
Google's antitrust suit: SC admits cross appeals
Google Inc and its related companies—Alphabet Inc, Google Ireland, Google India, Google India Digital Services—and others have challenged the March 28 judgment by the NCLAT, which largely affirmed the CCI's core findings that Google abused its dominant position in multiple markets in the Android mobile device ecosystem through its Play Store policies and engaged in unfair promotion of Google Pay, thereby violating Section 4(2)(e) of the Competition Act. The tech companies have also challenged the NCLAT's May 1 order that corrected its "inadvertent error" in its original judgment, reinstating CCI's two key data-related directives, which require the tech giant to disclose its data policies and refrain from leveraging billing data for competitive advantage.
The CCI's October 2020 order had penalised Google for allegedly exploiting its dominant position in markets such as online search and the Android app store. The competition watchdog had imposed a penalty of Rs 936 crore against the tech giant and its companies for engaging in anti-competitive behaviour by mandating the use of its Google Play Billing System for app purchases, while exempting its own applications like YouTube from similar commission structures. The antitrust body had also directed Google to cease these practices, including allowing third-party billing and ensuring data transparency. While the appellate tribunal affirmed the CCI's s order that Google imposed unfair and discriminatory conditions on app developers through mandatory use of Google Play billing system for paid apps and in-app purchases, it set aside the competition watchdog's findings regarding denial of market access and restriction of innovation on the grounds that Google's billing services constituted less than 1% of total UPI transactions and that there was insufficient evidence of market foreclosure or hindrance to technical development.The original penalty of Rs 936.44 crore was also reduced by the NCLAT to Rs 216.69 crore by limiting it to Play Store-specific revenues rather than Google's global turnover. The appellate tribunal also rejected some findings of the antitrust body's order, which the CCI has challenged now in the SC.Indian startups, including People Interactive India (operator of Shaadi. com), Mebigo Labs (owner of Kuku FM), the Indian Broadcasting and Digital Foundation, and the Indian Digital Media Industry Foundation, had moved the CCI seeking a probe into Google's functioning.

Obedullaganj: In a landmark move to bolster indigenous rail infrastructure and manufacturing, Defence Minister Rajnath Singh on Sunday laid the foundation stone of the 'Bramha' BEML Rail Hub for Manufacturing in Umaria village of Raisen district, Madhya Pradesh. The state-of-the-art facility, to be developed by Bharat Earth Movers Limited (BEML) with an investment of Rs 1,800 crore, is poised to become a cornerstone of India's self-reliant rail production ecosystem. Speaking at the ceremony, the Defence Minister hailed the initiative as a symbol of India's growing industrial prowess and praised Madhya Pradesh's emergence as a promising hub for defence and infrastructure manufacturing. 'The state has political will, stable leadership, and abundant resources. With 48,000 hectares earmarked for new investments, MP is on its way to becoming a 'Modern State',' he said. The new unit -- named after Lord Brahma, the creator of the known Universe in Hindu mythology -- will manufacture coaches for Vande Bharat, Amrit Bharat, metro trains, and future high-speed rail systems, including bullet trains. It will also produce other railway components, with export-ready broad and standard gauge coaches. The plant will initially produce 200 coaches annually, scaling up to 1,100 units over time. Railway Minister Ashwini Vaishnaw, also present at the event, noted that BEML has already delivered over 2,100 metro coaches and is actively developing high-speed train prototypes in collaboration with the Integral Coach Factory (ICF). 'The Umaria unit will generate at least 5,000 jobs and play a pivotal role by offloading jobs to MSMEs in meeting Indian Railways' target,' he said. Chief Minister Dr Mohan Yadav described the project as a proud moment for the state and a direct reflection of Prime Minister Narendra Modi's 'Make in India' vision. 'For the first time, Madhya Pradesh will manufacture and supply train and metro coaches across the country and the world,' he said. Union Agriculture Minister Shivraj Singh Chouhan spoke about Operation Sindoor on the occasion. Spanning 148 acres in Goharganj tehsil near Obedullaganj, the facility will incorporate cutting-edge technologies, including robotic welding, lean manufacturing, and solar-powered energy systems. It will require 2,000 MVA of power, to be met through renewable sources. BEML Chairman Shantanu Roy confirmed that the first coach is expected to roll out within 18 months. The plant's strategic location is expected to catalyse regional development, with ancillary industries in Raisen and Bhopal districts supplying bogies, interiors, air-conditioning systems, and other components. A dedicated rail coach technology institute is also under consideration to support skill development and technical training. BEML's expansion into Raisen marks a strategic convergence of defence-grade engineering and civilian infrastructure needs. The unit will complement its existing hubs in Bengaluru, Palakkad, and Kolar Gold Fields, and significantly enhance India's rail export capabilities.

