The accused is escorted out of the courtroom at the Kuching Court Complex. — Photo by Kentigern Minggu KUCHING (Aug 5): An Indonesian man was sentenced by the High Court here today to two years and nine months' imprisonment for smuggling eight migrants from his home country. Judicial Commissioner Zaleha Mohd Yusuf Pan meted out the sentence against the accused, 34, after he pleaded guilty to a charge under Section 26J of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants (Atipsom) Act 2007. This section provides for a maximum prison sentence of five years, a fine of up to RM250,000, or both upon conviction. The court also ordered that his sentence take effect from the date of his arrest, July 22, 2023. The accused committed the offence beside a shop premises along Jalan Batu Kawa here on the said date, at about 9.01pm. According to the facts of the case, a police team stopped a black Perodua Alza travelling beside the shop and found that the driver, later identified as the accused, was transporting eight other individuals to an undisclosed location. Further investigation revealed that all the individuals were Indonesian nationals. A report from the Malaysian Immigration Department stated that two of the eight had no record of entering or exiting Malaysia, while the remaining six did. However, their travel records indicated that they had overstayed in the country. The two were later charged under Section 6(1)(c) of the Immigration Act 1959/63, while the remaining six were charged under Section 15(1)(c) of the same Act. All of the migrants have since been sentenced accordingly. Therefore, the accused was found to have committed an offence under Section 26J of the Atipsom Act 2007. Deputy Public Prosecutor Muhammad Afiq Safly Nor Kazly prosecuted the case, while the accused was represented by lawyer Ranbir Singh Sangha. Court crime smuggled migrants

IPOH: A single mother was charged at the Ipoh Sessions Court yesterday for allegedly trafficking her daughter. The 44-year-old accused is alleged to have committed the offence at a house in Taman Sentosa 2, Sitiawan, between Sept 4, last year and June 7 this year, Sinar Harian reported. She allegedly trafficked her 21-year-old daughter for the purpose of exploitation by using force to compel her into working as a sex worker. The offence falls under Section 12 of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants (Atipsom) Act 2007, which carries a maximum penalty of 20-year imprisonment and a fine. In addition, the unemployed accused faces another charge under Section 14 of the same Act. She was accused of having trafficked her daughter while she was still a minor, aged 17 in 2022, for the purpose of sexual exploitation, committed at the same address between 2022 and Sept 3, 2023. The offence is punishable by life imprisonment or a minimum jail term of five years, and whipping. The accused, however, pleaded not guilty and claimed trial to both charges before Judge Azizah Ahmad.

PETALING JAYA: Large-scale operations against human trafficking operations have seen over 100 victims rescued, says Inspector-General of Police Tan Sri Razarudin Husain. A total of 45 operations led to the arrest of 249 suspects, he said at the monthly assembly of the Criminal Investigation Department (CID) at Bukit Aman here on Wednesday (May 28). '(In all) 144 victims were saved from the net of human exploitation under Section 44 of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants (Atipsom) Act 2007. 'The CID also recorded successes in the implementation of Operasi Cyber Guardian organised by the Singapore Police Force, involving Japan, Hong Kong, South Korea, Singapore, Thailand and Malaysia. 'The operation that ran from Feb 28 to March 28 also focused on dismantling online sexual crimes against children. 'This operation then led to the arrest of four suspects, including a civil servant, as well as the seizure of over 50,000 items of child sexual abuse material (CSAM)." The IGP also commended the ongoing effort in battling illegal gambling via Operasi Dadu Khas. 'A total of 6,719 raids were conducted with 8,603 people arrested. 'We also seized 3,464 electrical devices, including computers and handphones, as well as RM1.6mil in cash,' he said.

KUALA LUMPUR, May 4 — The Malaysian Immigration Department rescued 10 underage foreign girls believed to be victims of sexual exploitation during a raid on a spa and massage centre in Johor Baru yesterday. Director-general Datuk Zakaria Shaaban said preliminary investigations, guided by the National Guideline on Human Trafficking Indicators, found that the victims, six from Vietnam and four from Indonesia, were deceived with false job offers, denied wages, had their movements restricted and their passports withheld. All 10 victims have been placed in a shelter while investigations are carried out under the Anti-Trafficking in Persons and Anti-Smuggling of Migrants (Atipsom) Act 2007 [Act 670]. Checks on the premises led to the arrest of 37 Vietnamese women and 16 Indonesian women, aged between 18 and 40, on suspicion of prostitution. 'Initial findings revealed that prostitution services were offered to select clients through WeChat and WhatsApp, with rates from RM200 to RM300 per hour,' Zakaria said in a statement yesterday. He added that 11 men from Indonesia, Vietnam, and Bangladesh, working as cleaners, were also arrested, along with seven local men suspected of being the owners of the premises and 'captains' or handlers of the foreign women. A total of RM128,464 in cash, believed to be proceeds from the illicit activities, was also seized. 'At the time of the 3.15pm raid, several women were found attending to customers, including locals and foreign tourists, while others were hiding in a concealed room to evade detection,' he said. Zakaria added that the detained foreign nationals were taken to Immigration detention centres for further investigation under the Immigration Act 1959/63, Passport Act 1966, and Immigration Regulations 1963. Meanwhile, the local suspects identified as 'captains' are being investigated under Section 12 of the Atipsom Act 2007, Section 12(1)(f) of the Passport Act 1966, and Section 55B of the Immigration Act 1959/63. The operation was carried out following public complaints and intelligence gathered by the Atipsom and Anti-Money Laundering Prevention Unit of the Immigration Department headquarters in Putrajaya. It involved 58 officers from the Enforcement Division, Intelligence and Special Operations Division, as well as officers from Negeri Sembilan and Johor. — Bernama
