ITAT lawyers' body flags high case pendency in Delhi benches, urges action

The Delhi branch of the Income Tax Appellate Tribunal (ITAT) Bar Association has raised serious concerns over an increasing backlog of cases at the tribunal's Delhi benches, in a letter to the ITAT president, highlighting a deteriorating judicial environment marked by frequent adjournments. 'There is an unprecedented increase in instances where even the binding judgments of the Delhi High Court are not being followed, leading to dissent among members resulting in prolonged pendency of matters for months,' the association said in an April 25 communiqué to the president of the ITAT, reviewed by Business Standard. Delhi has the 'highest pendency' of cases among ITAT Benches, the association claimed. 'It is pertinent to note that Delhi Benches of the tribunal have the highest pendency and many of these matters involve complex legal issues and significant revenue stakes. It is therefore of utmost importance that members with experience, balanced disposition and judicial temperament be posted here, so that the ends of justice are met in a fair, equitable and unbiased manner,' the letter said. An email sent to the Central Board of Direct Taxes (CBDT) and the Law Ministry, seeking a response on the letter and the rising pendency of cases, remained unanswered till the time of press. According to a written response by Finance Minister Nirmala Sitharaman in the Rajya Sabha on March 18, IT appellate tribunals have a pendency of 23,175 direct tax cases entailing Rs. 6.7 trillion in dispute. There are a total of 63 ITAT Benches across India of which nine are present in the National Capital. The letter also flags concerns over the quality of orders being passed, stating that proceedings in several matters are conducted in a casual manner, falling short of the traditionally high standards of the tribunal. 'Despite having raised these concerns informally on multiple occasions, no effective resolution appears to have emerged. Consequently, if no perceptible solution is found, the Bar would be constrained to lodge a symbolic protest by wearing black bands, which could eventually lead to boycott of Benches,' the Bar warned in the letter. The association, in the letter, urged the ITAT president to review objective data — such as disposal rates, dissent trends, and time taken to pass orders — as evidence of the pressing issues before the Delhi Benches. The Bar association also flagged 'an element of bias is palpably discernible' in some cases, causing repeated delays, and questioned a recent appointment. 'We also wish to state that a member who has had serious differences with every Bar association at prior postings has now been posted to Delhi — despite belonging to Delhi — in direct contravention of the binding decision of the Supreme Court in the case of Ajay Gandhi vs. B. Singh, 265 ITR 451, which clearly laid down that members should not be posted to where they have practiced or have personal connections,' the letter stated.

The Federal Operations Unit, Zone C in Owerri at the weekend announced the seizure of N1,010,113,880.00 worth of contraband which included 78 Jerry Cans of 25 litre of Crude Oil, 102 bottles of 75 litres of Diesel, 80 Jerry cans of 25 litres of Premium Motor Spirit (PMS) amongst others in the South Eastern part of the country in the last one month. In a statement released by the Unit at the weekend, the Unit added that N13,451,848 was generated from Demand Notices (DN) within the period under review. During his first press briefing at the unit's headquarters in Owerri, the Customs Area Controller of the Unit, Comptroller Bishir Abdullahi Balogun stated that no matter the intentions of smugglers and their patronizers, the unit will not relent in carrying out its statutory functions which are backed up with intelligence-driven strategies by the Comptroller General of Nigeria Customs Service Bashir Adewale Adeniyi. The new Controller, while frowning at smuggling, stated that it is economic sabotage to bring in prohibited goods into the country which has negative impact on local industries, and affects the well-being of individuals. Notable among the seizures made by the Unit include: 725 Bales of second-hand used clothing; 2762 Rolls of Satin Fabrics of 60 yards; 2589 used tyres; 233 Sacks of 2Kg foreign Rice; 181 Rolls of Wall Covering; 102 Bottles of 75Cl Diesel; 8 Jerry cans of 25L of PMS; 78 Jerry cans of 25L Crude Oil; 32 New Tyres; 25 Bales of Cannabis Sativa; 24 Bottles of 150Cl of Diesel; 14 Bags of 50kg foreign rice; 3 Carton of Bedwine; one sack of used shoes; one Scannia