The offence took place at an apartment in Taman Ukay Perdana at 8.10am on June 20. He was charged under Section 509 of the Penal Code, which provides for a maximum sentence of five years' imprisonment, a fine, or both. According to the statement of facts, the victim noticed a flashing light on a bathroom shelf while showering and discovered a concealed recording device, which he suspected had been planted by his housemate. However, deputy public prosecutor Norhidayah Abdullah Sani urged the court to impose a deterrent sentence, citing the seriousness of the offence and the need to send a clear message to both the accused and the public. National Legal Aid Foundation lawyer Mohd Azizi Darus pleaded for leniency as Fahmi supports his family on a RM2,500 monthly pay.
