So you've finally bought that EV, Congrats! It's clean, future-proof, and makes you feel like Tony Stark on a budget. But now comes the part no one warns you about: charging it. And if you live in an apartment complex in India, getting a personal EV charging point can feel like navigating a maze of permission letters, passive-aggressive RWAs, and unclear regulations. Let's get you through the legal rights, step-by-step process, and what to do when your housing society blocks your EV setup and what the law says about it. The Law Is On Your Side (Mostly) The Indian government has been pushing EV adoption, and charging infra is key. According to the Ministry of Power's 2022 guidelines, any individual can install a private charging point in their home or apartment parking, provided it meets basic safety norms. The rules say: No RWA can unreasonably deny permission to install a charger if it doesn't affect common facilities. DISCOMs must support the installation and provide connections at notified rates. In societies, load augmentation or energy metering may be needed but can't be used to delay things endlessly. Some cities, like Delhi, have gone further. The Delhi EV Policy allows for simplified installations with rebates up to Rs6,000 per charger through empanelled vendors. Maharashtra, Karnataka, and Gujarat are also implementing fast-track approvals and subsidies. If your parking is on stilts or open, make sure there's a safe route for wiring. Write a formal letter to the Resident Welfare Association (RWA) or builder. Attach: charger specs, installer details, and a basic wiring diagram. Mention that the cost will be borne by you, and the wiring will be secure and non-intrusive. Some RWAs may insist on a 'uniform policy" for all EV users. If they delay indefinitely or reject unfairly, you have legal recourse. Apply for a dedicated EV meter or an extension from your home meter. If you want to use the common area meter, the RWA must approve it. In Delhi, BSES and Tata Power allow online applications via the Switch Delhi platform. The connection must follow safety standards: MCBs, earthing, and ISI-marked cabling. Licensed electricians are mandatory. Buy and Install a Certified Charger You can install a basic 3.3 kW AC charger (normal socket) or a 7.4 kW wall-mounted charger. Only buy Bureau of Indian Standards (BIS) approved models. Use a certified installer or DISCOM empanelled vendor. Some EV companies (like Tata, Ather, MG) provide installation support. Others like ChargeZone, Fortum, Statiq, and EESL offer marketplace options. This step varies widely between states. In Delhi, this is usually waived for low-power chargers. What If the RWA Says No? This is common. Some RWAs deny permission citing: Fire safety concerns Structural modifications Fear of setting a precedent But unless they can prove technical risk, they can't block you legally. Delhi Transport Minister Pankaj Singh on Tuesday announced that the draft of the new Delhi EV Policy will undergo wider public consultation, which is expected to take time, resulting in an extension of the current EV Policy. PTI quoted Singh saying that the policy extension was among the matters listed for Tuesday's Cabinet meeting, and it has been decided to extend the same. 'The current Electric Vehicle (EV) Policy has been extended until March 31, 2026, or until a new policy is approved, whichever is earlier," Singh reportedly said to the news agency. The minister said that the move aims to facilitate comprehensive consultations with all the relevant stakeholders, including citizens, industry experts, private organisations, and environmental groups. During this extended period, key provisions of the Delhi EV Policy will be discussed, including strengthening the electric vehicle charging infrastructure, reviewing subsidies and waivers to boost EV adoption, developing robust systems for safe e-waste and battery disposal, and clearly defining the role of the public and private sectors in advancing the electric mobility ecosystem. Singh added that given Delhi's air pollution crisis, this participatory approach is seen as a crucial step towards framing a more effective, inclusive, and forward-looking EV policy that promotes clean and sustainable urban transport. He also added that the government has urged active public participation in the consultation process to collectively shape the future of electric mobility in the capital. The current Delhi EV Policy was first introduced in 2020. It lapsed in August 2023, but since then, it has been extended multiple times. The Delhi government had discussed the draft policy on April 15 but deferred the approval of key