Man jailed 12 months for punching driving school instructor, kicking car
BATU PAHAT: A man who assaulted a driving school instructor by punching him in the face until he bled, and damaged a vehicle in an incident that went viral, was sentenced to one year's imprisonment after pleading guilty in the magistrates' court here today. Mohammad Rizal Mulyadi, 33, was also fined RM5,000 after entering the plea when both charges were read out before magistrate Arun Noval Dass. The court ordered him to serve 12 months in jail if he failed to pay the fine, which he was unable to do. On the first charge, he was accused of intentionally causing injury to a 56-year-old driving school instructor at the Parit Sulong police station compound at 1.30pm on Aug 12. The offence was committed under Section 323 of the Penal Code, which carries a penalty of up to one year's imprisonment, a fine of RM2,000, or both, upon conviction. On the second charge, he was accused of kicking the driver's side door, causing a dent, and smashing the windscreen of a car belonging to a driving institute in Taman Mutiara, Parit Sulong, at the same time and date. He was charged under Section 427 of the Penal Code, which provides for a prison term of up to five years, or a fine, or both. Based on the facts of the case, the complainant, who is also the victim, was on his way from Muar to Parit Sulong with four students when he was stopped by the accused, who was riding a motorcycle. After dropping off one of the students in Taman Mutiara, the accused blocked him again, got off his motorcycle, punched the car windscreen and kicked the driver's side door in anger. He then punched the victim in the face, causing injuries. Police investigations showed that the incident arose from the accused's anger after the victim overtook him, reportedly nearly causing a collision. The prosecution was conducted by deputy public prosecutor Firdaus Ruslan, while the accused was represented by Haryanti Othman from the National Legal Aid Foundation.

Clean sock: Trader fined RM1,200 for punching stall owner over cleanliness rebuke
BATU PAHAT: A trader was fined RM1,200 by the Yong Peng magistrate's court here today for punching a stall owner in the mouth until it bled after being told by the victim to stop littering on Saturday. He was charged with voluntarily causing hurt to the 31-year-old man at his stall in Taman Putera Indah, Tongkang Pechah, at 5pm on Aug 9. The charge carries a jail term of up to one year, a fine of up to RM2,000, or both upon conviction. However, magistrate Arun Noval Dass imposed the fine on S.M. Yusoff Othman, 56, after taking into account his guilty plea as well as submissions from both the prosecution and defence. The court also ordered a two-month jail term if the fine was not paid. Yusoff settled the fine. According to the facts, the victim had rebuked the accused for littering at his stall and told him to maintain cleanliness, which angered the latter. A quarrel broke out before Yusoff punched the man in the mouth, an act witnessed by his brother-in-law, who later lodged a report. Deputy public prosecutor Farah Wahidah Mohd Sharip appeared for the prosecution, while Tan Song Yan from the National Legal Aid Foundation represented the accused.

Man just out of jail for menacing wife now back in for whacking son
BATU PAHAT: Just days after being freed from prison for threatening to kill his wife, a 45-year-old factory operator found himself back behind bars, this time for kicking his own son in the stomach and striking him on the head. The man pleaded guilty at the Yong Peng magistrate's court today and he was sentenced to five months' jail by magistrate Arun Noval Dass. The father-of-four was charged with voluntarily causing hurt to his 18-year-old son in front of a business premises in Sri Gading here at 1pm on July 5. He was charged under Section 323 of the Penal Code, read together with Section 326A, which allowed for a doubling of the maximum penalty if the offence was committed against a family member. The sections carried a jail term of up to two years, a fine of RM2,000 or both. According to the facts, the victim lodged a report stating that his father had approached him aggressively to retrieve a motorcycle key. During the interaction, his father suddenly kicked him in the stomach and struck him on the head before leaving the scene. Police arrested the accused at 11am the following day. The victim was later sent to hospital where doctors confirmed the injuries on his head and body. Deputy public prosecutor Firdaus Ruslan prosecuted, while the accused was represented by Tan Song Yan from the National Legal Aid Foundation. In February, the Batu Pahat magistrate's court had sentenced the man to seven months' jail for assaulting his wife and threatening to kill her after she refused to give him RM800 for a car downpayment. The sentence was ordered to begin at his earlier date of arrest. Despite his brief stint of freedom, it appeared that he had not learnt his lesson.

Hired hand for 'Ah Long' fined RM10,000 for splattering red paint on houses
BATU PAHAT: An unemployed man, hired by an 'ah long', was fined RM10,000 by the magistrate's court today after pleading guilty to splashing red paint on two houses two months ago. Sashwin Ravindran, 25, who is currently serving a 12-month jail sentence for the same offence, pleaded guilty before magistrate Arun Noval Dass. According to the first charge, he and a 31-year-old accomplice were accused of committing a crime by splashing red paint on the house of a 45-year-old woman. The act was committed at a house in Taman Cemerlang here, at 1.30pm on April 14. For the second charge, he was charged with doing the same thing at the house of a 70-year-old man in Taman Pandan Jaya, Rengit, at 4.50pm on April 16. For both charges, he was charged under Section 427 of the Penal Code read together with Section 34 of the same Act, with imprisonment of up to five years or a fine or both, if convicted. Based on the facts of the case, the victims were at home and saw their yard covered in red paint. The closed-circuit television (CCTV) installed at the victims' houses recorded the sight of two men wearing helmets riding a motorcycle. In addition, the victims also found a threatening note to pay the debt before filing a police report. The accused was paid RM500 for each house that was splashed with paint. He was arrested in Skudai on May 14 to assist with the investigation. The prosecution was conducted by deputy public prosecutor Farah Wahidah Mohd Sharip while the accused was represented by lawyer Tan Song Yan from the National Legal Aid Foundation. In addition to the fine, the court ordered the accused to be imprisoned for 24 months if he failed to pay.

Man charged with kicking pregnant wife, slamming her head against wall
BATU PAHAT: A former security guard was charged in the magistrate's court here today with assaulting his pregnant wife and damaging a motorcycle last Saturday. The accused, Danial Azrey Affendy Mohd Noradi, 21, pleaded not guilty to both charges when they were read out by the court interpreter before magistrate Arun Noval Dass. According to the first charge, he is accused of intentionally causing injury to his 22-year-old wife by kicking her in the stomach and slamming her head against a wall at a house in Taman Desa Sri Banang at 1.15pm on June 7. The offence falls under Section 323, read together with Section 326A of the Penal Code. Section 323 carries a maximum sentence of one year in prison or a fine of up to RM2,000, or both. Meanwhile, Section 326A provides for a sentence twice the maximum for offences committed under Section 323 if convicted. For the second charge, the father of one is accused of kicking his wife's motorcycle, causing RM58 worth of damage, at Jalan Haji Ibrahim, Kampung Rahmat/Kampung Nawi Jaya, Jalan Tanjung Laboh, at around 3pm the same day. He is charged under Section 427 of the Penal Code, which carries a penalty of up to five years in prison, a fine, or both upon conviction. According to the police report, the wife, who is two weeks pregnant with their second child, had asked the accused to accompany her to Kulai to collect a baby cradle. He allegedly refused and told her to go alone. When she attempted to persuade him, he became angry, pulled her hair, and slammed her against the wall. He then allegedly kicked her in the stomach, causing pain, before she lodged a police report at Batu Pahat police station. The prosecution was led by deputy public prosecutor Firdaus Ruslan, while the accused was represented by lawyer Zulyatie Awang. The court granted bail at RM4,000 and imposed an additional condition requiring the accused to report to the nearest police station once every three weeks. The case has been set for mention on July 14 for document submission.
