Atishi claims detention during protest at Kalkaji jhuggi demolition site; police deny charge

NEW DELHI: The AAP on Tuesday claimed its leader Atishi was detained by police when she went to meet the residents of Bhoomiheen Camp in Kalkaji where a demolition is to be carried out. Police, however, denied any detention. Eviction notices by the DDA have been pasted at houses in the jhuggi-jhopri camp, warning 'encroachers' to leave the spot within three days, or face action. The camp, where most residents are migrant workers, has seen demolition drives thrice in the past year —in May and June this year and July 2023. Despite claims of detention, a police officer said Atishi along with others were 'removed' under Section 65 of the Delhi Police Act. Section 65 of the Act, 1978 states that all persons must comply with reasonable directions given by a police officer in the discharge of their duties under the Act. If someone resists, refuses, or fails to comply, the police officer can remove the person, produce them before a Metropolitan Magistrate, or release them in trivial cases, it says. Calling this an act of dictatorship, Arvind Kejriwal posted on X: 'In just three months, the BJP has destroyed Delhi.' At Bhoomiheen Camp, Atishi addressed the media and residents, saying: 'BJP wants to demolish all jhuggis. Today they are taking me to jail because I raised my voice for jhuggi dwellers. CM will face the curse of the poor.'

Was detained when I went to meet residents of Bhoomiheen Camp: Atishi

Senior Aam Aadmi Party leader and Leader of the Opposition Atishi on Tuesday said the police detained her when she went to meet residents of Bhoomiheen Camp in Kalkaji, south Delhi, which is set to be demolished on Wednesday. Rejecting her claims, a police officer said Ms. Atishi was 'not detained' but 'removed' from the site under the Delhi Police Act's Section 65 (If someone resists, refuses, or fails to comply, the police officer can remove the person, produce them before a Metropolitan Magistrate, or release them in trivial cases). The camp is situated on land owned by the Delhi Development Authority (DDA), and the DDA has issued an eviction notice to its residents. However, there was no reaction by the DDA over the claims demolishing planned for Wednesday. At a press conference, Ms. Atishi said, 'The DDA and Delhi Police have planned a bulldozer action tomorrow (Wednesday) at Bhoomiheen Camp. Today, the entire area was fortified by the police and the Central Reserve Police Force personnel, who began forcibly evicting the residents from their homes.' The former Chief Minister said that the camp's residents are not encroachers, as claimed by the DDA, but have been living there for decades. 'They work in the Kalkaji area; their children study in nearby schools. If their homes are demolished, where are they supposed to go,' she asked. Ms. Atishi alleged that she was 'assaulted' by the police. 'It is disgraceful. The Deputy Commissioner of Police of that area physically assaulted a two-time elected MLA, who is also the Leader of the Opposition and a woman who had come to hear public grievances. In a democracy, doesn't an MLA have the right to meet her constituents?' she alleged. The AAP leader said that of the 3,024 flats built by the DDA in Kalkaji under its in situ rehabilitation programme, only 1,862 flats have been allotted to beneficiaries so far. 'Why are the remaining flats vacant,' she asked.

Detained by police in Kalkaji camp, claims Atishi; Cops deny

New Delhi: Former chief minister Atishi claimed on Tuesday that she was detained by police when she went to meet the residents of Bhoomiheen Camp in Kalkaji, where a demolition is to be carried out. Denying the detention, police said, Atishi was "removed" from the spot under section 65B of the Delhi Police Act and taken to Baba Haridas Nagar police station in southwest Delhi's Dwarka. AAP MLA Kuldeep Kumar alleged that Atishi was also manhandled by the area DCP when she went to the camp to protest. Police, however, refuted the allegations. Addressing a press conference later at AAP headquarters, Atishi said that chief minister Rekha Gupta claimed that no jhuggi would be demolished in the capital, but the Delhi Development Authority (DDA) and Delhi Police have planned a bulldozer action on Wednesday at Kalkaji's Bhoomiheen Camp. "Today, the entire area was surrounded by police and CRPF, who began forcibly evicting residents from their homes," Atishi alleged. The senior AAP functionary said the families were living in the area for 20-50 years and demanded that they also be provided with a flat in multi-storeyed DDA flats nearby. "A total of 3,024 flats were built by DDA. Till now, only 1,862 flats have been allotted. Why are the remaining homes not being given to these jhuggi residents? Atishi said that when AAP was in office, it was totally against the demolitions of jhuggis.

Former Delhi CM Atishi removed from protest site at Bhoomiheen Camp; ‘she has not been detained', says DCP

Former Delhi chief minister Atishi was removed from the anti-demolition protest site in the Kalkaji area Tuesday after the police claimed that she was asking people not to vacate the houses at Bhoomiheen Camp. The Delhi High Court had earlier dismissed petitions by the slum dwellers against the impending eviction and demolition. Taking to X, Aam Aadmi Party (AAP) leader Atishi posted, 'I have been detained at Baba Haridas Nagar police station (Jharoda Kalan), 43km from Kalkaji.' She has been removed from the spot under section 65 of the Delhi Police Act.' The police said they were checking the situation at the site in view of the demolition to be carried out on Wednesday, when Atishi reached the Bhoomiheen Camp and instigated people, asking them not to vacate. After repeated reminders not to do so, officers had to remove her from the location to avoid unnecessary commotion, they said. On Friday, while deciding pleas by 417 residents of Bhoomiheen Camp in Kalkaji seeking the court's protection from demolition of their settlements and rehabilitation, the Delhi High Court said, 'Encroachers cannot claim the right to continue occupying public land pending the resolution of their rehabilitation claims under the applicable policy, as this would unduly impede public projects.' Reasoning that the right to seek rehabilitation, as it is, is not an absolute constitutional entitlement 'available to encroachers such as themselves', Justice Dharmesh Sharma added that 'determination of eligibility for rehabilitation is a separate process from the removal of encroachers from public land.' Of the over 400-odd petitioners, the high court granted some relief to around 30. The nearly three-decades-old slum cluster was home to migrants from UP, Bihar and West Bengal, among others. The petitioners first moved the court in 2023, claiming that the Delhi Development Authority (DDA), in 'an arbitrary and illegal manner, proposed to demolish their jhuggi-jhopdis'. On June 2, minutes before petitions to stay demolition of homes at the slum in Southeast Delhi's Govindpuri were heard by a vacation bench of the high court, the civic authorities had already started razing down the hutments. Delhi: 3 men posing as transgenders held for soliciting near Azadpur mandi

The Delhi Police has apprehended three men for allegedly posing as transgender persons and soliciting in northwest Delhi's Azadpur area, an officer said on Tuesday. Anil Kumar, 35, Prem Kumar Mahto, 30, and Sachin, 35, all residents of Jahangir Puri, were apprehended during an early morning operation near Fruit Mandi, Azadpur, on April 25, he said. The three had dressed as women, complete with makeup, to solicit near traffic signals in the area. "A specific input was received regarding certain male individuals masquerading as transgender persons and engaging in illegal activities, including begging and soliciting, in and around Fruit Mandi," Deputy Commissioner of Police (North-West) Bhisham Singh said. The three at first asserted they were transgender, but confessed to being male after sustained questioning, the DCP said. They were booked under sections 91, 92, and 97, related to behaving indecently and causing annoyance, of the Delhi Police Act, the officer said.
