Representative Image DEHRADUN: A single-justice bench of the Uttarakhand high court has referred the issue of whether section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 takes precedence over the Uttarakhand State Amendment under Section 438 of the Code of Criminal Procedure, 1973, to the bench presided by the Chief Justice. The referral addresses whether the provisions of BNSS, which benefit the accused, can be applied retrospectively to earlier cases regardless of when the case was initiated. After the other bench rejected the anticipatory bail appeals, they were heard by Justice Alok Verma bench, who stated that the provision of anticipatory bail is rooted in the fundamental right to personal liberty. Expressing disagreement with the view taken by the coordinate bench, Justice Verma said, "It is a pre-emptive measure to safeguard personal liberty against false accusation or misuse of the law. Anticipatory bail is a safeguard against arbitrary arrest. Liberty is the very quintessence of a civilized existence. The BNSS is also upholding the importance of protecting personal liberty. The restrictions on granting anticipatory bail under section 438(6) of the Code (as amended by the State of Uttarakhand) are no longer in effect. He further said that the anticipatory bail is a substantive right, not merely a procedure. "In BNSS, there is no express bar prohibiting anticipatory bail for the offences under IPC and other Acts, even if committed before the commencement of BNSS. It must be read in a manner that protects rather than restricts the rights of the accused," the counsel said. He also cited a case of Allahabad HC in which it was held that the provisions of section 482 of BNSS would prevail over the state amendment. "When the Parliament enacts more liberal provisions, the benefit thereof should be available to all persons who may be affected, regardless of when their cases originated. Therefore, this court is of the opinion that the accused is entitled to the benefit of the more liberal provisions introduced by BNSS," Justice Verma said and referred the case to the Chief Justice. Six textile parks will be set up across the state to further strengthen the industry, he added. Jaipur: The police Wednesday busted a cyber fraud racket worth Rs 5 crore operating in the city and arrested four members of the gang linked to an international network. DCP (South) Rajashi Raj Varma told TOI that the gang supplied bank accounts to online scammers, with funds routed all the way to China. "Acting on a tip-off, a police team from Shyam Nagar police station raided a flat near Kamla Nehru Bridge and seized Rs 7.7 lakh, 28 ATM cards, 23 chequebooks, 10 mobile SIMs, and forged rental agreements used to legitimise fake firms," he said. Varma said that key accused, Sunil Jakhar, allegedly used the front of a shell company to launder money from online scams. Jakhar converted the fraud money into cryptocurrency (USDT) and relayed it to Chinese handlers. "The gang leased out bank accounts across Rajasthan, Maharashtra, Bihar, and Jharkhand. Villagers were lured with Rs 10,000–30,000 a month to rent out accounts, hand over signed cheques, ATM cards, and SIMs linked to the accounts. The gang withdrew the laundered cash and sent crypto codes to China in return for commissions," Varma said. "So far, 19 cyber fraud complaints have been traced to accounts seized in this bust," said Varma, adding that the crackdown came after Rajasthan police ordered an aggressive campaign against cybercrime. Police believe more arrests are likely as they trace the gang's crypto trail and China connections. The gang is also suspected of frequently changing flats every one to two months to avoid detection.

Jind: A heart-wrenching incident has come to light in Haryana's Jind district, where a 15-year-old boy was allegedly held as a bonded labourer and subjected to brutal abuse by his employer for two consecutive months. The child was cutting fodder for cattle when his hand got caught in the sickle. Following this horrific accident, the owner abandoned the child in a dark, remote area 25-30 km from Jind city and fled. Somehow, the injured child reached Nuh, where a teacher saw him and rushed him to a local health centre and informed the police. On learning about the incident, officials from the Child Protection Commission reached the hospital to inquire about his condition. The child, a native of Bihar's Kishanganj region, had left his village about two months ago with a group to work in the paddy fields of Kithana village in Haryana's Kaithal district. During the journey, he got off the train at Bahadurgarh station, and while he was roaming around, the train left. A man approached him at the station and offered him a job for Rs 10,000 a month. Mumbai: Marine Drive police on Wednesday arrested a travel agent from Karnal in Haryana, Ravi Rajbhar, for allegedly procuring fake visas using forged Indian passports and immigration documents to facilitate illegal entry into Germany. The investigation was initiated following multiple complaints lodged by the Consulate General of the Federal Republic of Germany in Mumbai, alerting authorities about suspicious Schengen visa applications accompanied by fake passports and forged travel documents. The complaint was formally registered by a senior visa advisor at the German Consulate, who, after internal verifications, flagged the anomalies. Sources said the racket came to light when five people submitted Schengen visa applications with counterfeit visas of foreign countries, border control stamps, and tampered passports between July and Nov 2022.
