NEW DELHI: CM Rekha Gupta introduced the Delhi Goods and Services Tax (Amendment) Bill 2025 in the Assembly, after engaging in a heated exchange with her predecessor, Atishi over it. While tabling the bill, the CM said the amendments align the Delhi GST Act with reforms passed in the Central GST Act by the Centre. 'This is a step towards simplification, transparency, and justice for taxpayers,' she said. The bill was passed in the House on Friday. The amendments were introduced through two focused legislative packages. Combined, these reforms extend ITC claim periods, lower the pre-deposit for appeals from 10% to 7%, improve dispute resolution, and introduce machine-tracking enforcement mechanisms, particularly in sectors like gutkha manufacturing.

The Delhi Assembly on Friday passed the Delhi Goods and Services Tax (Amendment) Bill 2025. Chief minister Rekha Gupta said the amendments are aimed at simplifying tax administration, boosting compliance, and providing substantial relief to taxpayers and businesses across the national capital. This is a step towards simplification, transparency, and justice for taxpayers. Our aim is to promote business confidence while maintaining effective revenue governance,' CM Gupta said while tabling the bill. Amendments moved by the GST council are required to be ratified in the state assembly because both the central government and state governments have powers to levy and collect taxes on goods and services. Accordingly, the assembly is required to pass the amendments to the GST. The CM had moved the Delhi Goods and Services Tax (Amendment) Bill, 2025 and Delhi Goods and Services Tax (Second Amendment) Bill, 2025 in the Assembly on Thursday. The amendments were introduced through two focused legislative packages. The first package, comprising 45 amendments approved in GST Council meetings held in July 2023, October 2023, and June 2024, focused on extending ITC timelines, simplifying registration and return filing, establishing the GST Appellate Tribunal, and launching an amnesty scheme for relief on interest and penalties. The second package, passed during the 55th GST Council Meeting in December 2024, included 14 amendments aimed at strengthening enforcement and procedural clarity—such as penalties for non-compliance in track-and-trace systems, clarified ISD credit distribution, treatment of municipal funds, and streamlined appeal processes, CM office said in a statement. Leader of opposition in Delhi Assembly Atishi said the traders are concerned about the GST amendment bills. 'The government can now ask traders for documents in any format, which is troubling them. Along with this, the BJP government is talking about giving tax exemptions to SEZs. Such traders are only the special friends of the BJP. They will be given exemptions, while all sorts of rules are being imposed on the common traders of Delhi,' said Atishi.

Now, with machine tracking and unique identifiers, govt will ensure full transparency," CM said. She added that the GST amnesty scheme alone led to Rs 218 crore in collections for Delhi as of 31 March, 2025, a clear sign of taxpayer responsiveness to the reforms. Gupta slammed Atishi, who held the finance portfolio for two years in the AAP dispensation, for raising questions on amendments passed in GST Council meetings she did not attend. She added that the former CM missed the 55th GST Council Meeting, where these reforms were approved. Gupta highlighted that Delhi's GST and VAT collections increased to Rs 15,535 crore in just the first four months of the 2025-26 financial year, up from Rs 14,500 crore during the same period last fiscal. The leader of the opposition in Delhi Assembly, Atishi, however, alleged that the new provisions in the Act would empower govt to demand paperwork in any format, creating anxiety and confusion among lakhs of small businesses. "On one hand, BJP is harassing local traders with arbitrary compliance rules; on the other, it is offering tax sops to SEZs, which are nothing but safe havens for their industrialist friends," Atishi charged, calling the bill discriminatory and demanding its withdrawal. Soon, Delhi traders to get one-time GST amnesty scheme, says CM

Chief minister Rekha Gupta on Friday said the Delhi government will soon introduce a one-time Goods and Services Tax (GST) amnesty scheme which will provide relief to traders from pending dues . The announcement came during a conference organised by the Confederation of All India Traders (CAIT) at Bharat Mandapam. Experts, however, said that the Delhi GST Act does not have provisions for the state government to unilaterally announce an amnesty scheme. But, it can do so by taking approval from the Centre, they said. A number of states have rolled out the scheme, the latest being Haryana. Rajat Mittal, a tax lawyer, said: 'GST is a dual levy with both central (CGST) and state components (SGST), so states are technically empowered to independently provide amnesty or waiver schemes for their share of GST dues. But every demand order of a taxpayer in Delhi would also have CGST or even IGST component which cannot be unilaterally waived off without the concurrence of the GST Council. In the spirit of cooperative federalism, it is desirable that such schemes to be placed before the GST Council, especially to ensure uniformity across states.' Additionally, the government will unveil warehousing and industrial policies to enhance investments in industrial sectors and promote entrepreneurship. The CAIT said that the CM also announced that the government is planning to modernise and refurbish Delhi's major markets with upgraded amenities. 'The Delhi government is committed to being trader-friendly and considers trade to be the backbone of Delhi. The administration is working towards resolving traders' concerns and introducing business-friendly policies,' said the CM at the event. The event was attended by Union minister of state Harsh Malhotra, MPs Ramvir Singh Bidhuri, Bansuri Swaraj, Kamaljeet Sehrawat, and Delhi ministers Pravesh Verma and Manjinder Singh Sirsa among others. The CM also said that a 'Single Window Clearance System' will be launched soon to simplify business operations and offer entrepreneurs access to multiple benefits through a centralised system. Chandni Chowk MP and CAIT secretary general Praveen Khandelwal also proposed the formation of a 'Delhi Economic Development Council' to prepare a comprehensive economic plan through consultations with stakeholders. 'It will revive Delhi's traditional trade network and open vast opportunities in business, industry, and employment,' said Khandelwal.
