Surrey provincial court. The patient, whose identity is protected by a publication ban, alleged Bamgbade 'kissed her and touched her breasts' during an appointment in July 2022, the judge's decision said. At the time, Bamgbade was prohibited from treating female patients without a 'chaperone' approved by the B.C. College of Physicians and Surgeons, the court heard. However, the patient testified she was alone with the doctor when the alleged assault occurred. Part of Bamgbade's defence was that the patient's allegations were false, fabricated because she was 'engaged in drug seeking behaviour' and the doctor had 'refused to prescribe additional medications,' according to the decision. The judge found there was insufficient evidence to support this claim. Overall, the judge found the allegation was not proven beyond a reasonable doubt. Specifically, the judge concluded the assault could not have unfolded as alleged because 'the account of the touching and kissing is incompatible with the lay out in the room where she spent time alone with Dr. Bamgbade.' Ultimately, the judge found the patient's testimony had 'material inconsistencies and improbabilities,' and lacked reliability. 'As a result, I am left with a reasonable doubt that Dr. Bamgbade committed this offence. I find Dr. Bamgbade not guilty,' the decision concluded. In a separate case involving a female patient from 2019, Bambgade was charged with one count of sexual assault and one count of administering a stupefying drug. The trial on those charges is ongoing, according to the B.C. Prosecution Service.

B.C. lawsuit accuses Buddhist monk of abusing boy after mother granted guardianship

Supreme Court alleges a boy who was placed in the care of a Buddhist monk was subjected to years of abuse while living at a Vancouver temple. The lawsuit that seeks damages says the child was six when their mother, a Vietnamese refugee, assigned legal guardianship to the defendant monk and the boy was sent to live at the Chan Quang Temple in East Vancouver in 2003. The notice of civil claim filed last week says the monk allegedly subjected the child to 'polytraumatic abuse,' including burning him with boiling water, striking him with percussion mallet, whipping him with sticks and force-feeding the child until the point of sickness with salt, soy sauce and blueberries. It says the child was hospitalized after the defendant monk allegedly stomped on his abdomen and ruptured his stomach, but the plaintiff claims he was 'coached' to blame the injury on his brother, who also lived at the temple as a novice monk. The lawsuit says that after the boy was hospitalized for three weeks in 2005 he was placed into foster care and a police investigation began, but there were no charges because the boy protected the monk and the temple 'as he was groomed to do.' The allegations have not been tested in court and neither the monk nor the temple have filed responses to the claim, while calls to the temple went unanswered. The lawsuit dated Aug. 13 says the boy was sent back to his mother after foster care. The legal action seeks damages against the monk for assault, battery and intentional infliction of emotional distress, and against the society that runs the temple for allegedly failing to report the monk's 'abusive propensities.' 1 killed, 4 taken to hospital in weekend crash near northern B.C. waterfall
A 28-year-old woman is dead after a weekend crash along Highway 97 near Bijoux Falls, B.C., police say. The RCMP's B.C. Highway Patrol says the incident happened Saturday at around 1:45 p.m. PT when two trucks collided with each other near the rest stop and roadside attraction, about 187 kilometres north of Prince George. Four other people were taken to hospital. Police say the collision involved a black Dodge Ram 3500 pickup towing a flag deck trailer, and a black Ford Bronco. A passenger in the Ford Bronco was killed, while the driver and another passenger in the Bronco were hospitalized, as were the driver and a passenger of the Ram. A witness to the aftermath of the crash, who helped provide first aid until ambulances arrived, told CBC News there was an injured cat laying on the road, as well. The highway was closed to traffic in both directions as cleanup and investigation took place, and did not fully reopen until the next morning. "Police are very interested in how these vehicles were driving in the minutes leading up to the collision, and we're looking for more witnesses," Cpl. Michael McLaughlin said in a written release. "If you have dash camera footage that's also crucial."
