Youth claims trial to raping cousin when she was 7 and 12

(Pexels pic) PETALING JAYA : A youth has claimed trial to raping his cousin sister in Tuaran, Sabah, on two occasions, once when she was seven and five years later when she was 12. The 19-year-old was charged in the Kota Kinabalu sessions court with committing the offences on the victim sometime in 2019 and 2024, Daily Express reported. The charges were framed under Section 376 of the Penal Code, which provides for up to 20 years in prison and whipping upon conviction. Deputy public prosecutor Bryan Francis had urged the court not to allow the accused bail as he was a relative of the victim and posed a 'risk' to witnesses in the case. Lawyers acting for the accused pleaded for bail, saying their client is unemployed, had voluntarily come forward to assist in investigations, and also had to care for his parents who were ill. Judge Amir Shah Amir Hassan allowed the accused bail at RM3,000 but ordered him to report to the nearest police station every month and not to have any contact with the victim.

Man gets 16 years' jail, rotan for raping daughter since she was eight
KOTA KINABALU: A 64-year-old man was sentenced to 16 years' jail and 10 strokes of the rotan by the Sessions Court here today for repeatedly raping his biological daughter since she was eight years old. The rape, which continued until the victim was 16, resulted in the birth of a child who is now 10. The victim is now 26. Judge Amir Syah Amir Hassan handed down the sentence after the accused pleaded guilty to committing the offence at an unnumbered house in the Tuaran district in late 2014. The offence, under Section 376(3) of the Penal Code, carries a maximum sentence of 30 years' imprisonment and no fewer than 10 strokes of the cane. According to the facts of the case, the victim lodged a police report on Feb 4 this year, leading to the accused's arrest on the same day. Deoxyribonucleic acid (DNA) test results later confirmed that the accused is the biological father of the victim's child. Earlier in his decision, the judge said although the accused had no prior convictions, the court could not take the matter lightly. He added that the case had a profound impact not only on the victim but also on the future of her child. In mitigation, the accused, who was unrepresented, only appealed for a lighter sentence. Deputy public prosecutor Bryan Francis urged the court to impose a deterrent sentence, citing the seriousness of the offence and a rise in similar cases in Sabah. "As her biological father, the accused had a duty to protect her well-being, not destroy her life," he said. In this case, he said, the accused has raped the victim multiple times since she was eight years old to the extent until she gave birth to a child who is currently 10 years old. "We also wish to inform that according to the victim, the accused is still harassing the victim by sending pornography content and sending death threats to her and her mom. "As such, we pray for the heavier sentence to be imposed against the accused as deterrence not only to the accused but to the would-be offender in our society," he said, adding that the incident will inflict profound trauma on the victim. The accused was also ordered to be placed under police supervision for three years after completing his prison term.
