An accountant was fined RM3,300 by the Ampang Magistrates' Court after pleading guilty to secretly recording his male housemate while the latter was showering last week.
KUALA LUMPUR - An accountant was fined RM3,300 by the Ampang Magistrates' Court today after pleading guilty to secretly recording his male housemate while the latter was showering last week.
Magistrate Amalina Basirah Md Top imposed the sentence on Muhammad Fahmi Akmal Zakaria, 30, and further ordered that he serve five months' imprisonment in default of payment. The accused settled the fine.
Muhammad Fahmi was charged with intending to insult the modesty of a 31-year-old man by recording him while he was showering, with the purpose of violating his privacy and decency. The offence took place at an apartment in Taman Ukay Perdana at 8.10am on June 20.
He was charged under Section 509 of the Penal Code, which provides for a maximum sentence of five years' imprisonment, a fine, or both.
According to the statement of facts, the victim noticed a flashing light on a bathroom shelf while showering and discovered a concealed recording device, which he suspected had been planted by his housemate.
The victim retrieved the accused's laptop and USB cable and discovered that the hidden recording device contained a memory card with a video of him showering.
The accused was arrested on June 20, and his recording device, mobile phone and laptop were seized. Investigations confirmed that he had recorded the victim showering.
Earlier, counsel Mohd Azizi Darus from the National Legal Aid Foundation appealed for a minimal fine, submitting that the accused earns only RM2,500 per month and is financially responsible for his family.
He further submitted that his client claimed the act was intended as a joke between housemates.
However, deputy public prosecutor Norhidayah Abdullah Sani urged the court to impose a deterrent sentence, citing the seriousness of the offence and the need to send a clear message to both the accused and the public.
"Public interest must take precedence. This was not a joke. Had the video been disseminated, it would have severely humiliated the victim," she said. Norhidayah conducted the prosecution with DPP Ramanathan Alias Ashwin. - BERNAMA

Finance officer loses RM4.17m in online investment scam in Penang
GEORGE TOWN: A finance officer working at a local consultancy firm has lost RM4.17 million after being deceived by an online investment scam. The incident was reported at the Timur Laut district police headquarters yesterday. Penang police chief Datuk Hamzah Ahmad stated that the 60-year-old victim encountered an advertisement for 'KKR Investment' on Facebook in early March. After clicking the link, she was contacted via WhatsApp by a woman who later added her to a group named 'Kumpulan Analisis Kewangan Saham Malaysia'. The suspect promised high returns within a short period, depending on the investment amount. The victim was instructed to download an app called 'KKR INV' through a provided link to register and start investing. Between March 10 and June 13, the victim transferred RM4.17 million in 76 transactions to eight different company bank accounts. She only realised she had been scammed when she could not withdraw the profits displayed in the app and was instead asked for more payments. The case is being investigated under Section 420 of the Penal Code for cheating. Authorities urge the public to be cautious of online investment schemes promising unrealistic returns.
