New Delhi: A Delhi court on Friday decided to start hearing arguments on charge from July 2 in the Unlawful Activities (Prevention) Act case related to February 2020 riots. Additional Sessions Judge Lalit Kumar on June 2 noted that the prosecution and counsel for five accused persons had completed their arguments on charge. The court then sought the 'schedule regarding the time frame' and the manner of addressing the arguments, 'particularly time or hours' from the special public prosecutors and accused's advocates. On Friday, special public prosecutor Amit Prasad said the prosecution would take around four to five hours daily for at least five days to conclude its arguments. Prasad said he would supply a compilation for the court's convenience. The court agreed to the submissions of the prosecution and the counsel for the accused persons that the arguments on charge should continue post summer vacations. It was pointed out to the court that the proceedings in the present matter would take considerable time as the chargesheet runs into over 17,000 pages. Advocates for some other accused also made their submissions. 'This court considers it fit that a considerable time has already been lapsed and therefore, arguments on the point of charge have to be expedited,' the judge said on June 2.

New Delhi: A Delhi court on Friday set July 2 as the new date to begin hearing arguments on charges in the Delhi riots case on the larger conspiracy. Police, through special public prosecutor Amit Prasad, told the court of additional sessions judge Lalit Kumar that it would take five hours daily for at least five days to conclude its arguments. Prasad submitted that he would take four to five hours daily for at least five days to conclude his arguments. The court also accepted his suggestion to begin the arguments after the summer vacation so that continuity is not disturbed. The special public prosecutors and counsel for the accused said that since the chargesheet contains over 17,000 pages and it would take considerable time, the arguments should be after summer vacation for the sake of continuity. Advocate Adit S Pujari, appearing for Natasha Narwal and Devangana Kalita, submitted that there is an order of Delhi High Court of Sept 2024 which has directed that the trial court will hear the arguments, but a final order is not to be passed till the disposal of the petition. Pujari also submitted that he would argue at the end, as his two petitions are pending before Delhi High Court. Advocate Rajat Kumar, appearing for Abdul Khalid Saifi, submitted that there is a consensus that other counsel will start arguments after submission by advocate Rajiv Mohan, counsel for Tahir Hussain. On June 2, the court sought the schedule of arguments of all prosecutors and advocates of the accused to expedite the arguments on charges. The court noted that the matter was scheduled for arguments on charges and the special public prosecutor informed the court about the prosecution and five accused persons completing their arguments on charge. Twenty people, including activists Sharjeel Imam, Khalid Saifi, and former Aam Aadmi Party (AAP) councillor Tahir Hussain, were booked under the Unlawful Activities (Prevention) Act (UAPA) and several provisions of the Indian Penal Code for allegedly being the "masterminds" of the Feb 2020 communal riots that left 53 people dead and more than 700 injured.

