Kota Kinabalu: A 38-year- old man was freed of a charge of committing physical sexual harassment against his niece, without his defence being called. The man was discharged and acquitted by Sessions Court Judge Amir Shah Amir Hassan who ruled that the prosecution had failed to establish a prima facie case against the man. The man was accused of committing the offence against the 10-year and 10-month-old girl by fondling her breasts during the day on Dec 31, 2022 at a house in Penampang. He was charged under Section 14(a) of the Sexual Offences Againts Children Act 2017, which provides for a jail term of up to 20 years and whipping, on conviction. Four witnesses had been called by the prosecution during the hearing. Photo for illustration purposes only. – Photo from KOTA KINABALU (May 27): A Sessions Court here on Tuesday freed a labourer from a charge of committing sexual physical assault against his minor niece. Judge Amir Shah Amir Hassan acquitted and discharged the 39-year-old accused without calling for his defence. In his reserved ruling, the judge held that the prosecution had failed to establish a prima facie case against the man. He was accused of fondly touching the victim's breasts at an unnumbered house in Penampang during the day on December 31, 2022. The victim was 10 years old at that time. The alleged offence was under Section 14 (a) of the Sexual Offences Against Children Act 2017. The indictment provides for a jail term of up to 20 years and whipping, upon conviction. The prosecution had called four witnesses to testify against the man. This case was first brought to court on April 11, 2023. Counsel Mohamad Syazwan Shah Mohamad Ali, Nigel Neong Kaning and Hannan Razaini represented the accused.

KOTA KINABALU (May 23): A Sessions Court here issued an arrest warrant against an e-hailing driver, who was charged with posting abusive comments on social media TikTok. Judge Amir Shah Amir Hassan issued the warrant of arrest against Attad Alamin, 45, after the latter failed to turn up in court today when the case came up for mentioning. The prosecution had applied for the warrant to be issued on Attad since he was not present in court when his case was supposed to be mentioned to fix a hearing date. The prosecution submitted that only his bailors attended court and claimed that they wanted to withdraw themselves. The court fixed June 24 to review the warrant of arrest and to hear withdrawal applications by the sureties. Attad was accused of committing the offence and allegedly read by a man, who felt hurt by the post, at a house in Papar on 5pm on April 5, 2024. This case was first brought to court on August 15, 2024 and at that time, Attad was released on RM3,000 bail with two local sureties.

Kota Kinabalu: A 64-year-old who repeatedly raped his daughter since she was eight and she gave birth to a child as a result, was jailed 16 years and ordered to be given 10 strokes of the cane. The rapes continued until she was 16 and resulted in the birth of the child who is now 10 years old. Advertisement Sessions Court Judge Amir Shah Amir Hassan handed the sentence to the man who pleaded guilty to committing incest against the victim, now 26, at a house in Tuaran. The offence under Section 376(3) of the Penal Code carries a jail term of between eight and 30 years, and whipping at least 10 strokes, on conviction. In meting out the sentence, the court said although the man had no previous convictions, but he could not take the case lightly. He added that the case had a profound impact not only on the victim but also on her child's future. Advertisement During mitigation, the man who was not represented, only asked for a light sentence. However, Deputy Public Prosecutor Bryan Francis urged for a deterrent sentence, citing the seriousness of the offence and a rise in similar cases in Sabah. 'As her biological father, the man was bound to ensure her well‑being, not to destroy her entire life. 'In this case, the man has raped the victim multiple times since she was eight years old to the extent until she gave birth to a child who is currently 10 years old. 'We also wish to inform that according to the victim, the accused is still harassing her by sending pornography contents and sending death threats to her and her mom. 'Therefore, we pray for heavier sentence to be imposed against the man as deterrence not only to him but to the would-be offender in our society,' he said, adding that incident will inflict profound trauma on the victim. According to the case facts, the victim lodged a police report on Feb 4, this year which led to the arrest of the man on the same day. The deoxyribonucleic acid (DNA) test results later confirmed that the man is the biological father of the victim's child. Earlier in his decision, the judge said that although the man had no previous convictions, the court could not take the case lightly. The case, he added, has had a profound impact not only on the victim but also on her child's future. KOTA KINABALU (May 16): An elderly man was sentenced to 16 years' jail plus 10 strokes of the cane by a Sessions Court here today for raping his biological daughter since she was eight years old and gave birth to his child. The 64-year-old accused had raped the victim until she was 16. She is now 26 and the child resulted from the rape is now aged 10. The accused pleaded guilty before judge Amir Shah Amir Hassan to committing the offence at the end of 2014 at an unnumbered house in Tuaran. He was convicted under Section 376(3) of the Penal Code which carries a jail term of up to 30 years and whipping, upon conviction. The court heard that he victim lodged a police report on February 4 which led to the arrest of the accused on the same day. A DNA test result revealed the accused is the biological father of the victim's child. The accused was unrepresented.