Marico aims double-digit growth in India biz from next quarter: Saugata Gupta, MD
Home-grown FMCG maker Marico expects to deliver double-digit growth in the next one or two quarters in the domestic market, helped by its core franchises and expansion of new businesses, its Managing Director and Chief Executive Officer Saugata Gupta company, which reported a 9 per cent rise in domestic volumes, now aims for a revenue growth of around 25 per cent this year, led by pricing actions, Gupta told PTI."As far as overall revenue is concerned, we should be able to deliver in the mid-20s to around 25 per cent this year, given the pricing initiation," he which owns brands like Saffola, Parachute, and Livon, has "consistently improved volumes in sequential terms, Gupta added."This (June) quarter, India Volume growth was up 9 per cent. This year, we also expect the tax break (Income Tax benefits) to have a positive impact. In FY25, Marico has crossed the milestone of becoming a Rs 10,000 crore revenue company, and now, it targets to be a Rs 20,000 crore company by 2030 by growing its revenue two-fold over the next five years.

Govt to review petrol pump licensing norms
New Delhi: The government is considering further easing the norms for setting up petrol pumps in the world's fastest-growing fuel market, in light of the evolving energy security paradigm and commitment to decarbonisation , according to an official order. The government had in 2019 relaxed the norms for setting up petrol pumps, opening the door for non-oil companies to enter the fuel retailing business. At that time, companies with a net worth of Rs 250 crore were permitted to sell petrol and diesel, provided they committed to setting up infrastructure for at least one new-generation alternative fuel, such as CNG, LNG, biofuels, or EV charging, within three years of beginning their operations. For companies wanting to sell petrol and diesel to retail and bulk consumers, the networth criteria was set at Rs 500 crore. The Ministry of Petroleum and Natural Gas has now constituted an expert committee to review the 2019 guidelines for granting authorisation to market transportation fuels. The expert committee will "assess the effectiveness of the framework envisaged in Resolution dated November 8, 2019, in ensuring energy security and market efficiency; align the policy framework with national commitment towards decarbonisation, electrical mobility and promotion of alternative fuel; and address issues in implementation of existing guidelines," the order said. The committee is headed by Sukhmal Jain, former director (marketing) of Bharat Petroleum Corporation Ltd (BPCL). Other members of the four-member committee are Petroleum Planning and Analysis Cell (PPAC) Director General P Manoj Kumar, FIPI member PS Ravi and Arun Kumar, Director (Marketing) in the ministry. An August 6 notice of the ministry sought stakeholder/general public comments/suggestions on the matter within 14 days. Prior to the 2019 change, to obtain a fuel retailing license in India, a company had to invest or commit to invest Rs 2,000 crore in either hydrocarbon exploration and production, refining, pipelines or liquefied natural gas (LNG) terminals. This norm was relaxed in 2019. That year, the government allowed any entity with a net worth of Rs 250 crore to get a licence to retail petrol and diesel to either bulk or retail consumers. For those seeking authorisation for both retail and bulk, the minimum networth was set at Rs 500 crore at the time of application. For retail authorisation, the entities are required to set up at least 100 retail outlets. Also, retailers are required to establish 5 per cent of the total outlets in rural areas within five years. Global energy giants have been eyeing the Indian fuel market for a long time. French energy giant TotalEnergies, in partnership with Adani Group, had in November 2018 applied for a licence to retail petrol and diesel through 1,500 outlets. BP too has formed a partnership with Reliance Industries to set up petrol pumps. While oil trader Trafigura's downstream arm, Puma Energy, had applied for a license, Saudi Arabia's Aramco has been in talks to enter the sector. State-owned oil marketing companies Indian Oil Corp (IOC), Bharat Petroleum Corp Ltd (BPCL) and Hindustan Petroleum Corp Ltd (HPCL) currently own most of the 97,804 petrol pumps in the country. Reliance Industries, Nayara Energy (formerly Essar Oil), and Royal Dutch Shell are the private players in the market, but with limited presence. The joint venture of Reliance, which operates the world's largest oil refining complex, and BP has 1,991 outlets. Nayara has 6,763 pumps, while Shell has just 355. Currently, IOC is the market leader with 40,666 petrol pumps in the country, followed by BPCL with 23,959 outlets, and HPL with 23,901 fuel stations.
