‘A Kuwaiti Citizen will get rent allowance'

KUWAIT CITY, May 10: The Court of First Instance has ordered the State Ministry of Housing to retroactively and continuously reimburse a rent allowance of KD11,300 to a citizen who previously replaced and waived his housing application multiple times. In a landmark ruling, the court clarified that the criterion for suspending the rent allowance is not merely the allocation of a housing plot, but rather the completion of the construction period or the connection of electricity. Details of a lawsuit filed by Attorney Abdul Mohsen Al-Qattan indicated that the plaintiff was allocated a new plot in Al-Mutlaa on May 4, 2023. However, as construction had not yet been completed and electricity was not connected (conditions required for halting the rent allowance ), he remained entitled to receive the allowance. The administrative authority's decision to stop the payments and demand repayment for that period was deemed erroneous. The court ruled that the ministry must return the deducted amount and resume payment, as the plaintiff submitted a new housing application and had not yet benefited from the allocated plot. The judgment further stated that rent allowances must be reinstated for all individuals whose payments were previously suspended due to substitution or waiver of alternative housing, starting from the month following the implementation of the relevant regulation.

Kuwaiti Man acquitted of insulting Mother-In-Law

KUWAIT CITY, April 5: The Appeals Court upheld the decision of a lower court to acquit a Kuwaiti citizen of insulting his mother-in-law. According to the case file, the defendant's mother-in-law filed a complaint alleging that he verbally abused her. This was after the mother-in-law, her daughter, and other witnesses were referred to the police station following a complaint filed by the defendant against his wife when he saw her with a stranger on the street. They then followed his wife to her mother's house, quickly entering it. The citizen's lawyer, Attorney Abdul Mohsen Al-Qattan, appeared in court to defend him and argued that there was no conclusive evidence to support the accusation against his client. He pointed out that the case documents, the subject of the accusation, are devoid of evidence with legal merit. Al-Qattan said the Public Prosecution presented evidence to prove the charge against his client, 'which consisted of the complainant's allegations that were not without malice and fabrication.' He stressed that his client denied all the accusations hurled at him and that he neither insulted nor defamed the complainant Al-Seyassah/Arab Times Staff

Kuwaiti Man Sentenced to 12 Years for Attacking Officer with Katana

KUWAIT CITY, Feb 16: The Criminal Court has sentenced a Kuwaiti citizen to 12 years in prison after finding him guilty of assaulting a security officer, severely injuring him with a Katana (Japanese sword), and illegally possessing narcotics and firearms, including a Kalashnikov rifle, pistols, and ammunition. The attack resulted in the officer sustaining deep cuts to four tendons in his hand. The plaintiff's lawyer, Abdul Mohsen Al-Qattan, who represented the injured security officer in the civil case, demanded compensation of 5,001 Kuwaiti dinars. He argued that the crime met the legal criteria for attempted murder. According to the Public Prosecution, the defendant deliberately attempted to kill a first sergeant in the Ministry of Interior. He initially tried to grab a loaded pistol from the officer's desk, but members of the investigation squad intervened, preventing him from obtaining the weapon. Frustrated, the accused then reached for a sword mounted on the wall behind the desk, declaring, "Today, I am either a slaughterer or the slaughtered." He then attacked the officer, inflicting multiple injuries with the clear intent to kill. However, he failed to complete the act due to the intervention of other security personnel. The prosecution also charged him with possession of the narcotic substance hashish.
