Labourer acquitted, discharged of sexual assault against niece

KOTA KINABALU (May 27): A Sessions Court here on Tuesday freed a labourer from a charge of committing sexual physical assault against his minor niece.
Judge Amir Shah Amir Hassan acquitted and discharged the 39-year-old accused without calling for his defence.
In his reserved ruling, the judge held that the prosecution had failed to establish a prima facie case against the man.
He was accused of fondly touching the victim's breasts at an unnumbered house in Penampang during the day on December 31, 2022.
The victim was 10 years old at that time.
The alleged offence was under Section 14 (a) of the Sexual Offences Against Children Act 2017.
The indictment provides for a jail term of up to 20 years and whipping, upon conviction.
The prosecution had called four witnesses to testify against the man.
This case was first brought to court on April 11, 2023.
Counsel Mohamad Syazwan Shah Mohamad Ali, Nigel Neong Kaning and Hannan Razaini represented the accused.

Kota Kinabalu: A 43-year-old jobless was jailed six years and fined RM2,000 in default three months for causing hurt to his son with a wooden stick. Shahmar Asecio pleaded guilty before Sessions Court Judge Marlina Ibrahim, to the charge against him. Advertisement He hurt to his 16-year-old son by hitting him with the wood at 11.30am on June 2, this year at a house in Kg Baitam Laut, Membakut. The offence is framed under Section 324/326A of the Penal Code. The court ordered Shahmar to serve the jail sentence concurrently with the sentence for another offence. In mitigation, Shahmar who was not represented asked for a lenient sentence. Advertisement However, Deputy Public Prosecutor Afiqah Alya urged the court to impose a heavy sentence to deter and give a lesson not only to Shahmar but public at large from committing such offence. The court heard that while the son was in the kitchen Shahmar came from behind and hit him with wood on his shoulder, head and right leg. The victim's mother then tried to stop Shahmar who suddenly took a machete and threatened the victim with the weapon. SANDAKAN: Police are currently tracking down several individuals identified to assist in investigations related to a number of criminal cases in the district. Acting Sandakan District Police Chief, Supt Ramasamy a/l Kuppan, said members of the public who know or have any information about the individuals involved are urged to contact the Sandakan District Control Centre at 089-212222 or go to the nearest police station to provide information. Advertisement Among those being sought is Yee Kok Wai (MyKad: 621219-12-5433) for an offence under Section 376 of the Penal Code for rape; Mohammad Azwan Mukram (MyKad: 960814-12-6277) under Section 14(d) of the Sexual Offences Against Children Act 2017; and Hisyam Tarang (MyKad: 820304-12-6061) under Section 354 of the Penal Code for using criminal force with intent to outrage modesty. Police are also searching for Mohd Nazrie Mohd Sha (MyKad: 770914-12-5581) for voluntarily causing hurt under Section 323 of the Penal Code, and Firdawis Daud (MyKad: 860401-12-5489) under Section 46(N) of the Prisons Act 1995. Also wanted is a 31-year-old Indonesian woman, Safawati Taming (Passport No: C3822626), for theft under Section 380 of the Penal Code. Tony at the court following the proceedings. – Photo by Kentigern Minggu KUCHING (June 6): A habitual drug user was sentenced by the Sessions Court here today to five months' imprisonment and two strokes of the cane for abusing amphetamine and methamphetamine. Judge Musli Ab Hamid convicted Tony Kuswadi Martin, 42, on his own guilty plea to a charge under Section 15(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 39C(1)(b) of the same Act. The Section provides for imprisonment of not less than five years and not more than seven years, and whipping of up to three strokes, upon conviction. Tony was also ordered to undergo two years of police supervision upon his release from prison. He was tested positive for the two drugs at the Kuching Narcotics Criminal Investigation Division office at around 2pm on June 2, 2025. It was informed that the accused has two prior convictions, in 2017 and 2022, for the same offence.
