Impaired driving suspect who allegedly fled traffic stop before crashing into parked cars working on bail plan, lawyer says
The drunk driving suspect accused of fleeing a traffic stop while on bail in connection with a fatal crash will remain behind bars until at least the beginning of September. Article content Defence counsel Alain Hepner appeared in Calgary Court of Justice on Monday and asked that Kane Anignostis Burrows' case be adjourned to Sept. 3. Article content Article content Hepner told Justice Sean Dunnigan his is working on a potential bail release plan for his client and will keep assigned Crown prosecutor Greg Piper up to date on any progress in the interim. Article content Article content 'He's in custody, he's detained, I'm not making a judicial release application just yet,' Hepner told Dunnigan, in asking that his client's appearance in court be waived. Article content Article content Burrows, 19, faces charges of impaired driving, having an unlawful amount of alcohol in his system and two breaches of release conditions in connection with an incident in the early morning hours of Aug. 8. Article content He was arrested after police say a BMW M5 fled a traffic stop before heading northbound on Macleod Trail at a high rate of speed. Article content 'It is believed the driver attempted to turn westbound onto 58th Avenue S.W. while fleeing a traffic stop,' Calgary police said in a release. 'The BMW then struck the rear of a parked vehicle, causing a chain reaction that damaged seven parked vehicles.' Article content The Crown has given notice it will seek to have Burrows' bail revoked on charges he was facing at the time of his latest arrest. Article content He is set to face a preliminary inquiry in November, on six charges, including impaired driving causing death in connection with a crash last Dec. 23, on Glenmore Trail S.W. Article content According to a police news release, the driver of a 2018 BMW M240i lost control on a bend in the road and entered the right shoulder of the eastbound lanes and struck a stationary crane. OTTAWA — Actions by Liberal campaign workers caught in a party-sanctioned disinformation campaign could meet the threshold for charges, lawyers told The Toronto Sun. Litigators interviewed by the Toronto Sun say the scheme — which involved planting hyper-partisan buttons at a conservative convention in Ottawa last week — could meet the threshold of offences under the Criminal Code and Canada Elections Act. However, it's unlikely authorities would act, said Calgary-based criminal lawyer Alain Hepner. 'I don't see the Crown being interested in proceeding under the Criminal Code,' Hepner said. 'I think all Crown prosecutors across Canada have enough on their plate, and have bigger fish to fry.' Aside from the Criminal Code offence of mischief, those responsible could potentially run afoul of the Canada Elections Act. Sec. 481 of the Act specifically prohibits distributing or transmitting '…any material, regardless of its form' that purports to be made, distributed, transmitted or published by or under the authority of the Chief Electoral Officer, or a returning officer, political party, candidate or prospective candidate. Hepner said that if charges were laid, prosecution would like take place under the Canada Elections Act. But Hepner stressed he'd be shocked if any charges were laid.
