Kota Kinabalu: A 24-year-old man who committed armed robbery twice on two 24-hour outlets in less than 24 hours, was sent to prison for 15 years plus six strokes of the Arskan pleaded guilty before Sessions Court Judge Amir Shah Amir Hassan, to two charges against him on Friday. Advertisement On the first count, he was jailed 10 years and ordered to get three strokes of the cane for robbing a 34-year-old woman, the 7-Eleven's worker at Telipok Ria, Tuaran on July 17 this year at 3.13am and made off RM67, by using a sickle. He committed the offence together with Mohd Hiesyamsuddin Baharudding, 26, who also admitted to the charge and sentenced to 10 years plus three strokes of the cane. They were charged under Section 395/397 of the Penal Code which carries a jail term of up to 20 years, and whipping, on conviction. On the second count, Asreen was sentenced to another five years' jail and ordered to be given three strokes of the cane for robbing another 7-Eleven worker, a 19-year-old man, of RM154.95 in Tuaran on July 18 this year at 1.23am, by using a machete. Advertisement The court ordered Asreen to serve the jail sentences consecutively from the date of conviction, which was on Friday. During mitigation, Asreen asked for leniency saying that he was remorseful and promised not to repeat the offence in future. He also requested for both sentences to be served concurrently. Meanwhile, Mohd Hiesyamsuddin also asked for a light sentence by saying he was very desperate at the time and wanted to help his mother. However, Deputy Public Prosecutor Bryan Francis urged the court to impose a deterrent sentence considering several aggravating factors such as they used weapons while robbing the victims which threatened the public safety. Bryan submitted that the offences took place during the early hours of the morning when the victims were alone. The timing and location of the offences indicate that the accused deliberately targeted a vulnerable victim in a setting where assistance was unlikely to be immediately available. He further said although no physical injury was inflicted, it was undeniable that the victims were placed in a state of intense fear when confronted with a masked individual wielding weapons. Bryan added that the psychological trauma caused by such experience was significant and must be taken into account. The court heard that on the first incident, Asreen who wore a helmet, entered the 7-Eleven outlet and threatened the female worker with a sickle while asking her to surrender money to him. The woman who feared for her safety then gave RM67 to Asreen who then fled the scene with Mohd Hiesyamsuddin who waited for him outside the outlet with a motorcycle. In the second incident, Asreen entered a 7-Elevn outlet in Tuaran and threatened the male worker with a machete by asking him to give him money. He managed to get RM RM154.95 from the worker. Both victims had identified Asreen and Mohd Hiesyamsuddin as the persons who robbed them during the identification parade. KOTA KINABALU (Aug 8): Two men were jailed for 10 years and ordered to be given three strokes of the cane each by a Sessions Court here for armed gang robbery. Judge Amir Shah Amir Hassan imposed the sentence on Asreen Arskan, 24, and Mohd Hiesyamuddin Baharudding, 26, after they pleaded guilty to their joint charge under Section 395 of the Penal Code, punishable under Section 397 of the same Code. The indictment provides for a jail term of up to 20 years and whipping, upon conviction. Asreen and Mohd Hiesyamuddin were arrested for robbing a woman staff of a 24-hour outlet in Tuaran of its money on July 17. They were armed with a sickle when committing the robbery. Meanwhile, Asreen received another five years' imprisonment and three whippings for robbing a man of his employer's money. Asreen had used a machete to commit the offence at a 24-hour outlet also in Tuaran on July 18. The accused was ordered to serve his jail terms consecutively.