proposals, including the phasing out of CNG auto-rickshaws and fossil fuel-based two-wheelers within two years. The draft policy envisions 100 per cent electric vehicle adoption in the national capital over the next three years. Delhi govt plans to retrofit BS4 trucks to BS6 compatibility In view of the approaching ban on the entry of BS4 trucks in the national capital, the Delhi government is going to invite innovative ideas for retrofitting of these commercial vehicles to meet BS6 compliance, said Delhi's Environment Minister Manjinder Singh Sirsa on Tuesday. The minister has directed the Delhi Pollution Control Committee (DPCC) to hold an innovation challenge to find technological solutions to the issue. PTI has reported that the winning entry, whose technology will be used by the government, will be awarded a prize money of ₹ 25 to ₹ 50 lakh. The innovation challenge will be held in three stages — in the first stage, the proposal will be evaluated based on the paper submitted; the second stage will be focused on carrying out an exhaustive study of the proposal, following which ₹ 5 lakh will be given for testing the technology as part of the third stage. The certification will be given by The National Physical Laboratory (NPL). Sirsa said that if commercial vehicles won't be allowed to enter Delhi, it would lead to a crisis. "We will hold this challenge to invite solutions for retrofitting of BS4 trucks," he reportedly said. The minister also added that this will also help in curbing pollution in the national capital. The challenge will also involve finding solutions to reduce emissions from BS4-compliant vehicles. "The innovation challenge will be focused on identifying and promoting low-cost, easy-to-maintain and effective technological solutions capable of reducing/absorbing PM 2.5 and PM 10 emissions of at least twice the amount emitted from BS-IV vehicles operating," the minister said. This move from the Delhi government comes at a time when, from November 1 this year, only BS6, CNG or electric commercial vehicles will be allowed to enter the city. She said that while highlighting the Delhi government's different initiatives to combat air pollution. The Delhi CM has said that the transformation of all the vehicles, including private ones, into electric vehicles (EVs) is a big vision for which the Delhi government is coming up with a new EV policy, PTI reported. "We will urge people to purchase electric vehicles for which they will be provided subsidies," she reportedly said. Gupta also said that air pollution in the national capital region is a year-long problem that requires sustained efforts, for which the Delhi government is hiring 1,000 water sprinklers to be used to combat dust on the roads throughout the year. "In view of traffic, these sprinklers will operate in early morning and late night hours so that no congestion is there on the roads," she reportedly added. Gupta reportedly urged people to adopt electric vehicles. Delhi EV Policy 2.0: What does it envision? The Delhi government drafted the new EV policy earlier this year, detailing a roadmap for the government's vision for electric mobility. The Delhi EV Policy 2.0 draft has proposed tax waivers for hybrid vehicles for the first time. The inclusion of strong hybrid and plug-in hybrid electric vehicles under the policy marks a shift from the erstwhile BEV-exclusive approach to a broader clean mobility framework. The draft policy proposed a full exemption on road tax and registration fees for hybrid vehicles with an ex-showroom price of up to ₹ 20 lakh. The draft policy states that this move would bring down the price of such vehicles and encourage car users to shift to the usage of such vehicles. Besides that, road tax and registration fees will be fully waived for all Battery Electric Vehicles (BEVs) throughout the duration of the Delhi EV Policy 2.0. However, this exemption for electric cars will apply only to those models with an ex-showroom price of ₹ 20 lakh or below. The Delhi EV Policy is known as one of the most comprehensive electric vehicle policies in India. In the five years since the policy was introduced, the National Capital Territory of Delhi has established itself as a national leader in electric vehicle (EV) adoption. During this period, the share of EVs in total vehicle sales in Delhi increased nearly fourfold, reaching an average of 12 per cent in 2024. In 2024, electric vehicle sales in Delhi saw a remarkable 30 per cent increase compared to 2022, with a total of 82,081 EVs registered during the year. With the new EV Policy, the Delhi government is aiming to ramp up the pace of EV adoption in the city and region.
