Man gets decades in prison in fatal shooting, over-100 mph police chase

Jun. 3—A man shot and killed another man in Dayton and then led police in a chase with speeds over 100 mph. He is now facing more than 20 years in prison after pleading guilty to a manslaughter charge. William Gerald "Gerry" Hefner, 59, of Dayton pleaded guilty to one count of involuntary manslaughter charged via a bill of information in addition to indicted charges of aggravated possession of drugs, having weapons while under disability, and failure to comply with orders or signal of a police officer, according to a plea agreement filed May 29 in Montgomery County Common Pleas Court. Hefner was charged in the June 1, 2023, death of 48-year-old Matthew Smith of Dayton. Multiple people called 911 just before 10:50 a.m. to report a shooting in the 100 block of Centre Street. One woman told dispatchers that her boyfriend and her friend were involved in the shooting and had both left, according to Montgomery County Regional Dispatch Center records. She said that one left in a truck and the other ran away. A different caller told dispatchers that he was working in the area when a man ran up to a front door and said he was shot. The caller said that the man was shot in the top left side of his abdomen. He also told dispatchers that the man said he knew where the shooter was but didn't provide more information. "I didn't even hear a shot, so I'm not sure where it happened at," the caller said. The gunshot victim, later identified as Smith, was taken to Miami Valley Hospital, where he died later the same day from his injuries. Police said they identified Hefner as a suspect in the shooting and spotted his truck on camera the next day, noting that he had changed its appearance. Just before 10 p.m. June 7, an officer recognized Hefner driving a truck and started to pursue him. Dash camera footage of the chase showed the truck drive through yards and around traffic as well as running red lights and stop signs. Dayton Municipal Court records said the chase reached speeds of more than 100 mph. The chase came to an end near Salem Avenue and Denlinger Road in Trotwood when it drove through some grass and ran up against a pole. As part of the plea agreement, eight charges were dismissed, including murder and felonious assault. He was sentenced to a total of 20 to 25 1/2 years in prison without possibility of early release. He also must pay restitution for funeral and burial expenses and forfeit a Hi-Point 9mm Luger pistol. Staff writers Kristen Spicker and Jen Balduf contributed to this story.

Mar. 11—A dozen people were arrested and one person is facing charges after crowds of people celebrated St. Patrick's Day on University of Dayton's campus Saturday afternoon and evening. Of those arrested, four are students and eight are not students, according to University of Dayton officials. The students are being referred to the student disciplinary system as appropriate. A large gathering started around noon in the south student neighborhood near the 400 block of Lowes Street. There were 44 medic calls for illness and injured and 18 people transported to the hospital, according to university officials. Police told the crowd to disperse and later used a loudspeaker and horse-mounted patrol officers to issue more commands for people to leave the area. Officers used chemical munitions to clear the area after people in the crowds threw bottles at police, according to UD officials. "There was not one incident that precipitated the decision to clear the street; instead it was multiple factors, including shifting crowd dynamics, increased medical emergencies and safety concerns for the crowd and first responders," said Savalas Kidd, assistant vice president and chief of police. "Many of those in attendance did leave the area when told; however, some in the crowd resorted to throwing bottles and other objects at officers. This unacceptable behavior caused an escalation in crowd control." Lowes Street was cleared around 4:45 p.m. and was closed for the rest of the evening. About 90 minutes later, Dayton police received reports of disruptive crowds near Brown and Jasper streets. UD Public Safety officers and Dayton police responded to disperse the gathering. Around 9:15 p.m. police continued to break up crowds in the area when shots were fired in the Dewey's Pizza parking lot at 131 Jasper St. Springboro police responded to the scene, in addition to the Dayton and UD officers. A suspect, identified as 22-year-old Elijah Murph-Heard, ignored multiple commands to stop fleeing, according to Dayton Municipal Court records. He ran into the street in front of a Dayton officer, who tried to stop him by knocking him down, a Dayton police spokesperson said. The collision caused the officer to flip off of the bicycle and injured them. An officer from another police department also knocked the suspect down with a bicycle, but he got up and continued to run, according to police. It reportedly took multiple officers to arrest Murph-Heard. An officer used a taser to assist in the arrest, police said. He had a loaded .380 caliber handgun that was reported stolen in Dayton in 2015, according to court records. Murph-Heard was booked into the Montgomery County Jail. He is facing receiving stolen property (firearm), obstructing official business, carrying concealed weapons, having weapons while under disability and resisting arrest charges in Dayton Municipal Court. The resisting arrest charge is a second-degree misdemeanor. Brown Street was temporarily closed and students were urged to avoid the area while officers investigated, according to a post on the UD Facebook page. Police gave an all-clear around 11:30 p.m., and Brown Street was reopened.

A woman is facing charges after she allegedly shot at a Family Dollar store in Dayton. Officers found a shattered front window when they arrived on scene. The incident started when Pettet got into an argument with a cashier about her EBT card not working, according to an affidavit and statement of facts filed in Dayton Municipal Court. The manager eventually stepped in to help. After Pettet left the store, she got into a Dodge van and drove past the front of the store. Court records indicate that Pettet reportedly pointed a gun out of the driver's window and fired a shot at the store. The shooting was caught on surveillance video. Police learned that Petter was related to a former employee. They went to the former employee's house and found Pettet there. Officers saw a spent 9mm casing in plain view on the driver's seat of the van. After initially denying shooting the store, she 'stated she meant to shoot over the building and not at it,' according to court records. Feb. 7—A Dayton man has been sentenced to probation connected to a fight where a man was stabbed multiple times and a 14-year-old was knocked unconscious. Tavion'te Nel'shon Howard was sentenced by Montgomery County Common Pleas Judge Gerald Parker Jr. to up to five years of probation, with the conditions that the law enforcement maintain custody of the Smith and Wesson handgun involved in the case and he have no contact with his codefendants. Howard was charged along with Nathan Kyle Harber, 20, and Dae'toine Amontaey Jamar Shells, 19 connected to a fight Oct. 28, 2024. Police were called to the 400 block of Delaware Avenue on a report that someone had been shot, and on arrival found a man who had been stabbed multiple times and a 14-year-old who had been punched and kicked unconscious, according to Dayton Municipal Court records. Police confirmed to media that nobody was shot, but bullet casings from two different guns were found on scene. While investigating, police searched Shells' home and found a loaded .45 cal iber Glock handgun, documents said. When detectives spoke to Howard, he said that he saw Shells have and fire a handgun during the fight, and that he also fired a 9 mm handgun that was found in his home, records said. Harber was indicted on two counts of felonious assault, and is scheduled to be in court Feb. 13. Shells was granted intervention in lieu of conviction Jan. 17.
