Court acquits driver in fatal accident case
Ahmedabad: A sessions court overturned the conviction of Mohit Darji, who had earlier been sentenced to one-year imprisonment for rash and negligent driving that caused the death of one of the passengers in the car he was driving. The accident took place near SP Ring Road on Sep 23, 2015, when Darji was driving the car at high speed and hit a pole near the divider. The car turned turtle, and Darji's friends, Urvi and Devanshi, were injured. Darji was booked for rash and negligent driving under BNS and the Motor Vehicles Act. Urvi succumbed to her injuries, and Darji was accused of causing death by negligence under Section 304A of BNS. A JMFC court found Darji guilty and punished him with one-year imprisonment in March 2023. He challenged his conviction before a sessions court. His advocate, Vivek Bhamare, argued that the prosecution failed to prove beyond reasonable doubt that Darji was driving negligently. The court stated, "It is very much clear that though the complainant and other witnesses have deposed that the appellant-accused was driving the vehicle at fast speed, yet, there is no direct evidence which connects the accused with the crime and also rashness and negligent driving on the part of the accused-appellant is not proved beyond reasonable doubt and under these circumstances, the benefit of doubt should go to the accused. Man lynched over suspicion of scooter theft in Gandhinagar
Ahmedabad: A 30-year-old man from Aravalli district was allegedly beaten to death by three men in Gandhinagar who suspected him of stealing a scooter. The incident took place in the early hours of Tuesday, according to an FIR filed with Dabhoda police by the victim's elder brother, who accused the trio of lynching. The deceased, Kalpesh Katara, was a resident of Sunokh village in Bhiloda taluka of Aravalli. On Monday night, he reportedly went out with a friend from Vaktapur. The next morning, Kalpesh's family received a call from Dabhoda police station stating that he met with an accident and was admitted to Gandhinagar Civil Hospital. Later, they were informed that Kalpesh died during treatment. In the FIR, his elder brother Arvind Katara, a resident of Himmatnagar, stated: "My brother Kalpesh Katara was beaten up by Yash Darji and his aides Nikunj Patel and Sanjay Barot of Lawarpur village of Gandhinagar on suspicion of stealing a scooter. Due to the injuries inflicted by them, my brother died." That night, Darji, along with Patel and Barot, set out to trace the stolen vehicle. "Around 2am on Tuesday, they reportedly saw someone riding Darji's scooter near Gambhoi crossroads and attempted to intercept him. The rider tried to flee but fell into a roadside ditch after losing control of the vehicle, suffering injuries. The trio pulled him out of the ditch and then beat him to death," said inspector G K Bharwad of Dabhoda police. The trio caught Kalpesh and instead of handing him over to police immediately, they allegedly took him to the spot from where the scooter was stolen. The FIR states, "They took Kalpesh either to the garage or some other place and assaulted him, which caused severe injuries leading to his death." The accused informed the police about a thief being caught around 3.15am on Tuesday, and Kalpesh, who was unconscious, was shifted to Gandhinagar Civil Hospital. He died during treatment around 8:30am on Tuesday. A panel of doctors conducted the postmortem and noted multiple injuries on Kalpesh's body. Dabhoda police registered a case of murder under Bharatiya Nyaya Sanhita (BNS) sections for murder and abetment against the accused, along with charges of the SC/ST (Prevention of Atrocities) Act, as the victim belonged to a scheduled tribe. Human trafficking racket: Bobby Patel's aide arrested from Gujarat after 2.5 years on the run

Gujarat police's state monitoring cell (SMC) arrested Bipin Darji — purported to be the partner of Bharat alias Bobby Patel, the 'Dingucha kingpin' allegedly linked to the tragic deaths of a Gujarati family on the US-Canada border in 2022 — from Vijapur in Mehsana. Police say he was part of the network allegedly led by Bobby Patel that promised people with dreams of settling in the US, illegal passage through Canada and Mexico. "Darji worked as a field agent in Mehsana region and was responsible for luring clients desperate to reach the US, collecting their documents, arranging fake passports and visas, and coordinating payment logistics with Bobby Patel and the network of domestic and international illegal immigration agents," said a police officer close to the case. DIG (SMC) Nirlipt Rai said SMC launched an investigation after an FIR was registered under several sections of the IPC related to cheating, forgery and criminal conspiracy as well as for violations of the Indian Passport Act at Sola High Court police station in 2022. Investigations revealed that Bobby Patel had obtained 28 legally issued passports by altering minor details, some even containing biometric data, through various passport offices in Mumbai and Ahmedabad. These multiple passports allowed him to leave and re-enter India undetected. He was arrested by the SMC in Dec 2022 from Bhadaj area of Ahmedabad when he allegedly arrived to meet his ailing partner. "He is suspected of having helped 1,500 people from North Gujarat obtain fake passports. His name cropped up in the investigation into the IELTS paper scam in North Gujarat. We also suspect Bharat Patel had sent six people from North Gujarat to the US. The six had to be rescued by the US authorities after their boat capsized and they almost drowned while illegally crossing the St Regis river on the Canada-US border," said an officer. The Enforcement Directorate (ED) arrested Bobby Patel early this July under the provisions of the Prevention of Money Laundering Act (PMLA), 2002, in connection with a human trafficking case. The ED initiated its investigation based on the FIR registered by Sola High Court police station, which accused Patel and others of illegally sending Indian citizens abroad since 2015. The investigation revealed that Bobby Patel and his associates allegedly charged Rs 60 lakh to Rs 75 lakh for one passenger, Rs 1 crore to Rs 1.25 crore for a couple, and Rs 1.25 crore to Rs 1.75 crore for families with children. Even as further probe is underway, an officer close to the investigation said, "Other accused related to the case still at large include Munna Khatri, reportedly residing in Canada, and Munna Maken, currently in the US, for whom extradition procedures are ongoing." On May 27, police arrested nurse Hemlata Darji and radiologist Harshad Acharya, who allegedly carried out sex determination tests and abortions for Rs 15,000. Police said Acharya performed tests at his Odhav clinic, while Darji carried out the abortions at homes or a Bavla guesthouse. "These were not random acts but part of a planned service. The accused selected clients carefully, mostly through referrals," the officer said. "The clients didn't even visit the clinics. Blood samples were picked up by a lab courier, and abortions were done at home." Officers said that the nurse was well-networked and would offer her help in getting rid of a female fetus. Police found that 25 tests were conducted after which eight female fetuses were aborted.
