Recent charges withdrawn against brothers facing outstanding drug trafficking and weapons allegations

Alleged drug traffickers Darryl and Kody Berdan had federal drug charges, laid earlier this year against them, withdrawn by the prosecution this week. The brothers from Alliston, Ont. who face several outstanding charges under the Controlled Drugs and Substances Act were in court for the decision by an agent for the Public Prosecution Service of Canada relating to charges from April and May 2025 when both men were taken into custody accused of possession of cocaine for the purpose of trafficking. Darryl Berdan, 40, faces two drug trafficking counts from November 2024 when police said the accused was dealing drugs across Alliston and was pulled over along Young Street for a traffic stop of a vehicle with an obstructed licence plate. The elder Berdan, who goes by the name Kenny or Kenneth, was charged with possession of cocaine and methamphetamine for the purpose of trafficking along with having proceeds of crime under $5,000 and breaching his probation. (Source: OPP) A few weeks later Berdan was charged under similar circumstances leading to a charge of possession of an unauthorized weapon. He was also charged with three counts of breach of probation. In April and May, Berdan was also charged with possession of weapons and failing to comply with release orders. His brother Kody, 36, was also charged twice in April with weapons counts and failing to comply with release orders during what provincial police described as a bail compliance investigation. Kody Berdan had his most recent federal drug charges withdrawn by the Crown as well but faces several weapons charges and seven counts of failing to comply with a release order. According to court records, he is also accused of aggravated assault and uttering threats in October 2023. The accused are scheduled to return to court next week, the outstanding allegations against them have not been tested in court.