New Delhi [India], June 6 (ANI): Delhi's Karkardooma Court on Friday fixed July 2 as the new date to begin hearing arguments on charges in the Delhi riots larger conspiracy case. Delhi police said that it will take 5 hours daily for at least 5 days to conclude its arguments. The court is set to hear the arguments afresh after the transfer of the judge who was hearing earlier. Additional Sessions Judge (ASJ) Lalit Kumar listed the matter for hearing on July 2 at Noon. The court fixed the date after hearing the submissions of Special Public Prosecutor (SPP) Amit Prasad and counsel for the accused persons. SPP Amit Prasad submitted that he will take 4 to 5 hours daily for at least 5 days to conclude his arguments. The court also accepted his suggestion to begin the arguments after summer vacations so that the continuity is not disturbed, as earlier, the court was listing the matter before the vacation. SPP Amit Prasad also submitted that he will supply a convenient compilation for the assistance of the court. There are 1200 pages, and it will take considerable time the same. The bail applications are listed for hearing before the High Court on July 1. Advocate Adit S Pujari, counsel for Natasha Narwal and Devangana Kalita, submitted that there is an order of the Delhi High Court of September 2024 which directed that the trial court will hear the arguments, final order is not to be passed till the disposal of the petition. 'On the last occasion, this way was opted as many legal points will be addressed, others will add to that only,' Rajat Kumar said. The court on June 2 directed the counsel for Delhi police and accused persons to file a timeline for arguments on the charge for an expeditious hearing in the North East Delhi riots larger conspiracy case. In this case, there are 18 accused persons, including Umar Khalid, Shakeel Imam, Tahir Husain, Natasha Narwal, Devangana Kalita and others who are facing the allegations of the larger Conspiracy of North East Delhi riots 2020. The court had said on Monday, 'This court consider it fit that a considerable time have already been lapsed and therefore, arguments on the point of charge has to be expedited.' It had further said that since the court has been transferred, the prosecution and the accused persons and their counsels seek some time to consult with each other regarding the time frame to address the arguments. 'Accordingly, all the Special Public Prosecutors (SPP) and Learned Counsel for the accused persons are directed to furnish their schedule regarding the time frame and the manner in which they will address the arguments, particularly time/hours to be taken by them,' ASJ Lalit Kumar directed on June 2. Earlier, the case was being heard by ASJ Amitabh Rawat since the filing of the first charge till 2023. Thereafter, ASJ Rawat was replaced by ASJ Bajpai. (ANI)

Following a recent reshuffle of 135 judges across New Delhi, the trial in the larger conspiracy case related to the 2020 Northeast Delhi riots is set to be delayed again. The case was at the stage of arguments on charges, after which the trial was likely to begin. Five of the 18 accused people had concluded their arguments over the past few months. They will now have to argue from scratch as will Special Public Prosecutors Amit Prasad and Madhukar Pandey, who had concluded their arguments from the Delhi Police Special Cell's side. 'Accordingly all the Special Public Prosecutors and counsel of accused persons are directed to furnish their schedule regarding the time frame and manner in which they will address arguments, particularly time/hours taken by them,' said Additional Sessions Judge Lalit Kumar of Karkardooma Court in his order on od. ASJ Kumar, who replaced ASJ Sameer Bajpai, stated that the arguments on charge have to be expedited and listed the case on June 6. This was the first time he had heard the case. Judge Bajpai had been transferred following an administrative order issued by the Delhi High Court last week. This is the second time the case has been delayed because of a routine transfer. In October 2023, the Court of ASJ Amitabh Rawat (who heard the cases before ASJ Bajpai) directed arguments on charges to be conducted on a day-to-day basis. Judge Rawat was transferred in mid-December 2023. The Delhi Police Special Cell is investigating the alleged conspiracy behind the riots that broke out in February 2020 and left 53 dead and over 700 injured. They have booked 18 accused under relevant provisions of the stringent Unlawful Activities (Prevention) Act and the Indian Penal Code. The first chargesheet was filed on November 20, 2020, and the fourth supplementary chargesheet was filed on June 8, 2023 — after a gap of two and a half years. The accused persons include Devangana Kalita, Natasha Narwal, Ishrat Jahan, Faizan Khan, Safoora Zargar, Asif Iqbal Tanha (all six on bail), Tahir Husain, Umar Khalid, Khalid Saifi; Sharjeel Imam; Meeran Haider; Gulfisha Fatima; Shifa-Ur-Rehman; Shadab Ahmed; Tasleem Ahmed; Saleem Malik; Mohd Saleem Khan and Athar Khan (all twelve in jail for over four years).