Container Body truck with Registration number T 281 A2LA; one Mercedes Truck with Registration number NKE 323 XE; amongst others. The Controller of the unit while Commending officers/men of the unit during the briefing anchored his successes to focus, diligence, professionalism, and decision to contribute his quota to national economy, by blocking all revenue leakages, enforcement of trade facilitation and taking charge of the nation's entry points which is of uttermost importance to the unit. In continuation, he reiterated that the unit must work together to support the administration of President Bola Ahmed Tinubu (GCFR) and the CGC BA Adeniyi (MFR) to succeed. He also called on traders and stakeholders to be compliant, as our officers are professionally trained to checkmate the activities of non-compliant traders and block likely areas of revenue leakages. In our inter-agency collaboration, the seized cannabis sativa shall be handed over to NDLEA. These timely successes and achievements are a result of the purposeful leadership of the Comptroller General of Customs, high-level of professionalism, commitment, and teamwork. He further added that the unit is also determined to sanitize the zone of any form of un-customs activities and facilitate legitimate is committed to the consolidation of successes achieved, collaborative engagement with critical stakeholders, and innovative ideas in its dealings to ensure efficiency and effectiveness in customs operations. The Controller used the medium to thank the sagacious CGC and his entire management team for their dynamic leadership styles and qualities. SALT LAKE CITY () — The Utah legislature and the judiciary have come to an agreement about several controversial bills, including several that were the in the state. Bills that proposed changes to judicial retention and judicial elections will no longer be considered. Senate President J. Stuart Adams and Speaker Mike Schultz released a statement on Monday afternoon about the decision. 'Through deliberate debate, thoughtful conversations and in a spirit of collaboration, the Legislature and the Judiciary have found a path forward that will make our government stronger and our state better,' the statement reads. Legal professionals protest against bills that seek to reshape Utah's judicial branch The following bills will no longer proceed: H.B. 512, 'Judicial Retention Changes' H.B. 451, 'Judicial Election Amendments' Unnumbered 'Judicial Officer Modifications' H.B. 512 would have set up the 'Joint Legislative Committee on Judicial Performance.' The bill would have directed the Lt. Governor's office to put 'any retention recommendation from the (committee) for a judge or justice who is listed on the ballot.' H.B. 451 would have raised the threshold for a judge to be retained. According to the language in the bill, it proposed requiring judges to receive at least 67% of the vote to retain their office. 'Judicial Officer Modifications' would have increased the number of justices. The following bills/resolutions will still be considered: S.B. 203, 'Judicial Standing Amendments' S.B. 204, 'Right to Appeal Amendments' S.J.R. 9, 'Joint Resolution Amending Rules of Civil Procedure on Injunctions' S.B. 203 looks to (people different from the plaintiff) and add requirements for when an association can bring a case on behalf of its members. Critics argue this would make it harder for 'everyday Utahns' to challenge laws. S.B. 204 would allow defendants to appeal an injunction when a trial court rules that a law must be paused or not enacted because it's potentially unconstitutional. Sen. Brady Brammer (R – Pleasant Grove) has previously told this proposal aims to address the 'overuse' of injunctions in lower courts, particularly on laws passed by the legislature and signed by the governor. S.J.R. 009 would put a 28-day stipulation on parties challenging potentially unconstitutional laws and seeking an injunction. They would need to do so within 28 days from the time the legislature adjourns. The Judicial Council (the governing body for the Utah Judiciary) said it will remain neutral on S.B. 296, which would allow vacancies in the high court and court of appeals to be filled by appointment of the Governor and confirmation by the Senate. 'The Utah Constitution wisely created three independent branches of government,' Chief Justice Durrant, presiding officer of the Judicial Council, said in a statement. 'At times, there is tension, but that will not prevent the Judiciary and the Legislature from working together to serve the people of Utah.' Lindsay Aerts contributed to this report.
