Committee completes Syariah law study, submits findings to Rulers

KUALA LUMPUR: The Special Committee studying the competence of state legislative assemblies to enact Syariah laws has completed its report. Minister in the Prime Minister's Department (Religious Affairs), Datuk Dr Mohd Naim Mokhtar, said the findings of the study were presented at a meeting of the National Council for Islamic Religious Affairs Malaysia (MKI) and the Conference of Rulers. "The Special Committee was appointed for a one-year term and has completed its report based on studies, analyses, discussions, and engagement sessions with various stakeholders, including state chief Syariah judges, muftis, state Islamic religious councils, representatives from Islamic institutions, former judges and representatives from other religions. "The findings of the study were presented at the 73rd MKI Meeting on July 1 and at the 269th Conference of Rulers held on July 16," he said in a written parliamentary reply. He was responding to Datuk Seri Takiyuddin Hassan (PN-Kota Bharu), who asked about the current status of the study and whether the government plans to table the report in Parliament. Naim said the recommendations in the report would be thoroughly examined by the government before any further action is taken, including whether there is a need to propose legal amendments to be tabled in Parliament. "This is to ensure that any amendments to laws especially those involving the jurisdiction between the Federal and state governments are clear, orderly, and aligned with the provisions of the Federal Constitution, other prevailing laws, and Islamic law (Hukum Syarak), so that they are valid and not challenged by any party upon enforcement," he said. He added that recommendations by the special committee involving matters under federal jurisdiction would be submitted to the cabinet for consideration and approval. As for recommendations involving amendments to state laws related to Islamic religious administration or state Syariah court laws, these would be subject to the consent of the respective states. Last year, the 11-member Special Committee was set up following a decree from the Sultan of Selangor during the 70th MKI meeting.
