KUCHING (May 28): The joint declaration signed by Prime Minister Datuk Seri Anwar Ibrahim and Sarawak Premier Datuk Patinggi Tan Sri Abang Johari Tun Openg on May 21 is a significant milestone in redefining federal-state relations, particularly in the governance of natural resources, said Datuk Sebastian Ting. Speaking at a press conference at the State Legislative Assembly (DUN) today, the Sarawak United People's Party (SUPP) secretary-general said this agreement reflects a collaborative and constructive approach between the federal and state governments, setting a commendable precedent for resolving resource-related issues amicably and in a mutually-beneficial manner. 'In essence, SUPP views the joint declaration as a balanced and strategic approach to resource governance – an important step towards realising Sarawak's aspirations for greater autonomy and equitable development. 'We remain committed to supporting its implementation and to ensuring that its agreed-upon principles are translated into benefits for the people of Sarawak,' he said. He pointed out the arrangement between Petroliam Nasional Berhad (Petronas) and Petroleum Sarawak Berhad (Petros) was a true 'win-win' outcome – one grounded in a shared understanding while respecting each party's rights and responsibilities. He said the decision was in full alignment with Sarawak's Distribution of Gas Ordinance 2016 (DGO 2016), reinforcing the state's legal framework for the management of its gas resources. 'The joint declaration acknowledges both the Petroleum Development Act 1974 (PDA) and DGO, ensuring that federal and state laws co-exist and are respected by all parties involved in the oil and gas industry, including Petronas,' he said. He said the declaration reaffirms the commitment to uphold Sarawak's rights and autonomy as enshrined in the Malaysia Agreement 1963 (MA63), the Inter-Governmental Committee (IGC) Report, and the Sarawak and Federal Constitutions. 'On behalf of SUPP and all my fellow ADUNs (elected representatives) – some are here with me today – we wish to commend and congratulate our Right Honourable Premier, Datuk Patinggi Tan Sri Abang Johari for his inspiring, comprehensive and forward-looking winding-up speech. The Sarawak United People's Party (SUPP) said the joint declaration has successfully solved the disputes over the governance of oil and gas distribution within Sarawak. 'Utility and Telecommunication Minister Dato Sri Julaihi Narawi had sent a very clear message in his ministerial winding-up speech at the State Legislative Assembly (DUN) Sitting yesterday, stating that with such a joint declaration, Petros' appointment as gas aggregator must be respected by everyone undertaking the business of gas distribution in Sarawak. 'All agreements and arrangements pertaining to the supply and sale of natural gas in Sarawak must align with Petros' role as gas aggregator,' SUPP vice president Datuk Michael Tiang told a press conference today. Describing the joint declaration as another milestone for Sarawak and its people, he said SUPP commended Prime Minister Datuk Seri Anwar Ibrahim and Premier Datuk Patinggi Tan Sri Abang Johari Tun Openg for their wisdom and firm stand in reaching this understanding and agreement for the way forward. 'It is also pertinent to understand that all gas industry players including Petronas must respect and comply with Section 7 of the Distribution of Gas Ordinance, 2016 (DGO 2016), which is to apply for a licence as well as to comply with all Sarawak state laws when conduct their business of gas distribution in Sarawak,' he said. He criticised the Democratic Action Party (DAP) for attempting to politicise the issue, especially when both Anwar and Abang Johari have stood firm on the same ground. Julaihi delivers his winding up speech in the DUN. — Ukas photo KUCHING (May 26): Petroliam Nasional Berhad (Petronas) may apply for exemption from licensing requirements for activities or projects that do not conflict with the role of Petroleum Sarawak Berhad (Petros) as gas aggregator, said Datuk Julaihi Narawi. The Utility and Telecommunication Minister said such applications will be considered in accordance with the law, provided they do not involve the supply, sale, retail, or distribution of gas—sectors under the purview of Petros as sole aggregator. 'The Joint Declaration acknowledges Petros as the gas aggregator appointed by the Sarawak government in the exercise of its executive authority. 'Both the Prime Minister (Datuk Seri Anwar Ibrahim) and the Premier of Sarawak (Datuk Patinggi Tan Sri Abang Johari Tun Openg) have expressly stated that this appointment must be respected by all parties involved in the business of gas distribution in the state,' Julaihi said in his ministerial winding-up speech at the State Legislative Assembly (DUN) here today. Julaihi said all agreements and arrangements related to the supply and sale of natural gas in Sarawak must align with Petros' role as gas aggregator, as outlined in the Joint Declaration. He stressed that all industry players, including Petronas, must conduct their gas distribution activities in full compliance with the terms of the declaration. 'Therefore, all parties involved in activities related to the distribution and supply of gas are required to apply for a licence under Section 7 of the Distribution of Gas Ordinance, 2016 (DGO 2016). 'Failure to comply with this licensing requirement constitutes an offence under Section 20 (criminal case) or Section 21A (civil claim) of the Ordinance, which may result in a fine, imprisonment, or both,' said Julaihi. He stated that since the amendment to the DGO 2016 in 2023, his ministry has implemented several regulatory measures, including the issuance of 14 licences for upstream activities under Section 7(g), 537 licences for downstream industry players, and 10 non-compliance notices to five companies found operating without a licence under Section 7 of the Ordinance. Julaihi further expressed his confidence that the Joint Declaration will benefit Sarawak and serve national interests by strengthening investor confidence, particularly among international companies in the gas distribution sector.

