Jaipur: A single judge bench of Rajasthan High Court Monday issued notices to Bank of Maharashtra, additional commissioner of police, Telangana Police, advocate general, and others while hearing a petition seeking de-freezing of a Jaipur-based snack vendor's bank account. The account was frozen following instructions of Telangana police over a cyber fraud case. Justice Anoop Dhand issued notices on the petition filed by Padam Kumar Jain, a snacks vendor at Triveni Circle in Jaipur. The petitioner stated that on July 16, he was informed by the authorities of the Bank of Maharashtra that his account was frozen since it had a suspicious transaction of about Rs 4,600 from Telangana. "We approached the High Court as previously in a similar case the court held that without notice, banks cannot freeze accounts and only the transaction in doubt can be frozen, not the whole account," said Akshat Sharma, counsel for the petitioner. After hearing arguments, the HC said that the matter required consideration. "Notices to be served to the respondents. A copy of the petition and order to be given to the offices of the advocate general, additional advocate general Bhuwnesh Sharma, and Advocate Himanshu Tholia. Jaipur: Rajasthan high court Tuesday directed the foreigners regional registration officer in Delhi to extend the visa period for a five-year-old Australian citizen born to Indian parents without insisting on a no objection certificate (NOC) from the child's estranged mother who is fighting a matrimonial dispute with her husband. Hearing a writ petition filed by the child's father, Justice Anoop Dhand observed that the child, born in Australia to Indian citizens who returned to India in 2022, was residing with her father and could not be left at the mercy of her estranged mother. The HC stressed that the court's paramount consideration is the best interest of the child and that denial of visa extension would classify the minor as an illegal migrant, potentially leading to deportation. The court invoked international conventions, particularly UN Convention on the Rights of the Child (UNCRC), to assert that separating a child from either parent violates Article 9 of UNCRC. It also noted that no custody order favoured the mother, who earlier withdrew her application for guardianship. The court also allowed the petitioner to apply for an overseas citizenship of India (OCI) card for the child, urging the authorities to consider the application sympathetically within three months. The court called upon Union home ministry to revisit laws concerning children born abroad to Indian citizens, to address such unique and complex legal issues in the future.

Jaipur: Days after a school roof collapse killed seven students in Jalawar village, a single judge bench of Rajasthan high court Monday took suo motu cognisance of the poor condition of schools in the state and issued notices to the Centre and state govts, seeking detailed reports from Rajasthan chief secretary and Union secretaries on measures taken to improve infrastructure and ensure safety of school-going children. Terming the incident in Piplodi village as "heartbreaking", the court of Justice Anoop Dhand said, "As per reports of the Unified District Information System for Education, several govt schools in the state and country are in dilapidated conditions. Thirty-two percent of them have no electric supply, 9% have no drinking water facilities and 10% to 11% of schools have no separate toilets for girls. Due to the lack of toilet facilities, school-going girls are facing great difficulties affecting their health. Due to the lack of proper infrastructure, students face difficulties, and dropout rates are increasing." Justice Dhand said the state govt spends 6% of its total budget on education but continues to lag in infrastructure development. He added that a survey suggests 22% school buildings in 12 states, including Rajasthan, are in dilapidated condition and there are cracks in 31% such buildings. "There is no electricity in 32% schools in state, no drinking water in 9% schools," he said. The next hearing is on Aug 1.

A single judge bench of Justice Anoop Dhand took strong note of the delay, questioning the govt's inaction in the petition filed by Bhartiya Vidya Bhawan Vidyashram School. "Section 10 of the Act provides for the constitution of a Revision Committee, which serves as an appellate body to hear challenges against orders passed by the Divisional Fee Regulatory Committee. However, it has not yet been constituted by the state govt," said Prateek Kasliwal, counsel for the petitioner. "The delayed constitution of the Revision Committee has likely caused inconvenience to schools and parents, who are left without a functional appellate body to address their grievances. The court's intervention may prompt the govt to take immediate action to establish the committee and ensure that the provisions of the Act are implemented effectively," said Kasliwal. "Despite the Act coming into force in 2016, the Revision Committee of the state has not been constituted to date. What's more striking is that the govt of Rajasthan assured the court in May 2024 that the committee would be functional from June 15, 2024. However, the committee remains non-existent so far," said Justice Dhand. The court has now asked the principal secretary, education, to appear in court on May 19, either in person or via video conferencing, and he should file an affidavit explaining the reasons behind the delay in constituting the Revision Committee.

Jaipur: A single judge bench of Rajasthan High Court Thursday directed IDBI Bank to refund Rs 58.9 lakh, along with 6% interest since 2022, to a chartered accountant who fell victim to a cyber fraud . Ruling that the customer, in the case of cyber fraud, bore zero liability, the court also asked Union finance ministry and Reserve Bank of India (RBI) to formulate a mechanism to safeguard customers' money from unauthorised transactions. Court also said strict action must be taken against social media companies selling data of customers, which is being misused for cyber fraud. The court of Justice Anoop Dhand was disposing of a petition filed by Rakesh Totuka. TNN