The Rouse Avenue court on Monday granted respondents time to file a reply on the revisions filed by Delhi Police and Delhi Law Minister Kapil Mishra. The court is dealing with two revisions challenging the order for further investigation on the role of Kapil Mishra in the North East Delhi riots of 2020. Special judge Kaveri Baweja granted time to respondents Mohd Iliyas, Kapil Mishra, and others to file a reply on the petitions. The court has also directed Delhi police to supply a copy of the charge sheet filed in the Delhi Riots larger conspiracy to the respondents. The court has listed the matter on May 7 for arguments, and the interim stay is to continue till the next date. He has challenged the order passed by the magistrate court directing further investigation into the North Delhi riots of 2020. The court had stayed the operation of the order passed by the trial court till the next date of hearing. The court had also called the trial court records. Meanwhile, the sessions court has stayed the observation made by the Judicial Magistrate (First Class) in relation to the investigation of the Delhi police in the larger Conspiracy case. During the hearing, Advocate Amit Prasad appeared for the Delhi police, Senior advocate Pavan Narang, along with Advocates Neeraj and Himanshu Sethi, appeared for MLA Mohan Singh Bisht, and Advocate Manya Hashija appeared for Kapil Mishra. Illiyas. Applicant Mohd Illiyas had sought a direction for registration of an FIR against Kapil Mishra and others. Senior advocate Pramod Dubey appeared for Kapil Mishra. He argued, "Can a further investigation without having an FIR? Where is the FIR? And there is no identification of the area of the police station." "In the absence of a FIR direction, an FIR can not be given," Senior advocate Dubey argued. Dubey also submitted that further investigation can be ordered during the pendency of the Final Report. "There was no Charge sheet before the MP MLA Court. There should be pendency of charge sheet. For registration of an FIR, a complaint has to be filed before the police first, only after that, an application for registration of an FIR can be filed in the court. One ATR was filed when the matter was pending in the KKD court. Three ATRs were filed by the police. My client was interrogated by Delhi Police," it stated. Special Public Prosecutor (SPP) Amit Prasad appeared for the Delhi police and raised the question of jurisdiction of the magistrate court, which passed the order under challenge. He submitted that even this court could not pass this court as it does not have the jurisdiction to deal with an FIR which is already under consideration of a special court, and a charge sheet has been filed. This application for registration of FIR was filed through Advocate Mehmood Pracha, who was part of the propaganda building team in 2020, and the SPP submitted it before the court. This complaint was given to all officers and even the prime minister. Emails were sent to the prime minister, the home minister, the DCP, and the Commissioner of police. It was not emailed to SHO. This email cannot be treated as the compliance with necessary requirements for registration of FIR, Prasad added. "A Status report narrating the five incidents was filed by the police," the SPP for Delhi police said. It was also argued that there was improvisation of the statement of the complainant. First, he said that the vehicles of Muslims and Dalits were stopped, and later on were allowed to go. Later, the statement was changed to reflect that there was a Road block, damage to the cart of Muslims and Dalits at Kardam Puri road, SPP added. There was no allegation of violation; the court below embellished the Complaint, the SPP submitted. He further submitted that we informed the court that we have investigated the role of Kapil Mishra. Advocate Pracha was asked to argue, but he didn't; meanwhile, the roster was changed. We were again summoned and asked to place on record the material. "We were directed to further investigate on the basis of material we provided in a matter which is before the special court," SPP submitted. The court asked, "Had you ever investigated the allegations in the complaint before filing the charge sheet in the larger Conspiracy. "Are there any other complaints alleging the road block by Kapil Mishra?" the judge questioned. SPP submitted that there are multiple such complaints, but nothing incriminating was found. He was asked during the recording of that statement whether he had ever visited the place of the incident. He replied that he lives in Yamuna Vihar, and a petrol pump was burnt near his colony, SPP said. There are 751 FIRs, no FIR talks about damage of vehicles on the same date and time between 3 pm to 6 pm, it added. It was further submitted by the SPP that he was called to assist the court in the matter of application under section 156(3) and was given direction under section 173( 8) for further investigation, it was not expected. "I am going to face music every day due to this order," SPP added. All these cases are tried in KKD, you do not get the power to give observation on the police investigation in a case that is before the special court, he added. He prayed that the observation of the trial court should be stayed.
