This Bay Area city is the first in California to allow sale of ADUs as condos

San Jose approved the state's first backyard accessory dwelling unit to be sold as a condominium on Thursday, creating a new path to affordable homeownership. The property, on Joséfa Street near downtown, can now be sold separately from the main house. The sale was made possible by AB 1033, a state law that took effect in 2024, allowing cities to let homeowners sell ADUs as condos. San Jose was the first large city to adopt the law in July 2024. 'San José is creating housing affordability and ownership by thinking differently,' Mayor Matt Mahan said in a statement. 'ADUs are affordable by design and growing in popularity across the state, and now they can offer the most accessible form of home ownership, too. We are offering a proof of concept for California and hope that other cities follow San José's lead.' AlphaX RE Capital, a Bay Area real estate firm, developed the unit and plans to build dozens more. 'With San José leading the way under AB1033, we can offer homeownership at more attainable price points, giving families the opportunity to build equity and long-term stability,' said AlphaX founder and CEO Stephanie Yi. City officials saaid the change will help both homeowners and buyers. Owners can sell ADUs to generate income, while buyers can enter the housing market at lower prices than traditional single-family homes. Since 2022, San Jose has permitted 1,500 ADUs and issued final building permits for more than 1,100, according to city data. 'We are honored to lead the state in this effort and, most importantly, serve our community with more housing opportunities,' City Manager Jennifer Maguire said in a statement.
