Buc-ee's sues Winter Park shop over its beaver t-shirts
WINTER PARK, Fla. - It's beaver vs. beaver. Buc-ee's has filed a lawsuit against a Florida oddities shop over its Krampus-inspired Buc-ee's beaver t-shirt. In the 14-page lawsuit, Buc-ee's argues that Prometheus Esoterica, a self-described Gothic boutique in Winter Park that sells "morbid antiquities," like taxidermy and animal skeletons, used Buc-ee's' beaver logo on t-shirts and other items without permission – and in violation of its trademark. According to the lawsuit, Prometheus Esoterica promoted the sale of its t-shirt designs, including a "Krampus Buccee,' on its Instagram page, as well as similar stickers. Among the allegations against the Florida shop: Federal trademark infringement Federal unfair competition Common law trademark infringement Common law unjust enrichment Violation of Florida Deceptive and Unfair Trade Practices Act Lawyers for Buc-ee's are seeking damages for the alleged infringement, an injunction preventing the shop from making more merchandise featuring its logo, and to destroy all items featuring its logo, according to the lawsuit. They're asking for a jury trial. "Defendant's unauthorized use of the BUC-EE'S Marks is likely to cause confusion among consumers. Consumers are likely to perceive a connection or association as to the source, sponsorship, or affiliation of the parties' products and services, when in fact none exists," the lawsuit states. FOX 35 reached out to the Winter Park shop for comment on Friday. We have not received a response. Earlier this year, Texas-based Buc-ee's filed a lawsuit against Super Fuels, claiming that its logo – a cartoon smiling pup with a red cape standing in front of a blue circle – was too similar to its logo, a cartoon beaver in a red hat standing with a yellow circle behind it. Illinois, however, does not have its own location, and according to the company's website the state is not on the short list for a new store. Among the Texas-based company' 50-plus locations are stores in Missouri and Kentucky. For those in the northern parts of Illinois, the company has plans for a Oak Creek, Wisconsin, location, but is facing backlash from the community. Buc-ee's, Gen Z's favorite gas station , is planning to open a series of new locations across nine different states. The gas station chain has built up a cult following for its delicious food offerings, clean bathrooms and light-hearted advertising. Now the chain has plans to open 11 new gas stations over the next two years. The chain, which operates most of its gas stations in the South, plans to open new stores in Ohio, Mississippi , Florida , North Carolina, Arkansas, Georgia, Virginia and Texas - and its first ever store in Arizona. The first Buc-ee's opened in Texas in 1982, and the company now has 62 locations across 14 states that are all open 24-hours-a-day, 365 days a year. The majority of Buc-ee's are in Texas, with others in Colorado , Missouri , Kentucky , Georgia, Florida, South Carolina and Alabama . Among them is the world's largest convenience store (in Luling, Texas , at 75,593 square feet) and the world's longest car wash (255 feet of conveyor in Katy, Texas). Despite its enormous success, Buc-ee's remains a private company and has no plans to become publicly traded, according to its website. Where are the new locations? Arizona A new location in the Goodyear suburb of Phoenix, Arizona, broke ground on May 14 and is set to open in June 2026, according to the Arizona Republic. The location is the first ever Buc-ee's to open in the state. It is located just off Interstate 10, so should pick up traffic from those traveling to or from western Arizona and California. Georgia Ohio & Florida North Carolina, Arkansas, Mississippi, Virginia Another location will open in Mebane, North Carolina, sometime between late 2026 and early 2027, according to The Charlotte Observer. Buc-ee's is set to open its first location in Arkansas in September 2026, The Benton Courier reported. Buc-ee's website also lists a store opening in Harrison County at some point this year. The site also lists another gas store opening in Rockingham County, Virginia , later this year. Texas Next year the residents of Boerne, Texas, will also get their own Buc-ee's location, according to the company's website. The gas station had previously aimed its marketing at campaign at appealing to Gen Z shoppers. Buc-ee's posters on highways in states such as Texas and Tennessee had slogans such as; 'In my Buc-ee's era', 'Beaver fit check' and 'Slay: 82 miles' on the backdrop of the chain's eye-catching red and yellow. Fragile baby spider monkeys ‘ripped' from mothers, brought to SoCal. Trafficker sentenced
A Texas man was busted for trafficking vulnerable Mexican baby spider monkeys, who were too young to be separated from their mothers, into San Diego and selling them on Facebook. Sarmad Ghaled Dafar, 33, was recently sentenced to four months in custody and 180 days of home confinement for trafficking six of the young primates, according to the U.S. Department of Justice. U.S. Fish and Wildlife Service agents uncovered his crimes in 2023 when they intercepted three baby Mexican spider monkeys that had been smuggled across the border in Calexico by someone working for him, prosecutors said. Not only is it illegal to own primates as pets in California, but it's also especially frowned upon to possess baby spider monkeys. The species is endangered, and infants require constant, skilled care to survive. "This crime ripped weeks-old baby monkeys from their mothers, disrupted fragile ecosystems, endangered a vulnerable species, and posed significant public health risks," said U.S. Atty. Adam Gordon in a statement Friday. After officials seized the three monkeys in August 2023, they searched the smuggler's phone and found messages indicating that he was bringing the animals across the border for Dafar. In his plea agreement, Dafar admitted to coordinating the trafficking of baby spider monkeys, receiving them in the U.S. and arranging their sale. The three confiscated monkeys - named Chrissy, Jack and Janet - were temporarily quarantined at the San Diego Zoo. As part of his sentence, Dafar was ordered to pay more than $23,500 in restitution for the cost of their quarantine. The monkeys have since been permanently housed at the Brookfield Zoo in Chicago, alongside two other baby spider monkeys, named Frankee and Bucees, who were seized in a separate Southwest border smuggling case, prosecutors aid. During the investigation, officials discovered Dafar had previously smuggled and sold at least three other baby Mexican spider monkeys, in June 2022 and July 2023. Their whereabouts are unknown. These three additional monkeys were not quarantined, which is required by law to prevent deadly diseases - such as Ebola, Marburg and mpox - from spreading from primates to humans, prosecutors said. "This is not merely an economic crime; it is a severe and lasting injury to both wildlife and public safety," said Gordon. "Border security is not just about interdicting drugs and preventing illegal entries. It also involves protecting the public from dangerous diseases." The investigation indicated that Dafar intentionally trafficked baby spider monkeys, despite the risk of separating them from their mothers, because he believed they were easier to hide. When a Facebook user sent Dafar a news article about spider monkeys seized by U.S. Border Patrol agents, he responded, "He stupid brin[g] to[o] many of them and all adults they make a lot noise and they active. Baby's most be sleeping and small to hide," according to court documents. Dafar messaged potential customers on Facebook and sent photos of baby spider monkeys in diapers and under a heat lamp, both signs indicating that the primates are too young to survive on their own, prosecutors said. Spider monkey typically nurse for their first two years of life, and most will stay close to their mothers until they are 4 years old. Their mothers are protective, and the entire troop will work together to defend the baby in the face of a threat, according to testimony from U.S. Fish and Wildlife agents. As a result, poachers will often kill the mother and troop when trying to capture babies. Genetic testing of Chrissy, Jack and Janet indicated that they all had separate mothers, meaning it is possible that poachers killed many monkeys to capture them.