GENERAL KUCHING, May 22 (Bernama) -- Sarawak is committed to working closely with the federal government, Petroliam Nasional Bhd (Petronas) and Petroleum Sarawak Bhd (Petros) to implement the joint declaration framework in good faith. Sarawak Premier Tan Sri Abang Johari Tun Openg said the state reaffirmed its position that both federal and Sarawak laws must coexist in harmony and be respected by all parties. 'And this declaration gives them a guide on how they (Petronas) are doing their business in collaboration with Petros. Petronas still have to apply for the license to tell us. 'Petros is the gas aggregator, but the authority to produce a license lies with the Ministry for Utility and Telecommunication Sarawak (MUT), which has the authority to exempt Petronas, being a national company…we give the exemption to them,' he told reporters at the state assembly building here, today. Abang Johari said this to explain the joint declaration between the federal and state governments signed yesterday. The Premier also gave assurance that the declaration will not be abolished even if there is a change of government in the future. He also reiterated that the declaration is a clear manifestation of mutual respect and recognition of Sarawak's regulatory framework, particularly the State Distribution of Gas Ordinance 2016 (DGO 2016). Yesterday, the federal and state governments reached an understanding on matters involving Petronas and Petros. The joint declaration framework was signed at Perdana Putra by Prime Minister Datuk Seri Anwar Ibrahim and Abang Johari. Meanwhile, when asked whether the declaration would impact the ongoing court cases between Petros and Petronas, Abang Johari said the state government will leave the matter to the legal team to decide.

KUCHING: Although the dispute between Petronas and the Sarawak government over oil and gas rights has been formally resolved through a joint declaration, the national oil company and its subsidiaries operating in the state are still required to apply for operating licences under Sarawak laws. However, exemptions will be granted, Sarawak Premier Tan Sri Abang Johari Openg said at a press conference at the state legislative assembly today. The briefing followed the signing of the joint declaration between Prime Minister Datuk Seri Anwar Ibrahim and Abang Johari in Kuala Lumpur yesterday. "They are required to submit their applications. We will grant them exemptions," he said. Under the declaration, Petronas is expected to "cooperate" with Petros on all future oil and gas ventures in the state, especially those involving international partners. Expressing his gratitude to the Prime Minister Datuk Seri Anwar Ibrahim for his leadership and commitment in formalising the joint declaration, Abang Johari said the agreement reflected respect for Sarawak's rights and demonstrated that "real progress comes from genuine partnership and mutual trust". The most significant aspect of the declaration, he said, was the reaffirmation that both federal and Sarawak state laws must coexist harmoniously and be respected by all parties. "We respect their laws. They should respect ours," he said, adding that the joint declaration represented a milestone in Sarawak's evolving partnership with the federal government in the spirit of federalism. "This is a testament to the federal government's commitment, under the leadership of the Prime Minister, to honour the aspirations and constitutional rights of Sarawak as enshrined in the Federal Constitution, the Malaysia Agreement 1963 (MA63), and the Inter-Governmental Committee (IGC) Report." Abang Johari described the declaration as a clear manifestation of mutual respect and recognition of Sarawak's regulatory framework, in particular the Distribution of Gas Ordinance 2016 (DGO 2016). He said the collaborative framework outlined in the agreement would provide clarity and certainty to the oil and gas industry in Sarawak, particularly through recognition of Petros as the state's gas aggregator. As such, he said, all parties involved in the business of marketing, distributing and supplying gas to consumers in Sarawak must comply with DGO 2016. Looking ahead, Abang Johari reaffirmed Sarawak's commitment to working closely with the federal government, Petronas and Petros to implement the joint declaration in good faith. He said the agreement sets in motion a strategic shift aimed at unlocking Sarawak's gas potential, advancing the Sarawak Gas Roadmap, and accelerating the state's transition to a cleaner, more sustainable energy future — in line with Sarawak's aspiration to become the energy hub of the Asean region. When asked about the ongoing court cases filed by Petronas challenging Sarawak's rights over oil and gas, Abang Johari said he would leave the matter to the legal teams of both Petronas and Petros to resolve through due legal process.
