JSK movie case: HC closes petition by producers

Kochi: A high court bench of Justice N Nagaresh on Wednesday closed a petition filed by Cosmos Entertainments, the producer company of the Suresh Gopi-starrer Malayalam movie Janaki V vs State of Kerala, seeking the timely issuance of a censor certificate. Tired of too many ads? go ad free now HC closed the proceedings after being informed that the (CBFC) issued the certificate on July 11. Initially, CBFC had declined certification for the film, objecting to the use of the name Janaki, another name for Goddess Sita. The board cited Guideline 2(12) of the certification rules, which prohibits visuals or words contemptuous of religious, racial, or other groups. The CBFC also suggested 96 cuts in the film, prompting the producers to move HC. Subsequently, the board proposed modifications, including adding the initial 'V' to the character's name in the title and muting the word Janaki in two specific scenes. The producers accepted these suggestions and resubmitted the film, which was then cleared by CBFC. While closing the petition, HC permitted the producers to use promotional materials, including teasers and advertisements, bearing the old title Janaki vs State of Kerala. The court clarified that in view of the peculiar circumstances under which the film was granted certification, the continued use of such promotional materials will not expose the petitioner to any legal claims or liabilities. The court also clarified that this direction is intended to preclude unnecessary litigation from the public, such as claims before consumer forums alleging that the film advertised as Janaki vs State of Kerala was ultimately released as Janaki V vs State of Kerala.

CBFC decision on movie ‘JSK' likely today

Kochi: Central Board of Film Certification (CBFC) has informed high court that the board chairman has referred the movie 'JSK – Janaki vs State of Kerala', starring Suresh Gopi, to a revising committee for certification under Rule 24 of the Cinematograph (Certification) Rules, 1983. The committee's meeting is scheduled for Thursday. Following this, the bench of Justice N Nagaresh adjourned to June 27 the petition filed by Cosmos Entertainments, the movie's production company, which is seeking a directive to the CBFC to issue a censor certificate for the film. HC also directed that the revising committee's decision shall be made known to the petitioner on the next posting date. The petitioner alleged that although the film was submitted for certification on June 12, the CBFC has neither issued the certificate nor raised any formal objections. Instead, the delay is allegedly due to informal and oral objections regarding the film's title and the character name 'Janaki,' despite the CBFC having already issued a censor certificate for the film's teaser. On Wednesday, the petitioner argued that the CBFC screening committee had viewed the film on June 18 and had given a positive recommendation. However, no further action has been taken since. The petitioner's counsel also pointed out that the film's release was scheduled for June 27, and the postponement would result in a loss of approximately Rs 80 lakh.

Plea in Kerala HC seeks time-bound certification of movie

Kochi: The production company of the upcoming Malayalam film 'J S K – Janaki v/s State of Kerala', starring Suresh Gopi, has approached high court seeking a directive to the Central Board of Film Certification (CBFC) to issue the censor certificate for the film within a time-bound manner. The petition, filed by Cosmos Entertainments, is scheduled to be considered by the bench of Justice N Nagaresh on Wednesday. The petitioner stated that although the film was submitted for certification on June 12, the CBFC has neither issued the certificate nor raised any formal objection to date. Instead, the delay is allegedly due to informal and oral objections regarding the film's title and the character name 'Janaki,' despite the CBFC having previously issued a censor certificate for the teaser of the same film. The film is scheduled for worldwide release on June 27, and any further delay in issuing the censor certificate would result in severe and irreparable financial and reputational loss, the petition stated. The petitioner further submitted that, based on news reports, the CBFC has now directed changes to both the film's title and the name of the titular character, 'Janaki,' citing that it refers to the Hindu goddess 'Sita'. This, the petitioner argued, reflects inconsistency and arbitrariness in the CBFC's stand, as no such concerns were raised at the time of certifying the teaser.
