SEREMBAN: Four men, including a Myanmar national, pleaded guilty in the Sessions Court here today to misappropriating 1,200 kilograms (kg) of subsidised liquefied petroleum gas last month. Lee Kin Choong, 57; Lim Chun Wee, 38; Tang Kai Lin, 28, and Mar Thang, 31, made the plea before Judge Mohamad Kamil Nizam. They were jointly charged with committing the offence with another person, Phaway Ai, 23, also a Myanmar national, but the charge was not read out to him today because an interpreter was required. They are jointly charged with possessing a scheduled controlled substance, namely liquefied petroleum gas, amounting to 1,200 kg, in circumstances giving rise to reasonable suspicion under Regulation 3(1) of the Control of Supplies Regulations 1974 at about 6.45 pm at an unnumbered premises in Jalan Mantin, here last May 30. The charge, under Section 21 of the Control of Supplies Act 1961 and read together with Section 34 of the Penal Code, provides a maximum fine of RM1 million or an imprisonment for up to three years upon conviction. Judge Mohamad Kamil set bail at RM6,000 with one surety for the three local men, while bail for Mar Thang, who is a Myanmar national, was set at RM8,000 with one surety. They were also ordered to surrender their passports to the court, report at the Negeri Sembilan office of the Ministry of Domestic Trade and Cost of Living (KPDN) once a month and not intimidate witnesses. The court set July 2 for mention. Prosecuting officer from KPDN, Janawatul Fieza Hamisan, appeared for the prosecution, while all the accused were unrepresented.

Man charged with illegal possession of 4,000 litres of diesel in Pasir Puteh

KOTA BARU: A 25-year-old man was charged in the Sessions Court here today with dealing in nearly 4,000 litres of diesel without valid authorisation in Pasir Puteh in February last year. Afiq Hazwan Azmi, however, pleaded not guilty when the charge was read before Judge Zulkifli Abdullah. The accused allegedly committed the offence at Lot PT 150, Jalan Kampung Gong Kala, Sungai Petai, Pasir Puteh, during a joint operation conducted by the state Domestic Trade and Cost of Living Ministry and the Pasir Puteh district police headquarters' Criminal Investigation Department at 5am on Feb 2, 2024. During the raid, the accused was allegedly dealing in 3,993 litres of diesel stored in several Intermediate Bulk Containers (IBCs). The accused and several others were said to have fled the scene but were later tracked down by police and investigating officers. He was charged under Section 21 of the Control of Supplies Act 1961, read together with Regulation 3(1) of the Control of Supplies Regulations 1974. The prosecution was led by ministry prosecuting officer Muhammadi Iman Masjuri, while the accused was represented by the legal firm Azrul Hasyimi & Co. The prosecution proposed bail at RM30,000 with additional conditions, including monthly reporting to the ministry's Kelantan office, refraining from contacting witnesses, and surrendering his passport to the court. The court set bail at RM15,000 with two sureties and fixed July 27 for mention and submission of documents.

Trader fined RM15,000 for illegal possession of petrol, diesel

KANGAR: The Sessions Court here today fined a trader RM15,000 after he pleaded guilty to possessing 750 litres of petrol and diesel without a valid licence in Padang Besar in 2023. Judge Sharifah Norazlita Syed Salim Idid meted out the sentence after the accused, Loo Boo Long, 41, changed his plea after the charge was read again. During initial proceedings on Jan 23, Loo had claimed trial. He was accused of possessing controlled and scheduled items, namely 150 litres of petrol and 550 litres of diesel in four drums, without a valid licence. He was also charged with possessing 50 litres of diesel in a tank, at an unnumbered store next to his house in Lot 11, Lorong Teratai, Jalan Kolam, Kampung Kolam, Padang Besar, on Nov 6, 2023. The charge was framed under Regulation 3(1) of the Control of Supplies Regulations 1974, punishable by up to three years' jail or a RM1 million fine. The prosecution was led by the Domestic Trade and Consumer Affairs Ministry's Perlis branch prosecuting officer, S. Mugunthan, while counsel Syed Muhammad Anwar Syed Lokman Hakim appeared for the accused. Mugunthan urged the court to impose a deterrent sentence, saying the offence risked manipulation of controlled goods in the market. In mitigation, Syed Muhammad Anwar pleaded for a minimal sentence for his client, citing that the accused supports a wife, five children and his parents. The court then imposed the fine in default eight months' imprisonment. Sharifah Norazlita also ordered the forfeiture of the cash proceeds from the fuel sale, totalling RM1,761.50, as well as a Proton Saga car, to the government.
